Title: SB600 & SB1466 Floor votes
Post by: zippz on April 02, 2019, 11:33:50 PM
Contact your district House Representative as SB600 "under 21" bill is up for a House floor vote this Thursday and HB1466 "Red Flag" is coming up next week. Tell them to vote NO! Find your representatives contact information at https://www.capitol.hawaii.gov/members/legislators.aspx… or by typing in the street name (no numbers) here: https://www.capitol.hawaii.gov/findleg.aspx

You may be wondering why you're doing this when floor votes are very difficult to oppose for us. We want to see the Representatives voting record to analyze it, hold them accountable, and work with them to support us in the future.  I'll explain more about the process and where we are at at this Saturday's HIFICO meeting in Aiea.

Dear Rep Wantzurvote

Please oppose HB1466. The bill as currently written is a grave threat to constitutional rights.

The 4th amendment guarantees people due process, but this bill would allow removal of rights without a trial or the ability for a firearms owner to initially plead their innocence. There is a very low legal standard of evidence to grant the order, and the removal of 2nd amendment rights could be made indefinite through renewals without a case ever having to go to trial.

If a person is this dangerous they should be in jail or a treatment facility because they also have access to knives, fire, vehicles, poison, etc. Law enforcement already has all the tools it needs to deal with evil and disturbed people without threatening law abiding gun owners with draconian Brave New World type laws that encourage people to turn in their neighbors without consequences.

My gravest concern is how such policies could be abused by those who do not fear for their safety, but simply desire to threaten and punish gun owners for leverage (or simply because they can). Several innocent people have already died in SWATTING incidents for similar motivations. Let the police and courts handle the complaints with proper investigations and TROs instead of exposing the most law-abiding members of society to the whims of trolls, jilted ex-lovers, and other petty disagreeable people.

Thanks for listening and remember to please vote NO!

As something of an aside as the legislature votes today to deny 18 to 20 year olds the right to import and own firearms in Hawaii, here's what Idaho just did... talk about a contrast... permitless/"constitutional" carry 18 and up... I bet it's cool living in the United States of America..

Idaho Lowers [Permitless] Concealed Carry Age to 18 Statewide

Idaho Gov. Brad Little (R) signed legislation Tuesday that lowers the concealed carry age to 18 statewide.

On March 27, Breitbart News reported that Idaho and Kansas were both considering legislation to lower their minimum age for concealed carry from 21 to 18. The law in Idaho allowed 18-year-olds to carry concealed firearms outside of city limits, but the legislation Little signed removed the prohibition against the exercise of their right to bear arms in cities.

The Associated Press reported that proponents of dropping the age argued that the laws in the state were not consistent because 18-year-olds could carry in rural areas for self-defense but not in cities.

Former Idaho Gov. Butch Otter (R) signed legislation allowing guns to be carried on campus for self-defense beginning July 1, 2014. On March  26, 2016, Otter signed legislation eliminating the state’s requirement to obtain a permit for concealed carry.

Colorado Sheriffs also just said they won't enforce red flag law.  They rather go to jail than enforce an unconstitutional law.

So far, sheriffs and county commissioners in rural Washington, Oregon, New Mexico, and Illinois have expressed their determination not to heed the new laws put in place by Democratic state legislatures...

Washington

Last fall, voters in Washington state approved a package of firearms restrictions, generally called I-1639. It raises the minimum age for buying semi-automatic rifles, tightens background checks and makes it a crime to fail to store a gun safely, if the gun ends up in the wrong hands.

The restrictions have raised the ire of some county sheriffs.

"My plan is not to enforce it," says Klickitat County Sheriff Bob Songer.

Songer is one of about a dozen sheriffs, mostly in rural parts of the state, who have come out against the law. Some say they will apply certain measures — for instance, the background checks — but will ignore others. One sheriff said he is not going to arrest a 20-year-old farmer who happens to have a semi-automatic rifle with him on his tractor.

Songer is more absolutist. "As an elected sheriff and a constitutional sheriff, I believe it violates the Second Amendment of the U.S. Constitution," he says, "and, more specifically, violates the Washington state Constitution." Songer adds he won't enforce it unless — and until — the Supreme Court says it is constitutional.

Wash. police chief says he won't enforce new gun law The law raises the legal age to buy a semi-automatic rifle to 21, from 18, requiring enhanced background checks

https://www.policeone.com/chiefs-sheriffs/articles/482125006-Wash-police-chief-says-he-wont-enforce-new-gun-law/

REPUBLIC, Wash. — Loren Culp, the police chief in Republic, pop. 1,100, recently got a big shout-out from Ted Nugent, the “Cat Scratch Fever” rocker who these days is also known for his gun-rights and conservative views, and calls himself the “Motor City Madman.”

