What's dissapointing for it's like bill in the senate, no gun store submitted testimony. With the exception of 1 FFL who was on zoom for the hearing (live testimony). This would affect all their businesses.

They gutted and replaced this bill. INstead of it just being a 50 cal ban, it is now an "assault weapons" ban and mag ban. Basically mimics HB893 bill that died.

HHAA (the gun show club) sent out an email regarding this--using the Legislature's online directory I was able to call 15-16 legislators in about 40 minutes. Keep it short and simple, be clear that you are opposed to SB 401 and/or support your constitutional (2a) rights.

There is 1 more house floor vote.
Then it goes to a senate floor vote, but before this happens the committee heads of both sides will meet to discuss. These are Elefante (Senate PSM), Karl Marx (Senate JDC), and Tarnas (House JHA). If they all agree to the language of the bill, then it goes to the senate floor vote. None of these 3 are friends to the 2A, which is why the calls to the senate heads as in the NRA-ILA post are important.
1 house rep voted for the bill and was unaware of the changed to it. The rep thought it was only a 50 cal ban.

Looks like they intend on ramming this through. The only chance to stop it is a rally and phone campaign.
For the past few months liberals have been rallying again and again at the capitol, sometimes turning out in the hundreds.

Some of my issues with this bill:
1. They didn’t even make an exemption to be able to use these semi rifles and shotguns for hunting.
2. Their definition of assault shotgun uses the characteristic of having a max capacity of five rounds. Okay, well what type of shells because there’s no language to support the type? A shotgun that is advertised for four 2 3/4” shells could probably also hold six 1 3/4” mini shells. Being able to hold six shells now bans a lot more shotguns based on the bill’s language.
3, Their 10 round mag capacity is not the end game. If it was then there would be no justification to limit shotguns to five. They’re already projecting what the next push could be.

(It lowered the max caliber limit from "over 50 cal" to "50 cal"; if somebody had the time and money to wildcat a 50 BMG into a 499 FUKR, then the law would have zero practical effect other than inconvenience.) The mag bans and "assault weapon" bans didn't make it out of committee. And SB401 only made it out of committee because Awa did a realpolitik deal with Karl Rhoads.
But then they copy-and-pasted (gut-and-replaced) the mag bans and assault weapon bans from the failed bills into this bill.
Since the average Democrat in the house will vote Yes on anything that bans guns, it passed with flying colors. It'll probably pass the Senate too, our only hope being that it's watered down or Constitutionally-rejected by virtue of being a gut-and-replace.
They've been trying to pass this for decades and it looks like they finally did. Because A. gut-and-replace tactics and B. because Awa got played hard.

It was odd that the HB893 (the OG rifle/mag ban) didn't get a hearing in rhodes or elefante's committee's in the senate. They knew what was going to be SB401 and it's conversion.

The Supreme Court could make the whole concept of an "assault weapons" ban moot with Snope v Brown, or mag limits with Ocean State v Rhode Island or Hanson v DC.
And there will undoubtedly be challenges to SB401 in the state courts if it does pass in its current gut-and-switched form.
In the meantime keep taking people shooting and creating as inclusive an environment around guns as possible.

I'm just a parrot, but Awa sits on the Justice committee in the state Senate and usually votes no on these bills, so they don't usually make it out of committee. He voted yes on this one. Rumor is (I'm not sure how credible it is) that it was a deal for Awa to vote for the most-innocuous of firearms bans in exchange for the gun grabbers to support one of his bills related to foreign ownership of property. That could all be wildly inaccurate, I'm pretty new to the sport of state congress watching.

