Firearm Safety course only good for 4 years. How valid is this new law supposedly coming to effect January 1st 2024?

How valid is the new law? If you mean how constitutional, then not very if one is a true constitutional abider by the 2A. IIRC the court did say that some training is constitutional. I'm not 100% sure on this though. But IMO, the 2A doesn't need a course in order to exercise if one abides by it's true purpose.

If you take your gun safety class this year, it's useless as of 1/1/24 as HI added new requirements and all instructors must be approved by HPD first. So you will have to retake it next year if you plan to buy a handgun or get your CCW.

Ok, how about this:
If you take a class before 1 Jan and get an affidavit, that affidavit will not be good enough to get you a permit.
Put another way, as I read the law, any class taken on 31 Dec 23 or before will no longer qualify as of 1 Jan 24 under HRS 134.2(g) for issuance of a permit.
Unless there’s an instructor out there who has already incorporated the new requirements from Act 52 and has been approved by their county chief of police. Anybody know of one?

All the affidavit is is the instructor certifying that you took a class on a date, so it doesn’t really “expire.” It’s just that as of 1 Jan, that class you took isn’t good enough anymore.

So HPD has to approve my certification now.
Here is the obvious question...
Who has HPD certified to be an instructor?
If they cut off the supply of instructors, then they cut off the permits, therefore they cut off the guns.

To get a permit to acquire starting on Jan 1 2024, you must have the following that changed:
1. Training course mustve been taken within the past 4 years
2. Hunters Ed no longer applies for acquiring handguns
3. Taught by an instructor certified or verified by the police Chief. Or certified by an organization approved by the police Chief (TBD, but I assume NRA, USCCA, and others will be). Or certified military trainer.
4. Course must include mental health, suicide prevention, and domestic violence.
Also there are more mental health and background check requirements. Also more laws covered under prohibited persons. Some people may be denied due to this even if the were approved in the past.

As the law is written, I would say yes, that statement is incorrect, unless the training included mental health, suicide prevention, and domestic violence issues, AND the chief accepted the instructor’s credentials. Remains to be seen how they will enforce it.

No one knows. But if we use the CCW instructors approved by HPD as any indication, then there will be nothing online. Basicially, you have to believe/trust the instructor.

If you took a class within the past 4 years, you could ask the instructor to teach you the missing modules and redo the affidavit.

Chief of police can can choose to accept a nongovernmental organization’s certification, so being an NRA instructor MAY still be good enough… if the chief decides it is.

Seems like it would be ripe for a court challenge, like Oregon’s purchase permit law. They didn’t have a system in place to issue permits before the law went into effect, so it was a de facto ban on buying firearms. Oregon Supreme Court enjoined it.

The law reads:
A firearms training or safety course or class… provided that the firearms training or safety course or class provides, at a minimum, …a total of at least four hours of classroom instruction, which may include a video, that focuses on:
(A) The safe use, handling, and storage of firearms and firearm safety in the home, as well as a component on mental health, suicide prevention, and domestic violence issues associated with firearms and firearm violence; and…
So the requirement is for four hours of classroom instruction that focuses on…a component on mental health, suicide prevention, and domestic violence issues. That four hours of classroom instruction MAY include a video. If the comma after “video” wasn’t there, you might have been right.
That language appears in §134.2 - Permits to acquire.

Oh I see where you are referencing now. I read section 4 differently because of the extra commas. But in the context of the bill it makes more sense the other way.
Also I know no instructors and I dont care to prove you wrong or post anything here.

My CCW instructor did cover suicide already. So makes you wonder if you can do 2 birds. 1 handgun safety class that overlaps with CCW.

YG posted it on their IG account. Bascially HPD called them to tell them 1/1/24; everyone needs to redo their classes.
But even without HPD calling, if you read SB1230 CD1, it states the additional requirement and instructor must be approved by HPD. So just having an NRA credential is no longer automatic, but HPD will have to actually look at it and probably your course curriculum and then give permission. This is what they did for CCW instructors, the curriculum and exam with answer key had to be submitted to them.

However the idiocy of saying someone can keep the guns they own but can't have new ones unless they take a new course every 4 years?
I wonder if there is some background check portion that is the main thrust for the renewal part.

thats terrible, i hope noone has to go that route. unless you are doing it for free for people who absolutely need to transfer firearms for certain reasons. then its great.

Hand gun PTA needs a new class. Ur current affisavid is void as there are more requirments added and instructors must be approved by HPD 1st.
Unknown if current hunters ed for rifle/shotty is sufficient. On paper, it is. But we all know hpd...

I'm offering the class directed at those who may have not yet received their affi so they may acquire a firearm BEFORE Jan 1.
As there are currently NO instructors that I know of for AFTER Jan 1, this may be their last chance to acquire for some time, longer if there is litigation.
Whats terrible is paying for and taking the time to do a firearms course that will only be valid for "less than 30 business days". Previous to jan 1st, the affadavit was good for life. after jan 1st the affadavit is good for 4 years. having an affadavit thats only good for 30 days is terrible. There are other reasons why it is terrible, but you might take them personally so I will refrain from voicing them.

As I stated before, SCOTUS did not go far enough on Bruen and should have made national constitutional carry law.
They should have realized some states are going to give them da finga at rulings they don’t agree with as they have done in the past.

So our legislators are saying that firearm instructors are supposed to be qualified to teach people about mental health, suicide prevention, and domestic violence issues.
If not, then you will not be allowed to teach a safety course or issue an affidavit for a permit to acquire.
It seems to me that this opens up a liability problem for instructors.
It's forcing people to do something they are not qualified to do.

I don’t think so. The CCW course doesn’t necessarily meet the requirements for a permit to acquire (training for permit to acquire must include two hours of live fire training; LTC class only requires “live-fire shooting exercises on a firing range”).
I suppose an instructor could teach a class that meets requirements for both, and then say so in the affidavit, but not sure anyone has tried that…
