Teachers have the responsibility.
If they aren't up to it, then they should not be
entrusted with ours kids,  lives and minds.
We are repeated reminded cops aren't here to protect you
they just enforce the law.  Hawaii is pretty warped in that area
as the laws don't allow you to protect yourself  in public, which
is a problem when the cops are 20 to 60 minutes away.
BTW; Never talk to cops, ever!
I never have and never will call a cop for help mainly because they
are the most dangerous people I know of.  They can kill indiscriminately
and get away it.  Even soldiers have a UCMJ and their personal honor
to direct their actions.  Local cops are a Political, union member,  loose cannon
with a Glock 17 or M4 carbine.

local cops protect their own. period.  And by "their own", I do not mean the citizens of hawaii.  Look at the recent news story with the cop that beat up his wife.  After the news broke and the video surfaced, he got promoted!  He got put on leave for 2 years and got paid for that.  And now he's shuffling paperwork at a desk in a police station, and still getting paid!  Beating up your significant other really pays off when you're law enforecement.

The teacher? the janitor? cafeteria worker?

In the case of a minor, whatever adults  are currently responsible for their care has a duty to protect.  From a technical standpoint, whatever charges they brought up against the deputy could be brought up against all adults in charge.  They wont obviously because of blowback, and successful lawsuits/prosecution would open a HUGE can of worms so would never happen.  That is part of the reason why some districts talk of arming school personnel if they are willing, as it is they are the guardians for the children while they're in school.    But ONLY law enforcement have no obligation to protect, period.

In general, unarmed or armed, 100 years old or 18 years old, MMA expert or wheelchairbound, male or female, etc.  the duty to self protection is EACH INDIVIDUAL's.  That is the reason for the 2nd amendment, to give the average citizen a reasonable means of self protection, if they choose to (and if the state hasn't taken away their right).

The Supreme Court ruled that the police did not have a constitutional duty to protect a person from harm. What he did was deplorable, but it was not illegal.

Self protection is the responsibility of every law abiding citizen. The 2nd amendment (normally) assists you in protecting yourself unless if the right is denied for whatever reason, such as denied carry rights or "gun free zones". In those instances, you have the utmost right to be a victim, but rest assured, the police will attempt to enforce the law afterwards, and find the criminal.

You'd be surprised what the police are and aren't allowed to do. They're generally treated as a protected class of elite citizens. The police can chase down an assailant or thief and shoot them in the back. You cannot. The police can "feel threatened" by a unarmed mentally ill man and shoot him dead. You cannot.

Hell the courts have even ruled that the police can KNOWINGLY allow their police dog to attack an innocent person, and they have no duty to stop the dog from mauling and potentially killing you.

But I digress.

I agree retrying Deedy for any lesser charges under the same crime (murder, manslaughter, aggravated assault) is double jeopardy.  Those charges should have been included as choices for the jury.  Too late to go back again (and again, and again).

The Deedy appeal was filed by Kaneshiro.  I don't think he'll be going to the appeals court on behalf of the state now.  The court may see him at some point on his own behalf once he's convicted of corruption.

Hopefully Kaneshiro's replacement is smarter and just takes the two losses he can blame on his predecessor.

Saw on the news last night, the case of guy who shot through the door was dismissed due to the prosecution taking an unreasonable amount of time to try him (civil rights violation).  Charges were dropped without prejudice, meaning he can be charged again later.

He likely wont be tried again.  They'll quietly drop the case.   If the situation was different, with little justification for a self defense claim, they may have been more willing to prosecute.  Hawaii prosecutors and lawmakers do not want a case that will more clearly define hawai's self defense law.  the way they prefer it is if people are under the impression that you should retreat to the bathroom, lock the door quivering in fear and wait until the police arrive.  Not greet burglars and criminals at the front door or in your yard.

Any updates on the following

1) The guy in Mililani who shot someone who was hopping the fence in his back yard.  Last I heard no charges were filed against the homeowner.
2) Guy who shot at the Navy sailor who was trying to open his door and shot  thru his door is not being charged yet.  No charges on having an unregistered handgun either.  Pending.  Shooter is claiming self defense and had a cast on his foot.



Any other situations pending?

I've noticed a similar pattern over the years.  Hawaii prosecutor office does not want to acknowledge or encourage citizens to use lethal means to protect themselves.  So instead of bringing these cases to court, they'll quietly drop the case.  For both #1 and #2, that's exactly what they did, and there was some sort of statute of limitation that ran out.   My belief is the State does not want to deal with the backlash against prosecuting claimed self defense cases, as it may lead to more favorable gun laws in hawaii. They'd rather just maintain the status quo on self defense laws, while continuing to make more restrictive overall gun laws.

