Title: New civilian MG since Hughes Amendment
Post by: suka on September 17, 2014, 07:39:46 PM
What’s happening?

1.       ATF ruled that a trust is not a person as defined by USC 921(a) and the Gun Control Act (GCA).

2.       Since ATF holds that an unincorporated trust is not a “person” under the GCA,
the prohibition on the transfer or possession of machineguns as defined by  USC 921(a)(1) and USC 922(o) cannot apply to unincorporated trusts.

3.       Numerous Trustees filed Form 1 applications to build new MG

4.       ATF approved and sent out stamps!

5.       On or around 9/10/14, ATF began demanding that they be returned, or eForms, changed from Approved to Disapproved.

6.        Attorneys are working on it now...

7.       Take my $200 !!!!! :worship:

Can they just deny knowledge that the ATF is demanding a return?
I am not fully following the repercussions of this story though. Can you summarize?

I already have plans to get a trust going. This would also bypass getting NFA item in Hawaii without getting. signature from HPD Kealoha.

Seems Hawaii is not a big fan of  NFA weapons.

But that are so fun! Who cares only 2 out of a 100 hits its target.   :D

Suka,

In light of your other discussion on the 10mag loophole for members of certain organizations, I take it that if this issue holds then people of those organizations would be able to build and own MG's/SBR/etc, but would only be able to use them for organization related events?

How are you going to afford all that ammo?   ???

I'm kidding. . . Well, mostly kidding.  I've shot F/A some before and while fun, I keep thinking how expensive it would be for me to own one.  Maybe that's just what I tell myself from getting too jealous of my buddies in places like AK and AZ that can own such things.   :(

Seems like you've been putting a lot of research into both local and federal regulations.  I have to deal with different federal regs for work and everytime I read through them, I'm like
