So the taser bill is not on Ige's veto list.
So effective Jan 1st is the ETA.
How you call gonna carry it? Open, concealled, IWB, AIWB, ankle, etc...

No reg or permit required to buy or carry. HPD actually testified that they cannot handle the work load if reg was required. But I'm sure good ole Rhodes will amend to add this in later.
The seller is the one who needs permitting from HPD. Which means you cannot transfer possession without said permit.

Any electric gun or device that passes a current into someone else and is mobile. So a TENS unit also falls under such definition.

I concealed carried in WA state for 18 or so years.
My favorite was small of the back PPK/S
I'll do the same with a TASER.
I also carry a multi-tool.
I don't call cops. :thumbsup:

I've been "test tazed". I'm sure it was entertaining for those who witnessed. :-X
I've seen videos of when a couple of college buddies went through training with tazers. One of them is built like bowling ball. He went charging and zap, down face plant. It was pretty amazing actually. ;D

According to the text of the bill HB891, it becomes effective July 1. 2021.
Also, according to the Governor's official "intent to veto" release,
All measures listed below are subject to veto. Any measures passed by the
Hawai‘i State Legislature this session that are not on this list will become law with
or without my signature no later than July 6. The measures on the Intent to Veto List
are deemed objectionable because of concerns about legality, practicality of
implementation and/or lack of transparency.

I'm not sure, just what I was told. I know HPD also testified they needed more time to get the proper forms ready for sellers.
Also IDK if someone could tase someone else in a training scenario. I don't remember if can or no can. But I do know as written, if a trainer uses a TENS unit on someone else, that would be illegal.

It states that we have to have a background check performed....
(f) Before completing a sale, distribution, or other transfer of an electric gun, the licensee or an employee of the licensee shall conduct a criminal history background check of the recipient. At minimum, the criminal history background check shall be a name-based search of the adult criminal conviction records maintained by the Hawaii criminal justice data center. The licensee or employee of the licensee shall require the recipient to review a printed copy of the results of the background check. After the review, the recipient shall sign and date a declaration. The declaration shall be in the following form: "I, (name of recipient), declare under penalty of law that the attached document accurately reflects my adult criminal conviction history in Hawaii. I further declare that I do not have any convictions or charges pending against me that disqualify me from owning an electric gun. I further declare under penalty of law that I am not disqualified from owning an electric gun." The licensee or employee of the licensee shall witness the recipient sign the declaration and sign the declaration as a witness. If the recipient is disqualified from owning an electric gun, or refuses or is unable to sign or make the declaration, the licensee shall immediately terminate the sale, distribution, or transfer.
The flip side is that it should be this easy to obtain a firearm. Just like in the majority of states.
Also what would be the effective date we could purchase in Hawaii? Is it July 1st or would it be Jan 1, 2022?

As for needing a license for a private sale of a stun gun, I don't interpret the law that way.
What 134-C states is:
§134-C License to sell, offer to sell, distribute, or otherwise transfer electric guns or cartridges; fee. (a) Any
person desiring to sell, offer to sell, distribute, or otherwise transfer electric guns or cartridges to a person in the State,
either at wholesale or retail, shall annually file an application for a license to do so with the county in which the
person desires to conduct business or within the county to which the person intends the electric guns or cartridges to be sold,
offered for sale, distributed, or otherwise transferred using forms prescribed by the county
The clause "either at wholesale or retail" is a giant flag to me that the licenses are intended for businesses, not private sales. No private seller has a "wholesale or retail" price structure.
Every paragraph of the licensing portion is written in a way that applies to businesses and their employees. There is no mention at all of private sales.
The paragraph that drives this interpretation home for me is §134-B(c):
(c) It shall be unlawful for a licensee or employee of a licensee to knowingly sell, offer to sell, distribute, or
otherwise transfer an electric gun or cartridge at a place other than the licensee’s designated place of business.
That place of business is included on the license application. So, how can they limit you to a designated place of business if you aren't actually engaging in sales as a business?
I think "license" and "permit" are not synonymous. Licenses are for businesses, and permits are for everyone else.
That's my interpretation. I'm not a lawyer. Seek advise from someone who knows the answers before taking my interpretation as "the law."

Tasers are extremely effective in stopping someone, BUT, I can't see spending several hundred dollars on a very short range single shot weapon if I can only use it at home. In that case I would rather use my Glock or Rottweilers. J Hara Store on the BI sells bear spray, which is another highly effective deterrent with 30 ft range.

That's a bunch of hogwash. Tasers are not a deadly weapon. I carry a pocket knife and that's arguably more deadly.

The question is does the taser fall under HRS134-51 "deadly or dangerous weapon". If it does, then that means 1 can only open carry a taser. Thoughts?
Our fav senator thinks it does. But the AG's testimony is that it doesn't. Nothing in writing from the AG, just the verbal testimony.

Carrying ammo falls more under the "places to keep" law. Ammo and guns are treated alike. So if you carry any ammo on you, then you need a OC/CCW permit. Same goes with buying ammo, cannot buy from LGS and then go to starbucks after.

Other states that allow tasers (was 48, but now all 50) define them as "deadly weapons", too.
Their rationale: If you point a taser at a Cop, he is justified in using deadly force. The taser can incapacitate an officer, which puts him in a potentially lethal situation.
So, while the taser itself is rarely the cause of anyone's death, the use of one can create a lethal danger to the person tased.
Flip side of that is, if you can't legally carry a taser, but you can legally carry a handgun (in most states), people will be forced to only carry lethal weapons when they could have chosen less-than-lethal.

The other day I started thinking about this tazer subject.
We just bought a new oven/range and the delivery guys arrived to install it. They were the typical delivery type guys: friendly, cordial, and big. Huge, towering braddahs.
And I am the typical filipino male. Short, medium build, with a plump stomach. :D
If they were vicious home intruders instead of friendly delivery men I think I would have been killed if I tried to tazer them.
The reason I think so is because of a story a cop told my friend long ago when HPD carried .38 specials in their guns. HPD shot this huge polynesian male (where on the body I don't recall or if it was mentioned).
The polynesian guy yelled Owwwww.....YOU FACKAH....... :shake:

Quality, not quantity.
In my Concealed Carry course, we practiced putting 2 in the thoracic cavity first. if the threat was not stopped, put one in the Cranio-Occular Cavity. More simply put, 2 to the chest; if the threat isn't stopped, then 1 to the head.
Emptying your gun into someone wearing a vest or amped up on something like meth isn't the smartest choice. Save some ammo in case there are multiple threats.

Tasers may be the gateway weapon to full constitutional carry--if that **** Rhodes had to grudgingly admit that Hawaii would lose a court decision on stun guns and tasers....
