They basically want to know if I want the items and if I want to go through legal hula hoops to get them.. Then on the claim sheet and mitigation sheet they want to know why I ordered these parts.. Bottom line is that ep armory issued me a refund for the full amount for the items that the ATF confiscated and I have no intent of trying to claim the items they claim are illegal.

i would petition for it anyways on the grounds that it's not illegal according to every single definition they've made in the past about an 80% AR lower.

It seems they never mailed it to you, and was confiscated at their (ep) warehouse?

I received mine, me and 2 friends bought the 6 pack and split 3 ways -and actually milled out the fc pocket on one when I got the word. ATF set up confiscation thereafter.

Im voluntarily turning these over so as not to jeopardize my other firearms

Recon, these are purchased from EP and not Ares.
Which (EP) was raided first.

Of interest is the ATF letter dated 4/08/2014. While I don't know all of the details, the implication by this letter is that the lower is a firearm because the fire control pocket area is not manufactured in a single step as a solid piece. The intention is to negate any claim that the FCP isn't formed during the manufacturing process. They go on further to indicate that the FCP is "indexed", therefore implying the lowers intended function to be a firearm.
"Let it go" and file a claim. Unless a FFL Manufacturer serializes the part, it's prolly not going back to you but you never know.

I recently had a FFL inspection and they told me that the top level attorneys were the ones saying that the lowers needed to be confiscated. Word is that the local ATF wanted them to just get a 07 license and put #'s on them; but the higher ups said "No. They were illegally manufactured, they are illegal firearms and must go."

Nuts ah. Ep hasn't responded to the atf in any way since The April 8th letter. I hope I can get a refund or credit towards an aluminum 80 or something..

I'm still reping Ares along with the Michel guys.
An answer is due in about two weeks from the ATF based off the original complaint I filed.
It should have a lot of stuff about the EP polymer's which are the basis for this mess
