Legal and Activism / Need help finding an old legal case

Aloha all,

I am trying to locate an old (pre-Heller I believe...) gun case.

The case revolves around a Sheriff (could have been a Chief of Police) in a may-issue state that simply denied all ccw applications. When sued, he admitted such in court. The decision was that he could not arbitrarily and without reviewing the individual applications to determine "good cause" deny every permit application. But, that after actually reviewing those applications wasn't obligated to actually approve any of them. So, the bottom line was that he had to read the applications and actually exercise his lawful discretion in approving/denying submitted applications, but not that he actually had to approve them....which, if I remember correctly, was exactly what he did.

Anybody willing to exercise their google-fu to see if they can locate this case? I have so far have not been able to do so, but just haven't had a lot of free time to do a more comprehensive search. Thanks in advance....

Tennessee will have, effective 1 July 2016, a law that allows anyone authorized to carry a concealed firearm, and who was disarmed and subsequently harmed, to sue the property owner.

Way to go Tennessee!!

So, the defense attorney representing the Chief and his wife expects an indictment. If that happens, will Kealoha be stripped of his police powers (ROPA) and his ability to have firearms?

The Secret Service will be doing background checks on the press for the Democratic and Republican conventions. And, seems the press doesn't like it. It appears that they are concerned that some non-violent crimes might prevent then from getting credentialed and that there is no appeal process should they be denied....

Sounds like the First Amendment, at least for "the Press" is being treated a lot like the Second Amendment....and I don't recall many in the press being terribly concerned about that....

SB2954 was heard in committee today and was scheduled for a vote. One of our friendly legislators thought there was a problem because there was absolutely no testimony in opposition so he was able to defer it until tomorrow. He called and asked why there was no testimony. It originally appeared that the committee wouldn't take testimony but then changed their mind and opened it up late yesterday sometime.

Bottom line: We need to bury the Reps. with testimony. Even if you have sent it in before, send it in again, soon! Contact your reps and send it to them. I was looking over the number of testimonies sent in and considering the number of firearms owners, the numbers were pretty slim. Especially for the latter hearings. We really need to flood them with testimony.

Here is the message that HRA just sent out:

We just received word from our supportive Representatives that SB2954, the Senate version of HB 2692 (Rapback), is up for floor vote in the House on Thursday, 4/7, at noon.  The vote was deferred until tomorrow to give the representatives the opportunity to see how their constituents feel about the bill.  You MUST contact your representative and let them know you are STRONGLY OPPOSED to this bill.  If you aren't sure who that is, go to: www.capitol.hawaii.gov and on the upper right of the page, enter your street name where it says "Find your legislator".
 
If your representative is on the list below, you don't need to contact them, these representatives are already supportive of your Second Amendment rights:

Points of concern regarding the bill:
Strongly Oppose.  It's similar to HB 2692.
* It enrolls law abiding applicants for firearms permits into a Federal Database to track criminal activity.
*  It violates Federal law, which protects all legal firearms owners from being placed in a Federal firearm owners database.  The law is the "Firearms Owner's Protection Act of 1986".
* No other state in the United States is using this mechanism to track firearms, most likely because they have realized that doing so violates Federal Statutes.
* HPD Major Richard Robinson stated in Senator Nishihara's PSM hearing that the database will include the applicant's name,  identifying demographics, such as birth date and physical characteristics and the category listed will be firearms. This violates the Federal Statute above.
* If passed an additional fee will be charged to each applicant for a firearms permit. The fee indicated is around $50.00.
* If passed this becomes an unfunded mandate on HPD to assign HPD firearms staff to track all of the hits that come in from the Rap Back system and to track them through to dismissal or conviction, a  very time consuming  and unnecessary endeavor.

I know this is last minute, but just got off the phone with one of our supportive legislators. 5 bills are scheduled for a third reading tomorrow and will likely pass if we cannot get more legislators to vote no on them.

The bills are:
HB1813 - Firearms prohibitions for those on the terror watch list
HB625 - Firearms prohibitions for those convicted of misdemeanor sexual assault or stalking
HB2629 - The "RAPBACK" bill or continuous background checks
HB626 - Carrying a firearm while drinking
HB2632- Mental illness (MH-1) bill with firearms confiscation

We need to bomb our representatives with phone calls to their office asking them to vote no and to remind them this is an election year and that their vote will be remembered. And while you can email them as well, it really needs to be a telephone campaign and it needs to happen immediately. Especially if you are in Karl Rhodes district. Please remember to tell them you are a registered voter.