Somewhat similar case, note this wasnt' even inside a home or indoors.  Merely on the property, and the thief was shot in the back.



Question: Whatever happened to the case against a Kahuku farmer who was charged with murder after fatally shooting a man who allegedly threatened him while trying to steal his crops in 2004?

Answer: The Honolulu Prosecutor’s Office said it has closed the case against farmer Khamxath Baccam and will not refile criminal charges after a judge dismissed a second-degree murder charge in 2006.

Baccam was accused of fatally shooting Marcelino Pacheco, 38, who was found dead on Malaekahana Road on Sept. 7, 2004, after Baccam walked into the Wahiawa District Police Station to report the incident.

Baccam fired a shotgun in self-defense because he “faced a terrifying encounter and felt the need to protect himself,” his attorney, Todd Eddins, said at a Sept. 14, 2004, court hearing.

Pacheco bled to death from shotgun-pellet wounds in the legs and thigh. City Deputy Medical Examiner Dr. William Goodhue testified at a hearing in 2004 that Pacheco had crystal methamphetamine in his system, which contributed to the bleeding.

My last trip to Lanai in April i flew HAwaiian Airlines. Same as usual from HNL to LNY. They check my Pelican case, throw in the firearms card, hang out for 10-15 min and if nobody comes out then Im golden.

Now When I flewback from Lanai on HA, the HA agent tells me something new Ive never heard of. She asked if I had ammo and I said yes. I told her its in the cooler, seperate from my gun case which is okay. So I asked her about the rules if I can I put my ammo in the same case as my rifle? She said yes, but it has to have the foam cut out to place the ammo box in its own spot.

Im ok with following rules for everyones safety, but I hate how its different every trip. Nobody knows the rules or just make up their own.

Like I said in this thread earlier....

On a side note, I think how they want ammo in "original boxes" is absolutely retarded.

yeah, something wrong with these Hawaii Judges.  "The Hawaii Judge" is now a regular joke nationwide.

i think they're in cahoots with the rest of hawaii politicians. they know there's no room in the prisons, so unless the crime is absolutely crazy like murder and rape, they'll slap these guys on the wrist.  the alternative is to throw criminals into an overcrowded prison, then it riots like maui, resulting in even worse press (for the politicians).  there's zero will power or state $$$$ to address this issue.

wow, prosecutors is asking for 18 months, he got probation   Even 18 months is extremely light for such a heinous and unprovoked attack.  Nothing new in hawaii nei.

Do you remember the domestic violence charge when war machine beat up his pornstar girlfriend in las vegas.? He got life in prison.

Do you remember when berdon beat up his wife ostovich bad enough to fracture her eye sockets in waianae?  he got probation.

Hawaii catch and release program still in effect.  But don't worry guys! rely on the police for self protection even though they have no  legal obligation to do so.   A cop can stand by and watch someone beat you to death, not lifting a finger, and he's perfectly within his legal rights.  The lack of obligation by the police to protect was affirmed by the supreme court.

its not a new regulation, just DA TSA/ticket agents making up their own rules. Even different airlines has their own policies.  idiots making up their own crap happens all the time. 

There's actually a lot of firearm theft from checked luggage.  Guess who? That's why many people separate their bolts or slides or whatever from the firearm and ship them separately.  Of course it doubles your chances of getting screwed if one of your bags go missing.  Pick your poison.

To me, the real scary thing is how complicit 90% of the media is downplaying and covering all of it up.

Most active shooters end up killing themselves so I think the major benefit of these two surviving is that we can study them and find out what led up to their act.

There's enough mass killers that didn't end up killing themselves to gather enough data points.  I honestly think the government knows what the problem is, but there's no willpower to do anything about it since there's no easy profit to be made.

Probably an assumption, but a good one IMO.  These guys were:

bullied
social outcast
on mind altering drugs
diagnosed with mental disorders

There's no real profit in attempting to solve the issue, which is probably mostly societal and cultural in nature.  IMO the breakdown of the "normal" standard 2 parent household in the US is a huge contributing factor to a generation of messed up kids.  But I'm digressing.

Yes, handgun permit a few weeks ago.  If anything, I'd guess if you ever went to a kaiser facility and saw or was officially recommended to see anyone related to mental health you got flagged. 