Awa has been a good 2A supporter since he got into office. I spoke to him once and his reply on an anti 2A bill was he stated "automatic no".
He voted to support the original SB401, which bans 50 cals. So we found it odd why he would support this bill. He voted no on all the other anti 2A bills this year as well and since he took office. With his yes vote, the bill got enough votes to pass committee as Buenaventura and Gabbard voted no. Awa voting no would have killed this bill.
He needed the head chair (Rhodes) to accept to give his bill about banning foreigners buying land in Hawaii. The last year he tried to get this bill traction, it didn't go anywhere. (SB242)
I never was told this by Awa himself, but those involved with behind the scenes things in the legislature said that this is what happened. Awa also voted no on the senate floor vote when the bill just banned 50 cals. Why would he vote yes in committee, then no on the floor? That makes zero sense.
So it sounds like Awa is learning how to play politics. Which isn't a good thing. A bill that wasn't as bad as it is now was passed and changed to a huge bill. Rhodes is no noob to the game, he was thinking 4 steps ahead. The OG assault weapon/mag ban bill died as it never got any senate hearings. This is only possible if 2 committee's failed to even put it on the schedule, PSM (Elefante) and JDC (Rhodes). I assume both Rhodes and Elefante knew what would come about with SB401 and wanted to avoid it coming thru the senate committees as it would likely die. Last years assault weapon ban, Buenavenutra was the deciding vote and Rhodes said he would change it to make her happy, he didn't change it (he screwed her). So it's likely she would have voted no on HB893. Combine her no vote with no's from Awa and Gabbard, the bill dies.

Any SCOTUS ruling will take time. Which HI's thing is F-U, sue us. So until SCOTUS decides, the law is still on the books. THen it needs a lawyer to spend time/money to sue HI after SCOTUS rules. Usually, the lawyer can sue for lawyers fees, but if HI changes the law before the lawsuit is over, then they get zero. HI knows this and is why they have done what they've done all these generations.

Is that true? If it's already registered with the state, you aren't "bringing it into the state".
It's already here. You're returning with it. Place of sojourn still applies for places to keep, right? That includes sojourning to another state if you intend to return.

However, I don't think most guns can be called "assault weapons" if disassembled, and I don't know of any precedent for them to get around that.

This affects use of semi auto rifles for eradication hunting on non-private land. Grandfathered guns could still be used on private lands but nothing allows professional hunters to use them on county/ state land.

2) Hinders eradication hunting on public land.
3) I think some hay could be made that the law would create a feeding frenzy of firearm purchases for the remainder of the year.
4) All the existing practical points. (Ridiculous ban on adjustable stocks; ambiguous definitions of "shroud", "flash suppressor", etc; magazine limits that don't take into account cartridge sizes; yadda yaddal)
5) All the well-trod philosophical points.

there must be at least ten-thousands of 30-round PMAGS already in Hawaii, if not a whole lot more, given the wide-spread popularity of the Modern Sporting Rifle (MSR), a.k.a. AR-15. Or as Biden referred to it as the AR-14. I mean, what MSR owner has only one PMAG?
not sure how many rifle owners there are in the state, but I'd think that "most" of them have at least one MSR. It should be a civic duty that every citizen should own one, just my opinion.

Called my representatives and the Senate President, Kouchi. The call takers were all friendly and said they register the opposition calls they get. The two representatives said they have been getting a lot of call and emails of opposition about this bill, one said over 100.
I asked if emails are any good or if they get lost in mountains of emails but they said they do record opposition/support from the emails but they don't usually reply unless someone asks a specific questions seeking a response.
The process can seem a little daunting at first but having called a few over the years my interactions with the staff of legislators has found them to be friendly and helpful.

The bill now returns to the House and will be heard on Friday.

Are they seriously saying that possession of "assault weapons" and 11+ round magazines will now be allowable if you have enough Hawaiian blood quantum? That's effectively what this says, right?

It wasn't technically killed. It was put on life support without a chance of surviving the current legislative deadline.
The Senate president, Kauai’s Ron Kouchi, called for a show of hands, and declared the amendment dead.
But amendment supporters demanded a roll call, and with the vote tied at 12-12, the clerk called for his vote.
“Mister president?”
Kouchi paused and then said “aye.”
And the clerk announced “13-ayes, 12 nos. Amendment passes.”
The chamber was filled with loud cheers from the gallery.
To avoid unnecessary further drama, the bill was sent back to committee with no time to be revived this year.

Good news is they just lost all their federal funding through their NGO networks, and Act Blue is in serious trouble for money laundering and election fraud.

For a bill to be heard, a hearing must be scheduled at least 6 days in advance and the date published on a web-accessible calendar. In that time, testimony on the bill can be submitted.
Even if they stayed up the next 48 hours to pass it out of committee in both the House and Senate, there's no way to comply with the mandatory 6-day notice without a special session to extend this year's deadline. That's a very expensive tactic for an amended bill with pretty much 50/50 support.

