Designed for or capable of use with a pistol. So the answer would be no; these devices would be illegal. Because it is designed for excess of 10 in a 9mm, and capable of holding the same.

If it can be loaded with 12 rds of 9mm, and if it fits a pistol you can own here, then no, it's not legal.
Owning such a mag is a misdemeanor, and inserting it in a gun, even if it has no live rounds, is a felony.
Nothing else is relevant ... just the capacity and the fact it fits a pistol.

what about 10 round .40 cal mags that can hold 11 or 12 rounds of 9mm?

So let's reverse it.
I have a original 10 rd 40sw magazine.
Yet it will hold 12rds of 9mm.
Same magazine just in a different package.

Go ask the attorney general. They would probably ban it. =p
California has a similar issue with some of the rifle mags that you can fit more ammo in. But, their law doesn't mirror ours.
-
own 3 guns same model but all different calibers 9mm 40cal and 41ae.
All three gun uses the exact same magazine.
each will hold 10rds of the specified caliber, but is capable to exceed to 10 rds of 9mm due to size in the other mags.

10 rd 458 socom mags are just plain 20rd AR mags

That's confusing.
You're saying all the mags are the exact same.
The 41ae is a bigger round, and that mag only holds 10 rds.
The 9mm mags should also hold 10rds to be legal.
So, how can they all be the same size? Based on the size of the cartridges, the 9mm mags have to be smaller than the 41ae mags.

body size is all the same for all mags. they fit and lock up properly in all guns.
40 SW and 41AE mags are just 12rd/15rd 9mm mags with opened up feed lips.
9mm ammo will function with some FTF in all three mags
Same holds true with 45acp grease gun blocked mags they can and will hold 2-3 more 40SW rounds
same gun with a barrel change

Thanks for the additional details. Not all of us have handled/owned every modern gun manufactured and sold here.
This is starting to sound like another Hawaii magazine restriction grey area.
If the feed lips are designed for a designated caliber, that small difference may be enough to argue the mags are not designed to be truly interchangeable.
I'd personally be careful to only use the appropriate mags in each pistol, mainly for reliability and functionality. I would even mark the larger caliber mags so I never accidentally load them with 9mm ammo.
Since you are aware of the 10rd limit, I'm sure you'll never load over 10 in the wrong mag! You probably read about being able to do that on some gun forum!
It would be very interesting to see this scenario played out in court. :shaka:

This would be also the same argument for AR mags.
50 beowolf , 458 socom, 300blkout, etc all use the same "normal capacity" 5.56 mags.
yet they hold about 10 rds in their caliber with no modifications to the standard AR magazines..

Yeah some attorneys here have said that if you don't have a 458 socom upper, but had 5.56 - then you could likely get popped on importation of a LCM. So they recommend, at a minimum, at least having one upper that can utilize that caliber.
