Here we go guys.  There are a bunch of anti-2a bills on the works.  The list includes the old 2015 bills that carried over to 2016.

A big thank you to the HRA and Dr. Max Cooper for reviewing and clarifying / providing a position on the various bills!

I'm going to echo everyone else and say awesome job!  :thumbsup:

As far as the color codes, I would say red for oppose, green for support, and yellow for anything else until it can be discussed. For example, HB2629, I would NOT support this as it calls for ALL firearms applicants to be enrolled in a "criminal record monitoring service used to alert police when an owner of a firearm is arrested for a criminal offense anywhere in the country". Sounds like a national database of firearms owners to me.

I would also include HB2630 which would hand over our registration info to the Hawaii Criminal justice Data Center, and HB2631 which seems to be basically the same as HB2629 with wording to include "Lawful permanent residents" or legal aliens. Also its companion SB783.

We're not pedophiles, and we shouldn't have to be "registered" into any criminal database simply for exercising our Constitutional rights.

I'll be going over these bills and posting my opinions for discussion. I hope everyone else will do the same, as well as show up for hearings when possible and submitting testimony if it's not

Contacted Shimabukuro in reference to SB783 to inquire about language of bill, specifically with regards to the mental health section.

Informed by staff that unless it is pushed forward, bill will expire in 1-2 weeks.

"If a person charged with minor domestic abuse, like pushing or shoving, and can't plead delayed acceptance of guilt (DAG) or (DANC), if convicted you lose your gun rights forever.  Only a Governor's pardon can restore rights."

SB2314 SD1   Abuse Against a Family or Household Member; Deferred Acceptance of Guilty Plea; Nolo Contendere Plea
RELATING TO THE OFFENSE OF ABUSE OF FAMILY OR HOUSEHOLD MEMBERS.   
Makes a person ineligible for a deferred acceptance of guilty plea or deferred acceptance of nolo contendere plea in cases where the person was originally charged with the offense of abuse of a family or household member and the charge is subsequently reduced to a lesser included offense. Effective 1/7/2059. (SD1)

If the announcement has wording like "will hold a public decision making" (let's face it, the "decision" on most of these bills was made long before they came before the committees and in spite of overwhelming testimony opposing the legislators' agenda) then no new testimony is allowed, and if you try to submit testimony via the .gov site for that bill it won't allow it. The only option in those cases is to write an email directly to the chairman of the committee who will announce that your rights don't matter to him/her, we don't care what the balance of the testimony is, nor what potential for abuse is in the ambiguous or not so ambiguous language of the bill, too bad for you.

I might be missing something, but how did HB626 "pass reading" with one vote yes with reservation and 17 votes no?

I didn't see my rep voting yes on any of the bills I emailed him about. I guess maybe he listened.

For house, there are 51 representatives in total.  You would need 26 votes to get a majority vote.
For senate, there are 25 senators in total.  You would need 13 votes to get a majority vote.

When a measure says it passed, then you can assume that those not listed voted Aye.  Those listed are those that voted otherwise (Aye with reservations, Nays, Excused)

When a measure says it failed, then you can assume that those not listed voted Nay.

I asked JI808 the same question yesterday.

He responded that they do not list the winning votes (aye or no), just the "with reservations" and losing votes.

So when a bill passes, as above, only the losing opposition votes, Noes, and ayes with reservations, and  are listed.

It's confusing because with the committee votes, they list all the votes: ayes, ayes with reservations, noes, and excused.

So, no, your representative didn't listen to you. Mine either. He ignored multiple emails and two phone calls in which I had stressed that I voted in every election and my vote for him was dependent on his voting no on all the anti-second amendment rights bills. He nokea.

Ahh.  Got it.  Makes sense.  I was reading this late and after a few drinks.  Was really just looking for what my rep voted.  He was party to HB626, so I assume he voted yes. 

I asked JI808 the seem question yesterday.

I've written him many times, going back at least a few sessions.  He hasn't replied to any of my emails.  I will email him to make sure he knows that he lost my vote, especially in a case where the overwhelming testimony received was in opposition. 

I will continue to email him and my senators.  One of my good friend's wife does work with the Leg.  I'll talk to her next time I go over to their house.  My buddy is pro gun, but she's scared of guns.

Hey Q, I asked about that once and was told they just put any old date in there as a place holder until they get closer to actually passing it and then decide when the "effective date" will be.  :shaka:

The ones I have a problem with is when they have a current bill that says "to take effect in 2009". If any place could have retroactive laws making us retroactive criminals, it'd be Hawaii.

The message received by Senators and Representatives is that gun owners don't have a problem with their rights being reduced.  With the thousands of gun owners in the state, only a few submitted testimony or contacted their legislators in opposition to these bills.  Less than 100 testimonies opposing each bill was submitted, that's less than 1% of all gun owners in Hawaii.  If gun owners continue to be apathetic in a State with some of the most restrictive gun laws, expect to see more of your rights being taken away.

Thank you for all of your work!..... but I strongly disagree with 13 and 17 being "for." Non-citizens should not have guns, period. Until the immigration system is un-f'd, we can't allow that system to justify their ownership of arms.

I also support people on terrorist watch lists or no-fly lists (like 33) getting at least a temporary ban.

Honestly, it would be so much easier to just make the law say something like, "no national, citizen, or person originating from or associated with any Muslim majority country may own a firearm." Done, but of course that's not PC and boohoo.

Regarding the pro or con, this was the recommendation from Dr Cooper on whether the bills are pro or con.

For denying rights to own firearms for green card holders, wouldn't this be a slippery slope?  What about citizen Muslims that have never been convicted of any felony?  Why not Filipinos?  Or British?  Or blacks?  Or whites?  Slippery slope.

The no fly list is 40-60% inaccurate, which is why the legislators pulled that bill. If you were mistakenly put on a secret list that you had no means of getting removed from, would you want the government to use that list as a criteria for confiscating your firearms?