Not only is the chief — the entire Republic police force consists of Culp and a deputy — not going to enforce the law, but on Monday night, the City Council is going to take up for discussion an ordinance proposed by the chief.

He’s titled it the “2nd Amendment Sanctuary City Ordinance,” borrowing the “sanctuary” wording long used to describe places that limit how local law enforcement cooperates with federal immigration authorities.

The proposal certainly doesn’t mince its purpose.

First, it says that “all federal and State acts, laws, orders, rules or regulations regarding firearms, firearm accessories, and ammunition are a violation of the 2nd Amendment.”

Then, it says that any such laws are “hereby declared to be invalid in the City of Republic.”

Culp says the response has been overwhelmingly positive from the locals.

For the red flag law, a bunch of Sheriffs stated they won't enforce.  WA, MI, AZ, NV, OR just to name a few.  IDK the specific districts, but I'm sure it's on google or youtube.

https://www.youtube.com/results?search_query=sheriff+won%27t+enforce+red+flag+law

I can't find the vid, but I think it was in MI where about 10 Sheriff districts chiefs came to a town meeting saying that they will not enforce the red flag law.

Are you sure about Quinlan ?
He was nice enough to send me this yesterday.

Dear (Rocky) ,

Thanks so much for writing.
I'm happy to report that I have already voted no on SB1466, and will also be voting no on SB600.
I firmly believe that it is not the purview of state level governments to further restrict and abridge the second amendment.
Regards,
Sean Quinlan

I was just reading over 1466 Sd2 and am a little confused. One part it says that you have to turn over all guns immediately to the police officer serving the notice of a hearing. Another part says you have 48 hours to turn over to chief of police or "dispose of" them to a licensed dealer.

Whats even more sad about this is it's more due process violations, which ACLU and other groups should be against even if they don't like guns.

under the same logic, a driver's car should be taken away by police if anyone thinks he/she may be a danger to oneself or others....
and driving is not a right
heck, let's expand this unconstitutional law to include knives and any and all "dangerous instruments"

Let's introduce a bill like that next year to show how stupid it is

I included a lengthy position paper by the ACLU in my testimony. They oppose such laws for a variety of reasons. One time they are on our side.

Let's introduce a bill like that next year to show how stupid it is
I had already copied and pasted the bill with the idea of submitting it before next session (maybe next week) to every law maker that voted for it using the various substitutions for "firearms": any motorized vehicle, knives, razors, box cutters, screw drivers, hammers, wrenches (oh, hell, all hand tools), machetes, bats, pipes, bricks, rope, gasoline or any other flammable liquid, all potentially poisonous household chemicals (bleach, drain cleaners, etc.), etc. etc. etc. There'd be a separate bill for each item, just so I could send a LOT of emails to the morons. I think the most attractive one to me was "all household appliances or electric devices that have a cord greater than 8 inches in length", as those could obviously be used to suffocate (aka "hang") oneself, or another person ("Yep, the TV, refrigerator, computer, all the lamps, the phone chargers, etc. all gotta go..."). It gets a little complicated regarding probably the most commonly used weapons to harm other people: fists and feet. Go ahead, confiscate those... I guess with Sharia law they actually do that. If the lawmakers had any integrity, and even the slightest commitment to logical consistency, they would have to submit and pass those bills... ALL of them.  If  a person is deemed "a danger to themselves", certainly all those items would need to be removed... and most of them regarding the person being a danger to others. The idea that the person stops being a credible danger to themselves and/or others once their firearms and ammo have been taken is utterly and totally preposterous. That doesn't worry or concern out legislators in the least. It's what they do. :geekdanc:

Of course we'll see that from our legislators sometime shortly after the proverbial snowflake in hell...

Answer I got from Sen Kidani's office on a different topic but still firearms. And yet they love to make "feel good" decisions about them.

Aloha XXXXXX,

First off, I’d like to thank you for your email regarding firearm questions.  Secondly, as we are heading into conference and things moving very quickly, I’d like to apologize for the delay getting back to you with a response.

Senator Kidani is not informed at all about gun laws and is unable to answer your questions.  That said, Senator Kidani would like to forward your email questions to someone at HPD for a follow-up response and get back to you.

Mahalo,

Make sure you register ALL your guns.
Make sure your neighbors know you
have guns and  where the guns
are secured.
Support your local police, as they are
your friends. Always allow police  to
freely search anything they want to.
Answer all their questions.
The government is your friend.
Thank your Democrat representative
for making you safer.
Praise be to Democrats, our saviors!
Aloha!