And, to be most effective, concentrate your efforts on those that are likely to vote yes. If your Rep. is noted below, we don't need to call them as they are already supportive and are looking to garner the 10 or 11 more no votes to kill the bill:

A novel wound dressing now used to control severe bleeding on the battlefield will be available to civilian first responders treating trauma patients, the US Food and Drug Administration (FDA) has announced.

The agency today cleared XSTAT-30 (RevMedX) wound dressing for patients at high risk for immediate, life-threatening, and severe hemorrhagic shock and noncompressible junctional wounds when they can't be treated at an emergency-care facility within minutes. XSTAT-30 is not indicated for certain parts of the chest, abdomen, pelvis, or tissue above the collarbone, according to an FDA news release.

The wound dressing product consists of a syringe-style applicator holding 92 compressed cellulose sponges with an absorbent coating. The sponges expand with blood and fluid to fill the wound cavity, temporarily blocking blood flow for up to 4 hours. Each applicator's worth of sponges can absorb about one pint of blood, although the number of sponges needed to control bleeding will vary by the size and depth of the wound.

The same attorney that took on HDF's Chris Baker's case and the resident alien (Fotoudis) case, is looking for Kaiser members for a possible legal action. I will be sending this letter to the mayor to voice my concerns:

Mayor Caldwell,

After viewing the story on KGMB about HPD wanting to destroy $500,000.00 worth of fully functional guns rather than recoup some revenue on them, we at Lessons in Firearms Education (LIFE) and the Hawaii Rifle Association (HRA) were quite dismayed. In these times of lean budgets and continual cost cutting to needed city services, to throw away a half million dollars seems senseless.

The reason your office and HPD gave for not selling to the public seemed to be a slight on those legal gun owners who would have purchased them and who supported you during your election. You should be ashamed for suggesting that the good citizens of Hawaii cannot be trusted with buying HPD’s surplus guns for fear of them falling into criminal hands when record numbers of firearms have been bought by those same citizens for the last 10 years without any such problems.

To claim that selling these guns was going to "put them on the streets" as if to infer they were destined to fall into the hands of criminals seems a bit irrational and alarmist considering the rigorous processes that are currently place for the sole purpose of preventing that type of diversion and that law abiding citizens go thorough each and every time they purchase handguns. In conformity with Hawaii law, HPD’s surplus firearms could only be sold using this process, which includes mandatory training, a background check, and a 14 day waiting period.

We at LIFE and HRA offer our assistance in finding a way to sell these fully functional guns to responsible gun owners.

We at LIFE and HRA respectfully request the decision to destroy these fully functional guns be reversed.

Events / Range clean up day -This Sunday

Aloha,

On Sunday, the Hawaii Rifle Association will be cleaning the Kokohead Range. We will begin at 8 am and run until we are done.  We hope to finish before noon, as we will have some big machinery there.  Please bring your weed whackers, mowers, metal rakes, and chain saws.  We will provide water, energy drinks, and some fruits.  If the work takes longer than we expect, we will provide lunch, but we hope to finish quickly.

We still need at least two open bed trucks to move the tree trimmings and other yard debris.

A NY firefighter, injured during the 9/11 response, has $100,000 worth of guns taken, and his permit revoked after an argument with his son.

From the article:

“it is the policy of the ... Nassau County Police Department to confiscate all firearms with regard to any domestic disturbance call, whether such call is valid or not ... and once confiscated to prevent the return of such firearms on any pretense that can be imagined, and either destroying said firearms or converting them to the Department’s use without compensation to the owner

I guess it wasn't enough for them to take away a retired NYPD cop's gun and permit after seeking treatment for insomnia......

The topic will be Hawaii gun laws and what additional gun laws are needed. Note that one of the panelists is Karl Rhoads, the Chair of the Judiciary.

I am curious. When (not if...) Hawaii is either forced by the courts to change the current laws pertaining to the issuance of a concealed carry permit (from "May" to "Shall"), or if a bill is introduced for the same purpose, what should Hawaii's "new" concealed carry law(s) be?

Here's a few things to consider:

Training - Should there be mandated training? If so, how much and what should it consist of?

Restrictions on where you can carry- Are there any places you shouldn't be able to carry your legal firearm? Should there be any other restrictions, such as drinking and carrying?

Reciprocity- Should Hawaii recognize other state's permits?

Renewals/Fees - How often should the permits be renewed and how much should it cost?

Anything I missed?
