Problem is that the plaintiff’s will be given their licenses quickly since this suit is out. Then the court will have no choice but to moot the case. Leaving no real relief for everyone else. And leaving the court costs having to be paid by the plaintiffs.  They should challenge the license requirement in it self as unconstitutional.  No other RIGHT requires payment and license to exercise.

Political Discussion / Re: climate change caused Maui fires?
« on: August 16, 2023, 11:28:26 AM »
Whether it's "officially" ruled the cause was Climate Change, a hurricane, or other such event, it all falls under "Act of God" as normally included (or excluded) in most all property insurance policies.

Luckily the two exclusions in most policies are Earthquake and flood.  You have to get additional insurance for those acts of God.

For wildfire damage/devastation, if you live in an area prone to wildfires, you may also need additional coverage for that.

Hopefully this gets classified as a rare event -- hurricane force winds causing and exacerbating wildfires.  No insurance company should be allowed to sell policies in Hawaii if they try to exclude what happened on Maui.

Remember when the state created a hurricane fund to protect in case of another Iniki hurricane?  They did that for people who were uninsured or underinsured.  Abercrombie raided the fund to pay for higher state union salaries.

I wonder if someone at the top is already eyeing this as another "good crisis" that should not go to waste.

Of course it is. It’s already been stated by gov Josh Greed himself.

What about switch blades, gravity, and such?  Is these not covered as well? Or specifically butterfly’s?

I never heard of Maui doing controlled burns to reduce fuel, which they should do every year as wildfires were common there.  Would be difficult since most of Maui is private property.  Long term solution is to replant native trees to reduce the invasive foliage and restore the ecosystems, and train volunteers to fight the wildfires.

Previously person asked me to help them to pass a law to fight wildfires and get a water drop plane like they have in CA.  I thought it was a bit too much at the time but helped them anyways.

Shouldn’t property owners be up keeping their property in a safe manner, especially when said property poses a threat to the community. Also MECO/HECO share some of that burden in keeping areas safe from fire when their utilities pose such threats?

When all these huge billion dollar companies bought up all these lands post sugar, they should have been responsible for maintaining these properties.

Poor infrastructure and land management is the cause. Same as in commifornia. Of course they need to deflect from the obvious. Need to cover ass for the criminal negligence being preformed with our tax dollars and electrical profiteering.

You present a false dichotomy by implying that cops must do one or the other, stop drugs, theft, and assaults OR give traffic tickets.
Not only do cops do both, it is very often the case that traffic stops lead to the arrests of thieves and drug dealers.

For example, my house got burglarized when I was young. Cops did a traffic stop on a kid a day or two later and found his car full of our stolen items.

No it's called selective enforcement.

^^This

One example. Every single day I see Stolen property blatantly being used (shopping carts), yet I never see any arrests or prosecution. Don’t tell me the police never see it going on. This is right in front of the police station!  Yet they are one block over they are setting up speed traps to enforce a nonsense 25mph speed limit on a 4 lane main thoroughfare, which has no residential driveways and where the speed limit suddenly goes from 35 down to 25. I don’t speed and I’ve never got a ticket, this is just my observation. It more important to create revenue than stop thievery.

I do not blame the police. They are given this assignment. As well as if they do make any arrests, most definitely the criminals would be immediately released and not be prosecuted. Wasting all the officers time and effort.

Like I said in my post, if you read it carefully, the political leftists climate encourages and supports this nonsense.

Strategies and Tactics / Re: What’s your edc flashlight?
« on: August 12, 2023, 06:36:49 AM »
Been having zero issues with olights for many years now. At the moment I’ve been using the arkfield for edc. I don’t baby the lights and use them often as I work back shift in an industrial setting.

Back up is those little keychain olights.  USB rechargeable.  Saved me a few times when power went out in the head. Lol.

The left political class has turned the police and justice system from being a community protector and friend into an enforcer arm of their terror and extortion racket.

Don’t think it’s true?  Look around you while you drive around all the filth, squalor, vandalized property, public drug use, dumping, blatant stolen property being used, etc., then look at all the tickets being given out for victimless infractions of the driving laws. Or the constant harassment of the lawful person just trying to protect themselves and their loved ones.

It’s obvious that the left run government would much would rather harass those that are easy to victimize, such as the common joe just trying to make a decent living, than to go for those real criminals that are blatantly doing serious felonies.

People need to stop voting democrat.

DONE

You should too.  Be generous.  I know not many of us are shooting as regularly as we used to, because this city and state has been on an infringement rampage.  Use the money you would have burned on ammo to actually shoot back at tyranny through the legal system.

