Initial story looks like a crazy guy with a cellphone and a pepperball gun harassing a guy.
But it looks like the incident took place on private property.
Additional footage shows the pepperball guy getting arrested from a previous incident.
Let's watch this case to see how our legislators react.

Looks like he was shooting a Byrna SD with kinetic, not pepper balls. There was no cloud upon impact and the guy that got shot wasn't choking from pepper dust.
If he got shot with my modified Umarex pepper ball launcher with steel balls it would have been his last day on earth as the round that hit him on the side of his face would have penetrated his skull and the other rounds would have gone 2-3 inches into his body.
Assholes like the shooter who use these launchers for no defensive reason are going to ruin it for those who carry them for SD. I can see someone like Rhoads or Lee introducing a bill to ban these weapons.

I'm wondering what he's charged with. If it's assault 2 then police are considering it a dangerous weapon that could be banned under hrs 134-51: dangerous weapons.

Based just on the vid released:
The old man was the initial aggressor by shoving the shooter. He could have called 911 and had the guy removed from his property.
But he then "retreated", so the threat is now over and the use of force requirement has now changed. The old man being the initial aggressor is irrelevant at this point.
Does duty to retreat play a role? Because the shooter could have then retreated as the old man was walking away. Unless he has a medical condition that prevents this. "Retreat to COMPLETE safety" is the key.

Both were idiots by getting in each other’s personal space, but more so the younger guy because he was on the old guy’s property.

Maui looked into passing air gun laws last year in Bill 169. I'm sure it'll come up again.

WTF? You going shoot somebody over that? Plus a cute little "shove"?

That was.my concern about the popularity of the byrnas. Looks good in videos but wasn't sure about real life. It could discourage casual criminals but wouldn't work against dedicated criminals, druggies, crazies, or the enraged. Unless you emptied the gun into their face and took out their eyes.

Not the BBs, the launcher used. Pepper balls would have had him gagging and a modified Umarex with even nylon balls would have likely killed him with a head shot. With steel balls, garans he mahke die dead.
