Title: FFL Question
Post by: 841gun on August 27, 2013, 10:03:43 PM
Hey all,

Just wondering...

Went to OGC to get FFL done for an auction I won on gunbroker.  Seller is an FFL holder so OGC was able to do the transaction.  My question is, are there any FFL holders on isalnd that will accept a shipment from a non FFL holding seller?

Thanks all

EDIT:  Federal law allows from out-of-state nonlicensee to another state's licensee.  State law might vary :)

Quote
Q: May a nonlicensee ship a firearm through the U.S. Postal Service?

    A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.

Q: May a nonlicensee ship a firearm by common or contract carrier?

    A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

Licensee = FFL
Nonlicensee = Not an FFL

That's from the ATF FAQ on Unlicensed Persons Transferring Firearms.  I assume you are talking about transferring ownership.  Mailing firearms to yourself or from a manufacturer for repair are common exceptions, if that is of any interest.

Hope that helps.

^^^ Nice edit. ;)

Anyone can ship a firearm to a FFL. However, they will have to use FedEx or UPS for handguns, since the USPS doesn't like them.

I remember I had a pistol shipped from a private seller to OGC Tactical about 3 years ago. If they aren't accepting transfers from private shippers now, I don't know when that policy change happened.

Dwayne Lim - Danger Close Tactical

Al Mongeon - Ready on the Right

Both accept firearms from non-FFL