TRO issued, but only for the following

State law only, this doesnt apply to oahu or big island ordinance.

Law is suspended on the following

Parking lots belonging to city/state if its shared with another entity

Parks, beaches and their parking lot

Private property open to the public

Banks

Restaurants that serve booze

This is huge as its an obama judge who ruled.

Best i can figure, this particular BS is caused by the lawyers our taxes pay.

Certified/signature receipt is the equivalent of having a Cop deliver the letter to you at your address.  It provides proof the license was sent and signed for.  If there's ever a question about when it was sent, when it was delivered, and who received it, the return receipt is legal evidence for all of that.

Anyway, this is probably being justified under the heading CYA -- so HPD isn't being sued for not mailing licenses after approval.

I've received Non-Resident CCW permits from UT, NV, FL and Maine.  They all arrived in the normal mail.  If I ever had a problem like not receiving one, I'm sure the issuing state would have had no problem sending a new one.

This is not for the license, it's for a letter that tells you, you have to go back, and pick the dang thing up.  It's a useless letter.

Both girlfriend and I submitted our applications Feb. 28. She got approval letter July 28. = 151 days / 22 weeks wait. I'm still waiting.

Little extras;
We took the same class, qualified for two guns each, submitted application the same day. Girlfriend had two discrepancies (passport number changed, citizen born abroad) and had two follow up calls in the first month, corrected over the phone. After a few months I would call in checking on the status of our applications. Recently I call in maybe once every two weeks, get the robot lady at firearms saying "It's being reviewed, you'll get a certified letter 10 dollars blah blah thank you don't bother me bye" so I tried the "speak to your supervisor/sergeant" route which does nothing. Moral of the story, she had mistakes never followed up and got hers before me. Luck of the draw.. or they help whoever bothers them the least.

Tips; Sign up for the USPS informed delivery. You'll see a pic of the certified letter in your e-mail the morning of and make sure you're home as no one is allowed to sign for you. You also get separate certified letters and licenses for each gun you qualified/applied for. Dumb extra step to slow everything down.
Yep. Why certified letters? Why not mail the license to you? Why all the nonsense? Ridiculous and a waste of our time and money. Waste of police resources for nonsense extra “checks”.  If you can own a handgun you can carry it. Plain and simple. Both require the exact same things to be legal.

I really hope someone challenges the requirements for licensing in itself as unconstitutional. We all know it is, according to the 2nd Amendment and the SCOTUS Bruen decision. Show me a analog of a law in the 1700 that required a license to carry a firearm.

Arizona, I filled out the renewal, sent in a money order, they mailed me the license. Fricken simple.

Supposedly wrong date on HIPAA form, asked if my passport number really started with a “Y” (yes… yes it does), asked if I was born where I said I was born (I don’t personally remember, but that’s what it says on my birth certificate 🙄).  A little ridiculous.

I agree. Sent complaints to my city council members, mayor, and HP commission. See where that goes.

Probably nowhere fast, but makes me feel better.

Hope some groups challenge the carry permit as unconstitutional. Bruen decision, by my logic, renders carry permits unconstitutional. IMO

I applied (for the second time, with the new requirements) in mid-February. Just got my SECOND call (four months apart) from HPD to clarify and correct my application. 🙄

What type of corrections? They said I needed a copy of my driver’s license (which I did submit at the time) and I needed to sign my pistol permit.

Also, at the time of submission, the officer went over everything very carefully, said everything was good. Took 3 months, AND me asking, for them to come up with an issue.

This is pure infringement.

Didn’t the SCOTUS say that these permits need to be issued in a “reasonable timeframe”?  What is the legal definition of reasonable. By any normal person’s standards, I’d say this is beyond unreasonable.

What happened with the Big Island case where the guy had all gun charges dropped because the judge ruled the charges are unconstitutional? Might this precedent be used here? Supposing the self defense is justified?
38
Oh wow. Not the judge already forecasting a bullshit ruling.

You know they already have their mind made up. There is no consequences for them that ignore the SCOTUS precedent, as seen in the other jurisdictions that have done just that.  They know it’ll be decades for it to go back to SCOTUS.

Any other “right” would be taken much more seriously.

I know for a fact that I submitted everything that is required at the initial application, with the exception of “signing my permit”, which was not something that was written down in the requirements, nor required at the time I received the email registration.

No point to a “check list” if they are going to disregard or change the list at every inconvenience of the applicants.