I'm someone who's generally pretty friendly and talks story with the general practictioner doctor and nurses.  But in hindsight that is NOT smart to do.   You could be talking about anything, but if raises a flag with them, they might refer you to a psychologist or a therapist.  Example:  He's talking with you about your health, how many times you drink in a month.  You chill out with friends, drink a 6 pack beer a few times a week, guess what?  You're a binge drinker.  Are you depressed or have another mental disorder?  "let's be safe and set up a meeting with one of our mental health doctors".  Etc etc.

in my opinion, a good thing this guy/girl/it survived.  If I had to guess, they probably planned on committing suicide after the shootings, but being jumped by students prevented that.  helps highlight the differences between the average law abiding gun owner and this obviously mentally unwell thing that 1. the system should have prevented from acquiring a firearm, and failed miserably  2.  gun free zone failed miserably.  3. firearms in the hands of "good guys" may have been able to prevent the tragedy from even getting to this level.

Also most of the main stream media sites are portraying the shooters to be "normal kids", using older pictures and avoiding using the purple hairled freak of nature pictures and avoiding mention of his social media posts because it paints liberals in a bad light.

Just curious if anyone else went for the CMP lottery?  I should be getting mine sometime soon.

In case anyone's wondering:
- looks like most pistols are reparked, mixmasters in good condition (no surprise right?)
- CMP let some gems slip through for those lucky folks - Heard of US&S pistols, some 1911s, and JSB inspector
- Gunbroker shows some completed listings in the $2000-2400 range, price of these pistols was 950 or 1050.
- roughly 20k entries, it will likely take 3 years to clear them all, assuming they release more pistols in the next 2 years.  With the current climate in congress, I think it's very unlikely more will be released within the next few years, let alone clearing the list over the next 5-10 years.

the actual people doing the permitting are actually pretty understanding if you're trying to do aboveboard transactions, and issues come up all the time due to the registration system being in place only since the 90s and the obvious bureaucracy of city government losing/misfiling paperwork.  And add the fact that many of these firearms are older and from a time where the receipts proving ownership werent really necessary.

Probably like 1/3 of the firearms existing in hawaii was purchased or obtained legally, but not registered (technically making them illegal)

honestly his biggest accomplismnet this term might be adjusting the makeup of the supreme court and circuit courts.  Though I would like to add that my viewpoint is that these judges should not be "liberal" or "conservative" but uphold the constitution and not pursue their own personal agendas.  The 9th circus is a laughingstock because of how blatantly they ignore the constitution.

The democrats screwed up big time during obama administration when they first decided to use the "nuclear option" to ram obama's liberal justices through the senate.  Mconnell later used this precedent to do the same for supreme court nominations. If another supreme court justice retires, it for sure will set the tone for the supreme court and lower courts for decades to come.  And all of this was for some short term win by obama

My anti-2a dad asked my thoughts about this today.

Told him Hawaii's the only state to deny all permits.  He said, well there are those who are not as "cool headed" as myself so he agrees.  Told him rights do not work like that.  He then brought up that parking stall situation in Florida where they guy was shoved to the ground.  I told him, if that happened to me in Vegas when I carry, that might be a possibility also.  The guy who was shoved was assaulted by another person.  So I told him, how about don't assault anyone and everything will be ok.  But I also told him, I would not argue over a parking spot or anything.  I deescalate situations and walk away before it gets to that point.  I would even apologize to the person, even when I know I'm right. 

Told him he's being conditioned by the media.  Gave him FBI/CDC stats on self defense usage and he didn't want to hear it.  And stats about those killed with guns from unwarranted situations about 1700 IIRC from 2017 FBI stats.  Remove the suicides, self defense, gang/criminal, accidents.  And how 500K-1 million use for SD.  So only a small percentage may be "not cool headed". 

He then said that the 2a was written when muskets were around.  Told him, so does the 1a only apply to paper and pen and not computers and technology.  Bill of RIghts written to withstand the test of time.  That's why they said "arms" and not "muskets". 

He then brought up his "feelings" and again told him rights don't go based on feelings.  Used Islam as an example for freedom of religion. 

So just to show, there's no logic that can be used to change someones anti 2a stance until something happens to them.  But he did kind of have an "oh" moment when I mentioned rape and how a gun can give the victim the best chance.

He wont listen, but give him this statistic.  Anti-gunners beloved police officers commit at 6-7x the rate of permit holders.  The general public commit crimes 37x the rate of police officers.  All else equal, if you're in a room full of the general public and police officers, those individuals would assault you multiple times over before there would even be a chance that a random permit holder would do something wrong.