True, but the only time i can recall a special session was when Gov Lingle needed to get the law changed to allow the Super Ferry environmental impact study to be accepted after the ferry started operating and not before.
Time was of the essence then so the ferry operators could reduce their losses while waiting on the study to be approved. i don't see that kind of urgency with this bill. They've tried to introduce AW and mag bans before. Next year's submission would be no different than all the others that never passed.

Interesting how the article mentions lawmakers most likely needing to take another look at the tax codes, the income tax saving legislation they did last year, etc.
While not a peep about looking into streamlining hawaii's existing federal funded programs.

Thank you for all those who took part in killing this bill. Every phone call and email and interaction matters. From calls to senators, emails to them, spreading the word to other fellow 2A people, etc...it all added up.
Thanks to all that showed up to the rally on such short notice. Had about 120 pro 2A people and about 10 anti 2a. And the noticable thing is the anti 2A mostly looked all like retirees. Compared to our side we had younger to retirees in age ranges. Why this matters, people have to take the day off from work or school if they're not retired. So it's hard to do so.

RECAP FOR THOSE WHO WANT A BREAKDOWN. Going from memory so bare with me.
SB401 began only as a 50 cal ban in the senate.
It passed all senate committees and even had Sen Awa vote for it. This is very unusual for him because since he took office, he voted no on EVERY anti 2A bill. He's learning politiics and voted to support this in order for his bill about foreigners not being allowed to buy land. His vote would have killed this bill as Buenavenutra and Gabbard also voted no.
When the bill crossed to the house side, they added in all the extras about "assault weapons", shotguns, and mags.
The house had a similar bill like this, but it never got a hearing in the senate crossover side. Prob because they knew it would die.
Once the changes were made by the house committee (Tarnas), it went to a house floor vote and passed. This is the bad part. The HI Supreme Court ruled about "gut and replace" that a bill cannot be "substantially different". Which this bill is. Thus it totally by passed the committees in the senate side. See above about it dying if it went to committee.
Since there were changes, instead of the FULL senate committees re-hearing the bill, it instead only went to the committee heads ONLY for the senate. Which are all anti 2A. Wakai, Rhodes, and Elefante are the main and majority votes. This means that no testimony from the people are allowed to be submitted. Your voice is now gone.
The new version was approved by those in charge and went again to floor only votes for both senate and house.
The Senate side disagreed with the changes. For this to take place, 1 senator needs to suggest changes, followed by another to back them up. Then the entire senate of 25 senators must vote and the changes need a 50% or more to pass. This took place and it was 13 to 12 to support the changes. This essentially killed the bill. As any changes need to be sent back to the committees to be addressed. There is no time left for this. Lots of Kauai and Maui senators voted for the changes (aka killing the bill). They got tons of calls from people in their districts.
Senator Wakai crossed his party and voted for the changes (aka killing the bill). Which is odd because he supported the same ban on rifle and mags as he was head of the senate commitee that had him, Rhodes, Elefante in it. (All the commitee heads). I'm going to guess this, he voted for the change cause another back door deal was made for something else he needs. So politics at play. Wakai has a history of being anti 2A and he knows his yes vote would kill the bill.
During this vote, there was an error on the 1st vote for this. Awa stepped up and said we should go by the first vote since it's on youtube, which would have killed the bill. And theres a chance that a new vote may allow the vote to proceed as is without changes. Luckily, he was wrong and the new vote had the same results.
Now the bill is dead due to not having enough time to review the new changes.
We got super lucky on this. We need everyone to submit test and contact their lawmakers, even if a bill doesn't apply to them. We have seen this as an example. Someone doesn't submit testimony cause they own no 50 cal. Now the bill that doesn't apply to them passes and changes are added in. Even Rhodes stated "why should we add a grandfather for rifle mags, we don't have one for bump stocks". How many people didn't submit test years ago when they banned bump stocks because they don't own one. When they raised the age for rifles to 21, they used the "you need to be 21 to own a handgun". 1 anti 2a law is a justification for another.
We cannot give an inch to the anti 2A as they will forever move goal post and screw us.
Lawsuits cost money, take lots of time, and the deck is stacked against us. So until a lawsuit is won, the law would stay as is. Which means everyone who doesn't comply is a criminal until a lawsuit is won. So it's easier and cheaper to kill bills in the legislature than file a lawsuit.

