Title: Medical records
Post by: E808AN on August 03, 2023, 09:56:56 PM
How does the medical records thing work, I didn’t take meds for my “anxiety” that was diagnosed when I was like 12, and I have ADHD and am taking meds for just ADHD. Does either of these disqualify me from owning  a long gun or pistol

That depends. Is your last name Biden?

Do you have any billionaire friends?

Ever been to Epstein island?

Just trying to figure out which set of laws applies to you.

You may initially run into problems but the situation would be similar to the situation where the service member was denied due to seeing a therapist for homesickness. State lost the lawsuit and had to pay out.

If it helps, I never took any meds. Never is it mentioned in any visit anytime else other than that one time. Did we find out why the state lost the lawsuit I could possibly get ready for this if the time comes.

They lost because hpd was once again not following what the law states.

There are a few answers on the questionnaire which, if you answer "Yes" to, will trigger and immediate denial of your application.

Quote
He wasn’t diagnosed with any disqualifying behavioral, emotional or mental disorder,
the lawsuit said.

He later filled out forms to register his firearms with the Honolulu Police Department
and indicated that he had been treated for depression, but noted it was “not serious.”

Hawaii law requires registration of all firearms. Prior to acquiring a gun, an applicant
must apply for a permit. Santucci needed such a permit even though he legally owned
his firearms before arriving Hawaii.

Because Santucci answered “yes” on a form indicating he had sought counseling, the
permit process was halted and his firearms were seized, his lawyers said.

Honolulu must return Santucci’s firearms and complete the registration of the weapons,
U.S. District Judge Derrick Watson’s order issued Wednesday said.

“The City is evaluating the decision and its impact on our processes,” Honolulu
Corporation Counsel Dana Viola said in a statement Friday

BI HPD wants all access to your medical records.
I''m VA for all my medical, They won't tell them anything.
Federal rules.
My chances of getting a CCW in the county of Hawaii are ZERO!
So much for the courts defending our rights.

Have you ever seen a psychologist?
Do you have kaiser medical?
Those are 2 detours that may lead you to a red flag
If you answered no to those questions, I wouldn't worry about it

If you are in Honolulu, the Santucci settlement would cover you.  Denials by HPD need to be for serious threats to yourself, others, and property.  Or inability to use a firearm safely or commitment to a hospital.

Adhd isn't one of those unless there's more to it.

Santucci should apply to the other islands too, but we're not sure if they are following it or not.

I got diagnosed with ADHD when I was about 12 and I took meds for it for a year. Not your exact situation but I still managed to be able to purchase firearms.

Since they won't follow SCOTUS rulings what makes you think the will follow lower legal decisions?
In Hawaii you have two choices,  Bend over and ask "May I have some more?",
or go your own way.
