Title: Valid CCW holders bypass 2 week waiting period…

Learned something new today…handgun permit given on the spot, waived by ccw permit. According to hpd it is the law as of right now if you have your ccw permit card they have no choice.

I’m here right now, turned in my permit to acquire paperwork thinking I’d havto wait the 2 weeks, they asked me for my ccw permit, made copy, and stamped the permit to acquire an said here you go. I was shocked. But when I asked if it’s a new thing they said it’s in the law so they have no choice.

i found it in HRS 134-2(e):
Quote
(e)  The permit application form shall be signed by the applicant and
by the issuing authority.  One copy of the permit shall be retained by
the issuing authority as a permanent official record.  Except for sales
to dealers licensed under section 134-31, or dealers licensed by the
United States Department of Justice, or law enforcement officers, or
where a license is granted under section 134-9, or where any firearm
is registered pursuant to section 134-3(a), no permit shall be issued
to an applicant earlier than fourteen calendar days after the date of
the application
; provided that a permit shall be issued or the
application denied before the twentieth day from the date of application.

Buy guns while you can.  Training requirements might also change for permit to acquire.

Alan Beck was in town for a hearing similar to this. He was arguing that 14 days is an "undo burden" compared to a 20 min NICS check.  So lets see how this plays out.

Moving my state of legal residence to WA state.
no fuking permission needed to buy a pistol.
only a 10 day wait period on semi auto rifles.
I have enough of those at home in WA state.
"Washington is an open-carry state with certain restrictions, including courthouses and primary and secondary school premises."
Fuk Hawaii.
I'll still reside here, I just won't vote. nor will I do Jury duty, or pay income taxes.

The 14 days isn't necessary with the instant background checks, but the 9th would justify it for the mental health checks to return from the doctor.  Right now the max time is 20 days, probably has to be justified if they need to investigate further.

Hb984 changes the max time to 40 days.  Probably needed for all the additional checks, checking with references, getting medical docs from all your doctors, etc.  So I don't think people will get permits within 14 days if hb984 passes.

Ask them to show you where that is located in the statute. 

Then show them that the statute says the licensee exception applies to all permits, not just handguns:

"... no permit shall be issued to an applicant earlier than fourteen calendar days after the date of the application;"

It doesn't differentiate between handguns and long guns when describing the exceptions for the waiting period.

Change their mentality and force them to follow the laws.  If no one questions their errors, they will either 1) Continue to make the same mistakes or 2) Get away with knowingly making errors.

We have seen here that someone brought a lower of an AR and HPD asked where's the rest of it (the upper) cause they want to see that too. Then when said person was explaining the law, 3 officers came out from the back and surrounded him so they can discus the matter more.  THen HPD said "how do they know the barrel is 16in?". That's not their job to measure every barrel that comes to their window. In fact, shortly later, the officer measuring the barrel was doing it incorrectly anyways as they have a yard stick taped to the desk.

exhibit A. bottom line, if the people working the firearms window "dont know the law", it will never ever be worth the effort to try and "teach" them the law.

Its not an internet forum. Very few people appear to have the ability to converse to other human beings properly.

I repeat, DO NOT ask a police officer to "show you the statute" also do not show them the statute. dont do any of that shit, it will not end well.

Dont go to other peoples place of work and tell them how to do their job. Its not a thing that works in the real world.

Plenty of advice on what not to do.  But, what's your solution?

Nothing wrong with standing up for your legal rights. 

Talking to the desk workers may not change their process, but you can always ask for their supervisor.

And if you think "very few people appear to have the ability to converse to other human beings properly," I'd take a guess you are projecting or don't know many people.

When I go to Walmart, and someone rings up the wrong price, I'm not afraid of "telling them how to do their job" in their "place of work."

Thanks to them not knowing the law, even after being shown it, hifico was formed.

This is the problem and the disconnect between the people and cops at the firearms division.

I personally was told pre bruen i couldnt even apply for a ccw as im not LEO. Luckily, another cop sitting at the desk corrected the cop at the window.

So like flapp asked, whats ur solution to correct a cop denying someone their right or not obeying the law? Should everyone wear a bodycam and submit the vid with their complaint?

There is a big difference between being the head of the spear and actively fighting for 2a and suggesting random people on the internet to do such things when they may not be prepared for the consequences, especially given the poor course of action suggested.

I am not offering any solutions to an age old problem. I am simply saying for BRU not to do a thing that was suggested.

If I were to give BRU advice on how to try and get the permit faster, it would be to comment something like "Thats wierd because my friend in honolulu who has a ccw does not have to wait, maybe the law is different in honolulu."

Showing them the law is the best way to show theyre wrong. Idk how else would be more effecient.

Guess an honest looking person would be more sufficient and belieable. But what if 1 doesnt look honest? Maybe bring a lie detector.

People have to bring up the issue to the police, and elevate it if needed.  There's a fear that police will shoot or arrest them and that's a bit paranoid, assuming you didn't do something else wrong.

First you have to know the issue.  Read the laws and pass it by other people like we do here.  Don't take things at first glance, there's usually more to it.

Second go to the station and have paper copies of the references.  Explain it politely.  Be polite even if they're not.if they don't see the problem or agree, take it up higher to the Sergeant, Lieutenant, Captain/major of records section.  Write to the police Chief

Still no luck, go to the police commission.

Still no luck bring it up with a 2a friendly city council or state legislator.

It takes time and effort to do.  You may get yelled at but keep cool and continue on.
