Title: Officer Charged with felony murder Rayshard Brooks
Post by: Specter01 on June 17, 2020, 11:07:40 AM
I know it's in vogue to hate on cops right now, but this particular thing is complete BS. There's literally high def video of this and they'll try to hang this cop.

Especially because it may lead to this line of reasoning: Cops don't need guns--and if cops don't need guns then why do you need one?

If Blue takes the White House, this will be a thing. Watch for it.

The officer should have got down on one knee and ask really, really nicely for his Taser back. Why? Because BLM - that's why.

Anybody with half a brain knows that if the cop got tased, the perp can steal his gun and kill him.
Therefore, self defense.

Most here know I don't like cops,
and I dislike government even more
but our Americam MSM is the worst
this was mentioned in a very liberal foreign rag

https://www.dailymail.co.uk/news/article-8431801/Rayshard-Brooks-probation-faced-going-prison-charged-DUI.html

That cop may have made a bad decision, but this was a fact our Democrat
media knew about and has ignored.

Everyone does have a brain, but not the ability to think clearly with it.

I think the problem here is that the guy got shot AFTER he had discharged the taser.

Now I want to be clear I do not believe the cop Is a murderer but I’m not really sure if he was justified to shoot. The shithead who stole the taser and tried to use it on the officer was not a threat after he shot the taser seeing as its only a one shot taser. There were two officers if one got hit and was incapacitated and the shithead went for the cops gun THEN I think the other cop would be justified in shooting.

Now I know that all this happened in a split second and it would probably be very difficult to process all this but I think too many times cops will use the law to justify use of force even if it’s not necessary.

I listened to the press conference from Atlanta announcing the warrant for the Cop's arrest.

He's being charged with murder which carries a sentence of either Life in Prison or the Death Penalty.

Some of the factors cited:

Brooks was cooperative, even jovial, up until the officers became physical trying to cuff him.
Policy requires the Cops to immediately state why you are under arrest.  They did not.  Violates his rights under the law.
The Tazer had not just been fired, but it had been fired twice -- after which it was no longer a threat unless it makes contact with you as the trigger is pulled.
Brooks was fleeing from officers, which negates any claim of self defense, even if he pointed the Tazer at them.
At the moment of firing upon Brooks, the pursuing officer who shot was over 18 feet away.  More than a safe distance from a Tazer that could be fired, and enough of a safety margin with the suspect running away from the Cops.
After shooting Brooks, the Cops said "I got him!"
For over 2 minutes after shooting, the Cops did not provide aid nor request medical assistance for Brooks.
During that 2 minutes, The Cop who fired kicked Brooks as he lay dying.  The other Cop stood on Brooks' shoulders to pin him down.

The announcement also stated the second Cop is willing to testify on behalf of the state (meaning against the Cop who fired).  That Cop's lawyers said there is no such offer nor has there been any negotiation to avoid/reduce charges.

Cops are supposed to try to calm people down.  But it appears many are taught to escalate their response quickly so as to appear more serious or more threatening to induce compliance.  People will respond to the Cop's escalation with raw reflex sometimes, especially if their senses and judgment are impaired.  if I have one broad-brush criticism for all police forces, it's that they too often escalate to force when calling for back-up (overwhelming numbers vs. an even fight) or reasoning with the person would have been a better option.

Yeah, he fought the law and tried to run.  Bad decision.  Not a lethal threat, though, based on the reasonable man principle.

Guess you didn't watch or read the foreign media I linked to.
I think that cop made a BIG mistake!
You don't shoot a now, unarmed,  guy in the back.
Let him go home and pick him up tomorrow.
They could have let him walk home and impounded his car.
it would cost him more than it cost us.

But the crap coming out of that Democrat DA's mouth
was disgusting.  He is running for election by the way.

I have had people at my house drink too much and wanted to drive
or did drive to my property,  I took their keys  and "lost" them.
They got to sleep in a car that can't operate.
That is the difference between being a "peace" officer.
and someone that wants to log an arrest, most cops want an arrest.
Had I been that cop I would have told the guy to get in his car,
given him my business card, and left with his keys.
Report would read found some lost keys in parking lot.
He'll call if he wants his lost keys.

The big difference between your peace officer scenario an today's reality is the officers are not given that kind of discretion.  They have rules to follow, and if they let someone who had already driven to Wendy's drunk and had passed out in the drive thru sleep it off in his vehicle, Wendy's would have objected.  The guy wasn't at a friends house for a party.  He was driving intoxicated and wanted a chicken sandwich and a frosty.

