For research purposes, I thought I'd ask here... What is the Hawaii law concerning SMGs like the H&K MP5?
Does the H&K MP5 get classified as a pistol in Hawaii and thus, the 10 mag capacity limit?
Does the MP5 have a 10 capacity magazine and does that even make sense?

Any firearm that has a barrel length less than 16" is considered a pistol
Any pistol that has a detachable magazine, blah blah blah, and blah blah, will be considered an Assault Pistol, and therefore is banned.

Yup. Unless your barrel is over the 16" limit, it's a banned weapon and the magazine capacity is a moot point. If you have one that is over 16", then the 10-round thing would apply, since there are MP5's with barrels shorter than 16", making the magazines capable of being used in a pistol. This is the dumbass reason that 30-round AR mags are technically illegal here-there are pistol versions of the AR, so the magazines have to be blocked to accept 10 rounds. Nevermind the fact that possessing the pistol which is capable of accepting your magazine is already a felony...

No SMGs are allowed for civilian use in Hawaii. Law Enforcement Only with Proper Permitting from the State. Feds exempt and Military also. So the mag thing is pointless here.
Mag ban is for us poor civilians only.
Active Duty LEOs are allowed mags over 10 rds. BUT when they retire or lose thier arresting powers then they have to give them up or block them to 10 rds.
(name me one officer who would do that? They all laugh when I bring it up)

Hmm thanks for the reply but I don't get it... I was at Sports Authority today and noticed a 22 caliber H&K MP5. I also noticed one at Magnum before.
If it's illegal to own one, why would they display it there?
So are those meant to be sold only to LEOs then? Not sure why a LEO would want a 22 cal H&K... For practice maybe?

Those MP5s have permanent silly looking fake suppressors at the end to permanently extend their barrel length to 16"+.
** forgot, there's an actual 16"+ barrel underneath the fake suppressor. As silly as the fake suppressor looks, it's probably a lot less sillier looking than without O_o.Kind of like a constant reminder to you of why Hawaii's laws suck donkeys.

Ah ok, now i get it. Yes, the fake suppressor looked silly. I was wondering why someone would make ugly a cool looking gun.

Select fire guns are prohibited, but the "SMG" platform is not -- except through the other factors (detachable magazine outside of pistol grip and weight usually). There is stuff in works though. Stay tuned.

A SMG is select fire, capable of firing more than one round with a single pull of the trigger. The semi automatic version of the MP5 is the HK94, which sports a 16 inch barrel. The pistol variant is the SP89, of which there are a number that were registered in the state prior to the assault pistol ban. So, just like ARs, AKs, and virtually every other magazine fed semi automatic rifle in existence, the MP5 series has a magazine that can be used in a pistol, but the pistol itself is for all intents and purposes illegal to own unless registered prior to the assault pistol ban. Most people will tell you the magazine is ok to own and use in a rifle, however inserting it into a already illegal pistol is generally a bad idea.

Not sure what the proper acronym for select-fire is. Maybe it's also SMG.

Dont think there is a acronym for select fire, but no civilian ever own a SMG or any MG for that matter in Hawaii unless HRS 134-8 is either repealed or amended with an exception to compliance with federal law.

fyi...99% sure it was not a true HK MP5 at sports authority for 3 reason.
1st, it's illegal to own a genuine HK MP5 in hawaii,..unless it was a civilian version of the HK MP5 which was a HK94
2nd, Sports Authority does not sell high end guns, even if it was a HK94, going prices for those run $3000+ used. The one you saw at Magnum could of been a HK94 or MP5 (but for law enforcement/military use only) ..
3rd. HK never made a .22 cal MP5
it was probably one of those .22 cal. GSG MP5's

it was probably one of those .22 cal. GSG MP5's
HK94's typically run $4,000 used unless they are DOJ guns, then it's possible they might go for less.

Its made by Umarex. HK licensed it out to them so it can look more like a real MP5 compared to the GSG.

Cool...so who is Umarex dealer here in Hawaii? Sports Authority? .....interested in the HK416 version clone made by Umarex.... ive been out of gun world for awhile...

I'm pretty sure OGC is a dealer I got the mp5 version and also the 416 one from Carter... When I get a chance I'll post it side by side next to my mr556