I won't read the entire webpage as I'm burnt out from the past few days of SB401.
There has to be some area that is missing because I've never seen a 6 day notice. That would mean every anti 2a hearing for years had the rules broken. I think the 6 day must apply to something not related to the committee's hearings or senate/house floor votes.
If you use SB401 as an example, "48 hour notice" is stated, but can be longer due to weekends/holidays. But nothing about 6 day notice.

Troy Hashimoto from Maui voted Yes not the way we wanted. (We'll need to work on him, he's new.)
Final tally was 5/8 not-Oahu senators voted how we wanted, and 8/17 Oahu senators voted how we wanted. 2/3 Maui senators, 2/4 Big Island senators, 1/1 Kauai senator.
One changed vote from any island and the bill would have passed.

There is nothing in the senate/house rules that state what constitutes as an "emergency". But seeing how our politicians disregard SCOTUS (Bruen), Hawaii Supreme Court (gut n repalce), and of course the Bill of Rights, I would say that they can make up any reason they want to hold an emergency session to take away our rights.

Hey everyone, just an organizational question:
I was down at the capital on 4/24 with Jon of HIFICO, Dale and his wife from Young Guns, and others from Hawaii Tactical Div., etc.
When asked why so few of us, both Jon and Dale mentioned that it’s “always like this,” - and yes, I was super happy to see the turnout on 4/30, so it seems maybe there’s the start of a change with this aggressive attack on us, but we clearly need to be on the offense big time against these “mothers” (most especially Rhoads and his new sidekick Tarnas, or is it the other way around).
They have money, the entrenched party machine, and the evil intent, but we have the numbers (by far) and the indomitable passion and commitment to our Constitution and the God given right to defend ourselves and it.
HIFICO the site (not Jon) seems a bit dead in the water. By its name it suggests it was maybe intended as a coordinating entity? If so, can more volunteers/liaisons get it under steam again?
I get that people across organizations will all come together like we’ve just seen to fight, but how about doing the same all the time, to start making these tyrants have to look over their shoulders for US for a change.
This waiting for them to act, and then defensively responding, is 100% backwards and unnatural. They need to start taking fire from us for a change (politically - I’m obviously speaking figuratively, but the analogy is precisely the same: They have declared war on the U.S. Bill of Rights, and so on us).
Being a loner, I’m ignorant of our collective resources and how we can effectively organize across organizations to make it politically impossible for them to ever succeed - but I am 100% certain it can be done - we just proved that.
But they will likewise adapt their strategy and come back harder at us, and when they do, they need to feel a little more pain from the effort.
Of course getting these monsters out of office is great, but that’s a long-term (and in Hawaii, an uphill) strategy. We need to be pushing ahead on effective things we can do in the process in an ongoing way in order to make Hawaii safe for the 2A.

It hasn't always been like this with regard to the people who showed up. Before HIFICO was formed, only about 6 people would show up in person to hearings. Young Guns was 1 of them. And the anti would have about 10 or so show up. HRA at this time has stopped showing up (Harvey was the President). For online testimonies, there were like 20 or so submitted against these anti 2a bills.
Since HIFICO was created, there are now a few hundred online testimonies and even at most I've seen was 1500 for a mag ban some years ago. And in person we have anywhere from 10 to what you see. With the invention of Zoom, not as many show up in person anymore.
This was a last minute rally put on by Firearms International. Which means only a few days notice. Imagine if we had more time. And compared to the anti 2a who look to be mostly retirement age, most of us still have jobs and school, so we cannot just take off with 2 days notice.
No one in HIFICO is getting paid nor does the org receive any federal funding or money from other org's. Compare this to the anti 2A, which has shown to receive federal monies that is structured to hide it. 1 anti 2a vet even goes to say that we're getting paid by the big gun lobby. If this is true, I nor anyone I know of has received any money. Compared to his org that receives funds.
On the HI attorney generals website, it shows that Everytown for Gun Safety has spend $36,000 last year for "marketing" and this year about $20,000. NRA is 0 for years as their are very absent in Hawaii.
So everyone who helps HIFICO is a volunteer. Jon who you met has to take time off to be there and it easily cost him a lot since he's self employed. This means he has to turn jobs down for that day, which is lost income. He has to do the same with every trip to HPD to comply with firearm applications that need to be in person. Jon is also a plaintiff challenging HI's handgun 10rd mag ban.
We try to get pro 2a bills, but it's very difficult as those who control whether it gets a committee hearing are anti 2A. Rhodes, Wakai, Elefante, Tarnas. I can't remember the last time there was a pro 2A bill presented let alone passed. I think the last pro 2a law that passed was after Hurricane Katrina about not being able to confiscate guns during an emergency.

