And nothing happened.  Evidently it's ok for an HPD officer to leave his firearm unattended.  The prosecutor's office didn't even consider this in their 70 something page report on the incident involving the killing of a man that barricaded himself, took the HPD weapon, and threatened officers with a knife and their own rifle.

Imagine if one of us left a rifle unattended.  OMG.

Cops are exempt from many Hawaii laws.

They are exempt from the new safe storage requirements passed last month.  Why they don't have to secure their guns at home I dunno.

Yeah, and the ones they’re not exempt from, well, that’s what all those free passes are for.

I bet a lot of us personally know specific stories of cops walking away from things that would get us civies full vindictive prosecution and the book thrown at us.  I do, and I’m not remotely close to HPD.

Watch the first time a CCW permit holder makes a mistake - innocent or not.  They’ll invent new forms of personal destruction.

Obviously. It's not like people ever steal guns from cops.  ;)

If the perp killed an innocent bystander with the HPD officer's weapon, then what?

Remember, he didn't wrestle it from an officers hands, he picked it up because it was left unattended.

What HPD, governor, mayor, police chief, and prosecutors office going do?  Offer their hearts and prayers to the family of the victim?

"Our hearts and prayers go out to the family and friends of the victim(s) during this horrible tragedy....."

Yeah, right.  F*ck you.

This thread should just end right here,

is just chatter by comparison.

I don't think criminal charges would have fit this case. I am sure they will have internal consequences but there doesn't seem to be criminal elements to their mistake.

Oh, but what if I left my rifle "unattended" as in not secured........who's the criminal now.

HPD/LEO's are immune/excluded from many gun laws and even if they did break a law, they won't get prosecuted for it.

I like Larue Tactical: "if it's not legal for your voters to have, we won't sell it to you" (with regard to LEO agencies asking for stuff from them.)

The only reason you're probably right is that law enforcement enjoys an exception to almost every firearm infraction in HRS-134.

If I left a firearm loaded and unlocked in my garage, and a kid wanders in, do you think there would be no criminal elements for my mistake if the kid commits a crime with it -- like pointing it at police?

The Prosecutor will just say, “No charges. Everyone makes mistakes.  Flapp is a good boy.”

Then you will get a call from HPD asking if you want to pick up your firearm or have it delivered.

If you left a rifle unattended/unsecured in your house and a burglar picked it up you could still shoot the burglar.

Criminal, no but you could be hit with a civil suit.

Criminal, no but you could be hit with a civil suit.
Quote
§134-9.3 Leaving unsecured firearm in vehicle unattended; penalty. (a) No person shall intentionally, knowingly, or recklessly store or otherwise leave a loaded or unloaded firearm out of the person's immediate possession or control inside a vehicle without first securely locking the firearm in a safe storage depository that is out of sight from outside of the vehicle.

(b) For purposes of this section, "safe storage depository" means a safe or other secure impact- and tamper-resistant container that, when locked, is incapable of being opened without a key, keypad, combination, or other unlocking mechanism and is capable of preventing an unauthorized person from obtaining access to or possession of the firearm contained therein. A vehicle's trunk or glove box alone, even if locked, is not a safe storage depository.

(c) This section shall not apply to a person in an exempt category identified in section 134-11(a).

(d) Any person who violates subsection (a) shall be guilty of a petty misdemeanor. [L 2023, c 52, pt of §2]

I did say "in my garage," which may or may not mean in my vehicle.

Criminal, no but you could be hit with a civil suit.

It would be a misdemeanor and a firearms possession ban for 20 years along with possible civil liability.

Under secure storage or negligent storage.