I don't know if these Cops bothered to call a relative or friend to pick Brooks up.  I also don't know if they asked the manager if the car could remain overnight until the owner could pick it up after being held for detox.

What I do know is, no matter which option the Cops choose, there will be someone waiting to bash them for it regardless of the outcome.

You can't please everybody, nor can you predict that what you did the 100th time would turn out much worse than the previous 99 times you did the exact same thing.

Hindsight.

It comes down to whether you trust your own judgement over the judgement of others who have the benefit of hindsight.

Sometimes the right result isn't enough if you achieved it by violating the law, departmental policy or a supervisor's orders.

Have to know the deal when you go into a career, and then know which battles are worth risking your job on -- especially when it might turn out that your judgment was in error.

Having the best judgment and ethics can fail you if you have too little information for a correct decision.

Yep.  Hindsight is 20/20.  At that time adrenaline is flowing, the mind is racing a million miles a second.  Cops go through this shit on a daily basis.  Add in a day where nothing goes right and by the time of that incident things can go south real fast.  And it did.  Cops are human.

That guy didn't deserve to die but c'mon, resisting arrest, taking an LEO's taser, runs away with it then turns and tries to taser the officer.

If that guy didn't have so many fricken past infractions with the law and lived his life like a responsible human being instead of a selfish deadbeat dad he would be alive right now, at home like a loving, devoted husband his wife makes him out to be.

Bad decisions were made on both sides.  Brooks bad decision was when he decided to make a run for it instead of taking his lumps like a responsible person does.  If he successfully escaped he still would've been the loser.

Looks like APD is short handed tonight. The mayor went on CNN to downplay the situation but also told officers to remember their oath.
Looks like the locals in these zones may get a taste of what defunding/abolishing the police will look like.

Or get shot in the eye and be permanently blinded, still a lethal force situation.

The guy committed a crime, what's wrong with placing him under arrest? If you think DUI shouldn't be a crime then I understand what angle you are taking but if you are going to have an act be criminalized then officers have to be able to enforce the law by arresting people.

Do you not realize how big a liability is to just let him sleep it off? Throw the key away and let him sleep in the car, but what happens when he has a spare then drives and kills someone? News the next day would report how cops let a drunk man drive off which led to someone's death.

More cops should do this.  Because in many cities, it's only a matter of time when contact with a black person will result in a use of any kind of force.  What their leaders are doing is saying it's OK for any black person to not comply and resist.  And if they get injured for any reason, its the cops on scene's fault.

Guess their leaders are trying to get votes.

Number one they didn't arrest him.  They weren't up to the task at that time.
I have seen many police chases called off.
They knew where the guy lived and they could get him tomorrow
rather than escalate.
They could have called for a dog, if they felt he was still dangerous.
They already knew he lived a short distance away.
This all sounds like "Monday morning Quarterbacking"
but when the guy is unarmed, drunk, and running away,
my first instinct is not to shoot him in the back.

This is not a war.  Yet.

Normally they cuff the suspect before doing a full pat down.  They didn't know for sure that he was unarmed.

There was video recently released of a Cop stopping a car for a suspected DUI.  The suspect resisted arrest and grabbed the tazer from the Cop.

After incapacitating the officer with the tazer, he retrieved a firearm from his vehicle and killed the Cop.  He then drove away.

The drunk at Wendy's was reported to have been on parole after being convicted of child abuse.  Just being arrested for DUI -- even if he wasn't convicted -- would have been grounds for revoking his parole.  This is probably what was going through his intoxicated mind when he decided to resist arrest.

Apparently the "kicking him after being shot" report was from a still frame capture where the Cop's leg was bent as he stepped over the man on the ground.  No post of the actual video where he supposedly kicked him.  So, it's more likely he was trying to not step on the man or trip himself as he raised his leg to step over him.  More fake news and lies to manipulate the narrative.

They were trying to arrest him though right? And he wasn't unarmed, he had a taser and pointed it at the officer. Now if he were unarmed then no shooting was justified.

Yes, they could just stop chasing him but then there is a strong chance he could get away with the DUI. Part of a DUI case is taking a guy to the station where he blows on the machine. If that doesn't get done then he probably gets away with a DUI.

He was on parole.  Just being arrested for the DUI was enough to possibly send him back to prison.
