Title: Sen. Gabbard's Shall Issue CCW Bill SB 212

Senator Gabbard's "shall issue" CCW bill has been posted.

I appreciate Senator Gabbard introducing this bill at my request. I also appreciate him incorporating some of my suggested changes, including:

1. Changing the age from strictly 21 to 18 for military service personnel:

"(3)  Is twenty-one years of age or older or is eighteen years of age or older if a member of the United States military;"

and 2. Changing the cost from $100 to $25 (for three years), and renewal to $10.

The license is valid statewide, but only applies to concealed carry (no open carry provision). The bill is also very much more detailed than the Nishimoto bill, and includes penalties for violations, listed places prohibited to carry, etc. I believe those details might assauge the fears of some people that the CCW license is a license to create "the wild west".

(d)  The appropriate chief of police shall issue a license if the applicant:
     (1)  Is a citizen of the United States;

She might want to change that as its already been ruled unconstitutional


    (h)  The attorney general shall maintain an automated listing of license holders and pertinent information, which shall be available on the Internet to all law enforcement agencies through the criminal justice data center.

     (1)  Place used to commit violations that constitute a nuisance pursuant to section 712-1270;

     (2)  Police station;

     (6)  Polling place;

     (7)  Meeting of the governing body of a county or other political subdivision, the board of education, or any neighborhood board;

     (8)  Meeting of the legislature or a committee thereof;

     (9)  School administration building;

    (10)  Public school facility, state university, and community college, including the parking areas and grounds, unless the licensee is dropping off or picking up students and the firearm and license are located in the vehicle;

    (11)  Any establishment licensed to serve alcohol for on-premises consumption;

    (12)  Any establishment or event open to the public where the operator makes a reasonable request for the licensee to remove the firearm from the premises;


Any person who violates this subsection shall be guilty of a class C felony.

Hey London. I concur. Any law by any level of government dictating that any law-abiding citizen is a criminal for bearing any arm in any manner anywhere is utter bullshit as far as I'm concerned. The only "constitutional" law is no restrictive/infringing law at all and thus open and concealed carry of long guns and handguns (without any magazine capacity restrictions, bans on "assault pistols, etc.) anywhere. I'll support that bill as first priority when I see it, but I will also support others that are incremental steps (this is friggin' Hawaii after all... steeped in a long history of "obeying the man") to the eventual full manifestation of our rights. I don't know what else to do, besides fantasize about a huge raft of lawsuits funded by some deep pocket civil rights activist that would quickly be decided by a revamped court system that was not ruled by political appointees set on destroying our rights. Like I said: fantasy (Peruta was filed in 2009...).
