It's supposed to be the Government's burden to prove a person is disqualified from owning a firearm.

Mayor says public safety is #1.  Sounds like interest balancing.

Sales tax in downtown SF is 8.63%.  It goes up to 10% in neighboring districts.  Restaurants charge a 4% to 10% added fee to cover their worker's healthcare costs, and tack on other service fees.   Larger businesses pay a 0.175% to 0.69% homeless tax on gross revenue.  Minimum wage is $18hr.  This combined with the added security guard cost makes everything expensive.

That money goes to good use.  The disabled homeless all have electric scooters and wheelchairs.  I dunno where they charge them.

My review of downtown San Francisco.  I traveled to San Francisco for a couple days to support the Wolford v Lopez hearing in the 9th Circuit Court of Appeals which is located in the middle of downtown.  Subway from the Airport to Downtown SF during the day was okay and it was surprisingly clean. There were a couple of homeless people sleeping in the car

First thing out of the station, I see two homeless guys scrapping.  There were 2 security guys in reflective jackets trying to stop them, kind of.  All they did was just try and get between them, but the two guys kept scrapping.  SF has a lot of security and law enforcement in the tourist and financial districts.  They just stand around and don't do much. I guess they only get involved when the homeless mess with tourists and businessmen or do something major.  Most of the retail stores, malls, and hotels have a security guy at the door.  Go a couple blocks off the main strip, and there are no police or officers to be seen and it gets more sketchy.






It's relatively okay during the day, equivalent to Downtown Honolulu at midnight.  There's homeless screaming, sleeping on the ground, begging, and wandering around dazed.    There is  quite a bit of poo on the ground in the early morning where I have to watch my step.  A poo patrol goes around to clean it up. Most of the homeless are well dressed.  Guess that's all the clothes they steal from the stores.   People also openly use and sell drugs on the street.  Anything from pakalolo to black tar heroin.





Nighttime reminds me of the old NES Castlevania game where regiular people come out during the day, but are replaced by vampires and monsters at night. They have a "swap meet" to sell things like tidepods, handbags, and clothes.  The homeless setup their camps for the night alongside my hotel.  These pics are from early in the night and it gets worse around midnight.

Some of the main takeaways from the hearing.

The judges were openly questioning and concerned with having a circuit split with the 2nd Circuit Court (New York).  In Antonyuk, the 2nd Cir struck down the preliminary injunction thereby upholding the bans in all sensitive places except for churches and places without a "guns allowed" sign.  The liberal 9th 3 judge panel is expected to closely follow the 2nd's ruling.  A "Circuit Split" is when the appeals courts have different decisions from each other, one of the conditions for SCOTUS to take up a case as you cannot have the same laws applied differently in the US.  However the appeals courts judges are supposed to judge cases on their merits while taking into consideration how other courts handled the appeals.  They do not base their decisions on preventing SCOTUS from taking a case and overrule them.  That is gaming the system and politics.  It's very apparent judges do this, but they don't openly say they're doing it.

The other issue is how many historical analogues are needed to rule a 2a restriction constitutional.  The opposing counsel and the judges analysis of Bruen was that only one analogue was needed, not analogues.  So if there was one gun restriction in a state, city, or territory out of the original 13 states, that was enough.  They pointed to a restriction on firearms carry in NYC in 1763 and 1771 that justified the sensitive places ban.  I'm not sure what those restrictions are, I have to look them up.

The word "balancing" was used a lot in the opposition.  They are still pushing "Interest Balancing" tests for public safety to justify the carry restrictions.  This was prohibited under Heller and Bruen opinion which uses the text, history, and tradition.  They also talked as if the SCOTUS Heller/Bruen opinions intended for restrictions like this to be allowed

Neal Katyal, the opposing counsel who served under Obama, was a smooth talker.  Little substance, but he had the confidence to make it sound good like a car salesman.  The three judges were all democrat appointments.  Schroader and Graber are extremely anti 2nd amendment from past cases and were pretty hostile to the 2A in court.  Sung never ruled on a 2A case before, and her line of questioning was milder. The likely outcome will be ending the preliminary injunction in Hawaii for everything except for the hold on the private property "guns allowed" sign requirement.

There were a few Moms Demand Action ladies in the court.  They had a small rally with the Mayor the prior day.

You just demonstrated the whole reason the NRA was created.  Training civilians in a time of peace so they had firearm skills and experience should they ever need to fight for the country was their primary purpose.

Too bad the NRA doesn't sponsor "range packages" so people can more easily afford to get professional training at their local range.

i'd like to see them offer a $10-$20 package to include ammo, a rental firearm, firing range access, and an instructor.  It should also include a safety class that satisfies the individual's state training requirements if any, and a certificate of training if they pass a proficiency test.

Seems the main thing the NRA does is beg for money -- over and over again.  Unless one pays for an NRA-certified course, those dues offer no benefit toward training.

The NSSF was promoting this before for gun ranges to do on their own.  $10 paid for 10 rounds of 22lr to shoot at a private range.  To get new shooters in the door and not be intimidated.

NRA might have grants for clubs to do something similar.

Or firearm owners can do the same on their own just for the cost of ammo, especially 22lr.  I've done this for a couple hundred people so far.  Taught NRA classes for just the cost of supplies for a lot of people too.

Wonder how many of the " 54 cases so far this year." as well as last year involved Registered or LTC licens holders ?  ::)
It’s unclear whether the guns involved in this week’s shootings were registered or not.

You can tell for most of them if the person is charged for firearms violations.

The Aiea home one might've been legit self defense. Though he was arrested for place to keep.  Not sure how that was added on if it was due to shooting on the sidewalk or ran away with the gun.

It means there are different versions in the house and Senate that need to be consolidated.  The House version is harsher, the Senate version was watered down by Rhoads due to our opposition.

There's a possibility it may not pass due to the differences and large opposition by Big Islanders

A lot of people never did a private sale before.  Most new buyers get guns from the store.  More experienced ones buy used when they know what they're doing.
