So the electric gun bill is dead.  Supreme court has already said that banning them is unconstitutional and the state is ignoring that.  So I guess that means the president has to enforce the supreme court decision which is not going to happen. 

So there is really no avenue for fighting a law in Hawaii then.  you cant use the courts, you cant get the state rulers to overturn their decisions...

So I guess that means why follow the law if it all gets ignored in the end anyway?

on a side note, I wanted to test a patient yesterday for coronavirus and the department of health wont allow it because the patient did not travel to china....I guess they havent noticed the virus in 80 other countries.     we are so screwed.
Do we really want to start listing the idiotic completely illogical and evidence-devoid decisions of the moronic socialist Democrat "progressive" gubmint the vast majority of the people of Hawaii love and continue to re-elect?

Tracker updated, lots of bills died, others on 3rd reading on Tuesday, and the rest crossover to the other chamber.

More updates later when I get a break.  updates are a little slow as I'm burned out from all of this.

Tracker is updated.  Surviving bills have crossover from Senate to House and House to Senate and will repeat the committee hearings again.

Senate hearings are on Thursdays for the bills that crossover from the House.  The HIFICO testimony forms page will be up later tonight for these.
HB1902 Mag ban does not have grandfathering and includes the mental health checks as a minor.
HB2709 Estates/Probate hasn't changed much.
HB2736 Ammo checks still requires showing your registration form.  However it has exceptions for possession at shooting ranges.
HB2744 Gun violence commission still has the "ghost gun" bill attached to it.

Help the Hunters out by submitting SUPPORTNG testimony for SB2417 which recognizes game animals as a sustainable food source, which will help protect hunting against future laws and regulations.  Submit testimony at the Capitol page in the link.

Substantive resolution deadline has passed and there are no firearm related ones such as repealing the 2nd amendment.  There are a couple of hunting related ones to Support SCR62 and SCR138/SR98 which helps to protect hunting lands and restore game animals for hunting.  Please support these when they go to the committee hearings.

SCR119/SR79 tells the marines to stop shooting before 10am at Puuloa Range in Ewa Beach.  Fat chance of that happening.  Marines will start implementing night fire qualifications soon.  I'm guessing the neighbors aren't aware of that yet.

With the legislature being in recess for a while, I'm wondering if they will be affected by the June 30th state year.  They've completed 33 out of the 60 days legislative term in the Hawaii Constitution.  Can they complete a session less than 60 working days long?  Can the session go past June 30th?  I dunno.  They could rush the gun bills through quickly if they want to, a month or less from restart of the legislature to Governor's signature.

Legislature is opening back up on Monday.  Their focus is on COVID stuff and I'm not sure if they'll bring up the gun control bills.  Time is short as the June 30th deadline is coming up.

I wont trust them for anything after reading about unconstitutional solutions to track US citizens visiting the State of Hawaii. Ankle bracelets. Imprisoning them in a hotel. Arresting them for getting food. After these authoritarian measures what tourist would visit the "Aloha" State?

Legislature went back into recess today and will be resuming on June 15th to focus on the budget, COVID, and sunsetting bills.  There is a small possibility that the remaining gun bills could come up.  The House Bills in the Senate still needs to go through JDC with Karl Rhoads which is possible with HB1902 Mag Ban most likely to be heard out of the bunch and still needs a grandfathering clause (grandfathering unlikely).  The Senate Bills in the House are unlikely to advance due to them needing to go through two committees and time limitations.

I'll be putting a mission out for people to talk to their legislators about this and general firearm stuff over the next month.  Mostly to start communications with them to prepare for next year since legislators should have a bunch of free time to talk now.

Bills are up for hearing in Senator Rhoad's JDC committee.  I thought it would be unlikely that the bills would come up since the legislature is focused on COVID, budget, and sun-setting bills but it was an unusual year where legislators went above and beyond in pushing for these gun control bills with joint committees, early hearings, press conference, and appearance by the HPD leadership club.

HB2292 Electric guns is the first time this committee will see a electric gun bill.  Rhoad's refused to pass it in the past even with it's overbearing restrictions however he's under pressure to pass it with the expected upcoming win in the Roberts vs Conners lawsuit which would result people being able to buy tasers without no restrictions.

HB1902 Mag ban.  This is the big bill they want to pass this year.  There is no grandfathering clause in it so we have to convince 3 members of the committee (Keohokalole, Gabbard, Fevella) to include it.  Rhoads kept the grandfathering clause in the Senate bill SB2519 back in February so it may be possible.  Grandfathering is an insurance policy in the event SCOTUS doesn't take up a magazine ban or other substantial 2nd Amendment case or if we lose a SCOTUS case which is a tight vote now.  This also includes the family court background check which may be unpopular to some Senators.

HB2744 Ghost guns.  This is the first time this committee will see a Ghost Gun bill.  It has been combined with the Gun Violence Prevention Center which I think may be stripped out due to lack of funding.


Written testimony will be needed, and we need people to call the committee and Senate President and try to leave a message or speak with them directly.  One strategy is to complain that the committees should be focusing on the budget and COVID.  There are only a handful of bills in the legislature right now with most of them on COVID, emergency measures, budgeting, and sunsetting bills.  There are a few others on environmental stuff and sex/domestic abuse type bills.  Everything else is dead.

Another thing that may or may not work is getting changes made to the bills which could run out the clock.  Like adding grandfathering to the magazine ban or dropping the gun violence center from the bill.  This would result in delays for the final vote, requiring the House to vote on it again, and conference committee.  The clock could run out or legislators may not want to allocate resources into it.

There are proposed drafts of all 3 bills on the capitol bill status pages.  HB1902 Mag Ban adds in grandfathering and removes the family court checks.  Not sure whats in the other two.

Looks like they are reducing restrictions so the bills can pass easier and make the deadlines.
