I would hesitate to be the test case for that one, but one could always say they were on their way to the car.

Prosecutor will ask, how come it wasn't in an enclosed case?  Why was it on oneself.

Actually unless your lease or contract prohibits it you are. You can carry on any private property you have consent to be on.

Hawaiis place to keep and carry laws are unconstitutional and wouldent stand up to any level of scrutiny.

It maybe, but I don't have the time or money to fight a court battle.  In the mean time, my firearms are confiscated.

I would suggest only to move here to retire if you can afford it. 

Why:

1) Cost of living is higher
2) Gun laws suck
3) Cost of living is higher

My friend moved to vegas.  He bought a 5000 sq/ft home for $320K brand new in a gated community.  His wife doesn't have to work and his new job only pays him a little more.  Where as over here they had a 2500 sq'ft home that cost them $600K.  They both had to work.

So I've been new to the firearm community for about 3 months now.  My wife has always been ok with buying stuff, but more like "what the hell is he going to use it for?" in the back of her mind. 

Well at 3am this morning, my neighbor was robbed at gun point.  About 20 feet from our front door (apartment).  So  now she is 100% on board and knows why we need protection. 

And we just bought a shotty that day also.  She spent about 3 hours looking at accessories to trick it out.

Something to consider: The Ninth Circuit has ruled (Peruta) that there is no constitutionally-protected civil right to bear arms concealed (that is merely a "privilege" that the state may "regulate" in any way it deems fit, including a total "de facto" ban), and thus any legal appeal on Hawaii's denials of CCW licenses is doomed to failure unless and until some case re CCW as a "right" would be upheld by the SCOTUS. This is likely years away, if ever. You might want to apply for an open carry license (either instead of or in addition to a CCW license) if you want to have grounds for possible legal action. Of course that's doomed to failure as well, but at least you'd be failing on untrod ground. There is no end to the arbitrary, capricious and illegal infringements of our civil rights here in Hawaii, so thanks for making the efforts to at least make some noise, pending the discovery of some secret formula for actions that would actually be effective in changing things here.  :shaka:

Apply more for the fact that if an "exceptional circumstance" does arise and I am left unarmed to protect myself or others then I can hold HPD liable because I did apply and got denied.

NP. I'm new to the firearms community (3 months) so I want to do what I can.  You know the saying "no vote, no grumble".  I'm actually going to apply for CCW here knowing I'm going to be denied.  Still waiting on my Nevada CCW, it's only been 45 days.  The website says don't call unless it exceeds 120 days.

Got a call back at 645am from his office. The gal i was talking to seemed on it. She was actually looking up the HRS134 ccw code as we spoke. And she was very sympathetic for us. She will pass the word to DC about thr bills language so Hawaii can carry.

So you're saying that you have good reason to believe that government agencies/agents will take retributive action against you if you exercise your First Amendment (and possibility other) Constitutionally-guaranteed rights, especially in the most important area of protected speech, political speech?

The term "they will  look for a reason to punish" comes to mind.

From what I read, like London said, you shouldn't have had to surrender your guns.  Unless I missed something or interpreted the law wrong.  Only if a TRO is placed on you, then you have to surrender.  The law doesn't mention anything about household member having to surrender if another household member or relative has a TRO.

Damn, sucks to be you.  There was a book about Hawaii gun laws that they sell in LGS every year.  The arthur said he had his guns confiscated and had to reapply  (wait 2 weeks) to get his own guns back to him.  He couldn't just pick them up.
