Here's my take. Chauv should def not be charged for murder 2. But the other charge fits of manslaughter.
Once someone is cuffed, they are now in the custody and control of the officer. So if they slip and crack their head on the side walk, the officer is responsible. Due to the fact that their arms are cuffed behind their back and it's harder to walk and cannot brace for a fall. A while ago, had 1 guy die in the back of a cop meat wagon. The cops failed to restrain him properly in the van properly and he ended up breaking his neck when the van hit a pot hole or something. Again custody and control=PD's responsible.
So Floyd was cuffed and on his stomach. That is a very difficult position to get up off the ground from or try and do anything bad. So with Chauv on top of him, he is responsible for Floyd. Chauv messed up plain and simple. There was no racial motivation. TBH, I'm sure this isn't the 1st time Chauv used the same technique, and at most the guy on the ground passes out. Then wakes up and that's it. "Hey man, you ok? You passed out".
Now Floyd could have avoided this entire situation if he wasn't tripping balls and writing bad checks. So actions have consequences.
Let's compare this accident to the other MN cop who's from Somalia and shot and killed the girl in her driveway. She was not armed nor arguing. She died and he only got 5 years. His instructors at the academy felt he wasn't going to be a good cop, but told to pass him due to his race and immigration status.
With all the public and pressure from politicians, I don't think Chauv got a fair trial at all. The fact that they found him guilty of all those charges is BS too. His atty better appeal.
The media and DS played the public who are crying foul for suckers like how they always do. How much money did BLM make off of Floyd? White guy dies in a simular manner and the cops are even laughing at him and no protest in the streets.
