Title: NSSF (Shot Show) lawsuit
Post by: changemyoil66 on July 12, 2023, 08:26:32 PM
National Sports Shooting Foundation, the producers of Shot Show filed a lawsuit against HI's Attorney General (AG) for HB426.

This bill holds firearm and accessory sellers, employees and manufactorers civilly  liable if someone used their product in a crime and "reasonable measures" werent taken to keep these items out of their hands.

During testimony, the committee was asked whats "reasonable measures" and their reply by chair Wakai was "were not here to answer questions".

So the only logical measure would be to do a background check on all purchasers. Even if 1 is buying a buffer tube spring.

This law violates federal law (Protection of Lawful Commerece in Arms Act) as well and the committee was told of this, but they dont care.

I read all the testimonies for this bill and didnt see 1 gun store or part selling store submit.  There are a few though who contacted their representative direct. Zipps mentioned some did submit written test, so maybe it was under their individual names and not under their store name.

The bill is very short, but very dangerous.

Votes, testimonies and other rational measures to influence the committee's direction on a bill are moot from what I heard. If the chair has personal affections towards something in a bill it will be influenced. So everyone who makes 1911 grips to the real gunsmiths who work on 1911s are held responsible? Blame everyone except the criminal. Easy prey that's why.

Yes, they are all responsible.

Again, just like SB1230 and like bills. If we got 10k testimonies, its much harder to ignore than 100 testimonies.

TBH, I don't think their claim on the 2a/Buren will apply or hold. But their claim about PLCAA violation is the bread and butter.
