When I get the registration email, I’ll pass it along.

That’s the email I’m looking for. The one that tells you about the wait.

Have you received an emailed response?

I am investigating some troubling behavior and am looking to collect some of these emails to see if there is a pattern.

So if you could share your e-mail (black out any PII) that would be great.

It states in the case notes at the bottom. Same place that says cane swords are not deadly nor dangerous weapons.

Came knives are not, cane swords are.

They sell "fish wackers". Some are shaped like a mini baseball bat.  Others shaped like half the length of a billy.  Both are made from metal and have a soft foam grip with lanyard.

Pics shown on RSN's post is not considered a billy club? I am confused.

It’s a sap or blackjack.

a sap is a leather club filled with a metal rod or bar, lead, sand or other material that can deliver a crippling blow in a close-quarters fight. Typically, a sap is flat and looks a bit like a beavertail. It's made with heavy leather and is surprisingly easy to carry and deploy.

It’s very i portably to read the case notes on laws like this. Oftentimes definitions are changed,modified or clarified in court and by the AG.

We can Officially confirm…..

As of this morning Honolulu Police Department is no longer charging the rap back fee or requiring enrollment when applying for a concealed carry license.

Everyone that was previously charged the illegal fee will be getting a phone call or letter letting them know that they have been issued a refund.

If you paid by card you will get an automatic refund. If you paid by cash you will be required to go in person to collect your money.

Hawaii’s ban on batons, Billy clubs and sticks is unconstitutional.

This lawsuit was filed on Todd’s behalf by Alan Beck and Rick Holcomb. These are the same lawyers that won my first lawsuit 7 years ago.

Yesterday, it was brought to our attention that HPD is (illegally) charging some people $43.25 just to apply for a concealed carry application. How were they doing this? By making them (illegally) sign up for Rapback.

In 2018, Hawaii was the first (and only) state to require people that wished to obtain or register a firearm in the state to sign away their rights and enroll in the FBI Rapback program. For the privilege of doing so, the state deemed that people should be charged a one-time fee of $43.25.
Rapback is an FBI program that enrolls Hawaii gun owners into a constant background check system, where they become a suspect of all crimes in the US, just for owning a gun in Hawaii.

When and how Rapback enrollment can be done is set in Hawaii law. Relevance to firearms is within HRS1345-2 and 134-3 and says that, "The issuing authority shall perform an inquiry on an applicant by using the International Justice and Public Safety Network, including the United States Immigration and Customs Enforcement query, the National Crime Information Center, and the National Instant Criminal Background Check System, pursuant to section 846-2.7"

HRS 846-27 says: Except as otherwise provided in this section, criminal history record information shall be used exclusively for the stated purpose for which it was obtained in accordance with section 378-2.5. (43) The county police departments on applicants for permits to acquire firearms pursuant to section 134-2 and on individuals registering their firearms pursuant to section 134-3;"

As you can see, it mentions NOTHING about sections 134-9, which is in regards to Hawaii's concealed carry laws. Furthermore, the fee for a concealed carry permit (when issued) is $10, and this is contained in 134-9: "(d) A fee of $10 shall be charged for each license and shall be deposited in the treasury of the county in which the license is granted."

Section 846-2.7 is explicitly clear, the Rapback enrollment/background checks CANNOT be used for any other purpose than those stated in the law, and section 134-9 is also explicitly clear, the only fee allowed to be charged is the $10 fee.

So this makes it clear that HPD (and possibly other counties) are illegally signing people up for Rapback and stealing their money to do so.

We don't know how many people have fallen victim to these scheme, and likely never will.We did speak to the police department this morning and expect to hear their explanation on Tuesday.

If you have been charged this illegal fee, do reach out to us. It's likely that our lawyers would be interested in hearing about it.

How would one state find out that you were denied a ccw in another state?  Is there a "rapback" version of ccw permit info shared by states?

They ask you on the form and if you lie it’s a felony (usually)

I was really hoping to not incur an additional 40 plus dollars on the "rapback" fee.for my gf since we were not applying for a pistol or rifle permit that day. Just the CCW. Also, no heads up on their website nor signs posted, while waiting in line, requiring us to fill out the Permit to Aquire application and the two medical forms (thereby forcing us to pay the rapback boondoggle while only starting to fill out the PTA app and med forms when we get to the counter). Lines would move faster if people were better informed.by HPD. I guess this is by design. I hate wasting my time and my dwindling resources.

Im literally at HPD as I write this.

I just spoke to the sergeant for the Firearms Department informed him that they cannot enroll people or charge people for rapback when applying for a concealed carry license.

Who can be enrolled in rapback except by state law, it does not include those applying for concealed carry. The fee that can be charged for concealed carry is set in law it is $10, there is no option for them to charge the additional fee for the application.

They will kick it upstairs, I will not be back to HPD until Tuesday and told him I expect an answer as to what they’re gonna do then.

Pretty much none. Either take with you by transporting using state laws for transportation or ship via FFL. HPD says you have to let them know if a gun leaves the state but:
1. I doubt it
2.  What are they going to do?
3. I know many people that never have and nothing happened

This was last time I read something. Could be wrong or could be changed, but I doubt it

State law requires it.

Just wondering will the person need to be present when putting there gun under my name. I was told seller doesn't need to be present. I know I'm going have them take a pic of my permit for there documents. But just wondering if they will need to meet me at the police station. Thanks in advance.



Seller does not need to be present, seller dosnt even need to see your permit.

You are required to have one, but unlike a pistol, they are not required to sign it.

Also, you might want to reconsider letting them copy/photo it.

Your permit contains more PII then your drivers license. There’s no reason for them to have a copy of it.

Rapback can not be used for CCW. The law only allows it for permits to acquire and registration.

I was there this morning and they made the guy fill out all 3 of the permit forms.

They are also providing me with 100 copies of each everyday I go in a It’s needed. I’m Getting 700 pages a day from them.

I'm at HPD registering pistol bc its been almost 1 month since I registered online and no email yet
while I'm there I ask a question to one of the cops, "do I need to fill out PTA forms and health forms when applying for ccw?"
cops reply, "whatever is on the checklist is what we need."
me, "so we don't need to bring those PTA and health forms?"  bc its not on the CCW checklist
cop, "whatever is on the checklist is what we need."

either the cop doesn't know what is required paperwork, or doesn't care, or is trying to mess with me by just repeating what was said the first time.  either way that's the wrong info.  never changes
