Legislative updates.

Congratulations on getting these 2 bills passed:
HB3298 Big Island shooting range planning group.
HB1872 Recognizing game mammals and birds as a important food source.
These bills passed through the legislature with your support and are not on Governor Ige's Intent to Veto list.  Therefore they will become law by July 12th.  The Big Island range project has been in the works for over 10 years by On Target Hawaii and has faced setbacks, but the work continues on thanks to this bill.  Thanks to Hawaii County GMAC and hunters for introducing HB1872 to protect hunting traditions in Hawaii.

Hunting bill is on the Intent to Veto List:
SB3179 Bounty for Axis deer management offers cash incentives to hunters to control the overpopulation in Maui county.  The Governor believes bounties are ineffective and will lead to fraud and trespass.  Please contact the Governor's office with your comments https://governor.hawaii.gov/contact-us/.

Anti-gun bills passed:
On June 3rd Governor Ige signed into law HB2075 Requiring in-person inspection/registration for firearms acquired from out of state, person to person, or assembled with engraved registration numbers.  This conflicts with the Federal District Court's ruling in Yukutake v Connors which struck down the requirement as unconstitutional.  Honolulu Police Department has updated their website to reflect the changes.  It is unknown if other county's are following.  Firearms acquired through FFL's may still be registered remotely and are exempt from the in-person inspection/registration requirement
We are confident that we will prevail in the 9th Circuit Court of Appeals in Yukutake v Connors.

First 2 days of bill intros, not much to report right now.  It may be a light year for gun control due to it being an election year.  Things are going badly for the err....gun control side nationally... and gun control loses votes.  It has less of an effect in Hawaii due to our one party state.  Everytown isn't as active in other states probably for this reason and there's rumors their donations are down.

It's been a slow start so far with a relatively small number of bills coming up though we still have 3 days to go for bill introductions.  Also last year's bills, 2021, are still in play but legislators will reintroduce bills rather than bring back old ones 90% of the time.

Biggest one so far is SB2800 which adds requirements for concealed/open carry in expectation of a positive SCOTUS decision in NYSRPA.  Cuts down permits to 6 months long (from 1 year).  If Hawaii has the national average of 6% of adults having permits, then 60,000 people would need permits and police departments would have to process 120,000 applications each year.  Plus a 16 hour training requirement, must carry a electric gun with the firearm, etc.  Even police officers don't have these requirements.  Thank Senator Lee for this which he also introduced in 2019.

Other one is SB2738/HB1732 banning electric guns from government buildings.  This bill is a "not my problem" type of law where the government doesn't care what happens to you on your way to the government building or security inside of the building.

"Electric gun" means any portable device that is designed to discharge electric energy, charge, voltage, or current into the body through direct contact or utilizing a projectile.  "Electric gun" includes devices commonly referred to as stun guns and Tasers.  "Electric gun" does not include any automatic external defibrillator used in emergency medical situations.

I was afraid of this and there might be more restrictions they are concocting up because they know most likely SCOTUS will rule against them.

All of this to complicate and hinder and discourage self protection efforts by law abiding citizens.  All the while the criminal elements somehow still manage to obtain firearms illegally.

Instead of working to stop the criminal element from obtaining firearms, they focus on restricting the ability of law abiding citizens to protect themselves, saying we must be expert witnesses and to run away from the bullets that are chasing us, lol!

Hawaii legislators are not interested in our safety.  They are interested in their political agenda.  And a big part of their agenda involves restricting or eliminating the 2nd Amendment.
Sometimes you gotta know when to save your bullets.

Liking HB2075 regarding permits to acquire *insert sarcasm*. Because they were forced to eliminate the 10 day expiration period, they're now just moving the goal post to 30 day expiration. So in reality it doesn't change anything. But you have to love the reasoning that cuts both ways. Why for the handgun PTA but not the long gun? Optics of control.

..."The legislature finds that, if a permit to acquire has an excessively long expiration date, some of this background information, including relevant mental health information, may become outdated by the time the permit is used. People often change their names or addresses, and their appearances can change over time. More importantly, people can experience events in their lives that disqualify them from owning firearms, such as criminal convictions, mental health diagnoses, or being subjected to restraining orders."...

They also want to keep physical inspections in place with the exception of dealer purchases. So all private party transactions will require a visit back

HiFiCo thanks for all you've done, but it looks like another court battle here if it passes.

All of this shows what dicks our politicians are. I guarantee you that if gun control was higly unpopular and pushing for it likely means you won't get reelected, they would flip sides. All they care about is staying in office with its perks.

Popularity of policy positions matter more that the purpose, goal, or viability.  It's all about telling the people what they want to hear,

One more day of bill intros left and it's been light so far.  The House seems to be behind on updating their bill statuses or they maybe limiting the number of bills being introduced.

The Governor's office submitted SB3043/HB2075 to address my permitting/registration lawsuit.  Essentially they want to track all firearms in Hawaii by requiring in-person inspection for firearms acquired out of state, private to private sales, and ghost guns.This goes against the Federal judges order in my lawsuit.  The team is figuring out options on how to handle this.

Looks like hopes for a Big Island range is still alive in SB3298 which calls for a working group to find a place and plan for a range.  This has been ongoing for about 10 years with constant roadblocks.

Also a few bills to control Maui's axis deer overpopulation problems.

is it just me?  it seems that most modern metal firearms nowadays are engraved, either laser or CNC, not roll-marked, not metal-punched for ID numbers like the old days.  and all polymer firearms have embedded tags for serials numbers.  kinda sounds like ALL firearms to me will have to be inspected?  going back to the old way, rolling back the HIFICO progress.

That's all folks, intro deadline passed yesterday.  Lighter year on the gun control push and a still less than my optimistic projections.

We'll be pushing HB2464 which removes the duty to retreat when using deadly force.  There is still the requirement to be threatened with serious bodily injury, but it removes some liability and hesitancy from the victim.  It got a good amount of support from the House judiciary committee last year, so it's got a shot at passing.

No committee hearings scheduled yet.  These bills will likely start popping up towards the end of second week of Feb.

FYI, these are last year's bills that saw action.  These could be carried over to this year.  Two bills that advanced the most, SB301 Mag ban, SB307 50 cal ban were crossed over tot he House where it was stopped by JHA committee, they weren't interested in them.

Got a first committee hearing on a minor bill, HB1456 which basically upgrades the theft charge if someone steals an electric gun.   In the House JHA committee on Tuesday.  Write testimony through the capitol website.  Capitol is closed so Zoom testimonys only.  This is a good chance to practice your Zoom setup and skills before the other gun bills come up later.

It's a bill we can support to discourage thefts of electric guns and show legislators that we want to punish criminals with weapons.

Personally I don't think the law is really needed but I'll support it.