Been following this/submitting testimony for over 20 years, but not in person.
I joined and donated to HIFICO a long time ago, but I didn’t get any feedback (such that I thought maybe I dreamed it or something).
Tried again a few months ago, but the site has no membership page (oops 404!). Tried contacting but no response.
None of this is in any way a criticism - just the opposite: I’m frustrated I can’t figure out a way to get involved! I’m sure I’m not the only one who feels this way.
Jon mentioned to me that in addition to running his business, he’s got four kids. What he’s doing is superhuman from my point of view.

Been following this/submitting testimony for over 20 years, but not in person.
I joined and donated to HIFICO a long time ago, but I didn’t get any feedback (such that I thought maybe I dreamed it or something).
Tried again a few months ago, but the site has no membership page (oops 404!). Tried contacting but no response.
None of this is in any way a criticism - just the opposite: I’m frustrated I can’t figure out a way to get involved! I’m sure I’m not the only one who feels this way.
Jon mentioned to me that in addition to running his business, he’s got four kids. What he’s doing is superhuman from my point of view.

You can help by spreading the word when testimonies are due. Many don't have social media, so the coconut wireless is the best. And convince those who don't want to do it without a valid reason to do it. Explain "no vote, no grumble" type philosophy.
For now, you can also help donate to the Wolfard lawsuit and spread the word on this too.

After the COVID tyranny-in-the-guise-of-public-health attempt, anyone who does not agree with you should probably not be listened to very much with respect to what’s in play in our country and state. I personally believe they wanted to go a lot further toward the Australian model of hell here, but they knew a) not enough police here to enforce it, and b) they would absolutely have to use force, as thousands of us would confront them. So yes, I do believe they thought about there being more guns registered here than people, and that is EXACTLY how it should be, and it’s also why they’re desperate to disarm the people of Hawaii.
As an aside, I believe that if the Kingdom of Hawaii had the equivalent of the 2A, the Marines might not have taken their walk down King Street, and the history for Hawaiians would have been far less hurtful. I believe Hawaiian history is a powerful argument for the 2A, and why the people here are especially entitled to its protections. Just an old bastard’s two cents.

The failure of Hawaiian nationals to take up arms against the US empire during and after the reign of Queen Liliuokalani had more to do with her being manipulated by the pro-American Hawaiian nationals she kept company that duped her into trusting the US empire in not annexing her nation by force.

Awesome point. I didn’t intend to make this a major topic, but after learning Hawaiian history at UH back when I was considerably better looking (of course in a completely relative way …), this thing has gnawed at me.
What I wish the conversation was like is:

called the public access office. they said they will announce what the special session will cover. no specific rules limit what can be discussed. but past practice and the time limitations mean that they will generally only cover the specific intent of the special session. also said that there is no rule that says that bills cannot be considered in conference committee during the special session, but she said that those bills are generally considered dead if the clock ran out. and that they are normally not considered until the end of the next session if they are continued from the first year of the 2 year cycle...

Is there a list of what topics they will discuss?
Tokuda, DLE and Chief talking about ghost guns wasn't anything that they could add to the emergency session. They've already passed all committees and votes to ban ghost guns even more.

There is NO OFFICIAL LIST but as you and i know, they can decide on the fly what will be discussed. Is it "legal"? That is the ? Is GUT AND REPLACE legal?
I guess the bottom line is that we must be aware and be ready!

I've seen several other sources stating there are special sessions tentatively set for August, September and/or November based on the Federal budget cuts being suggested.
Nakamura added that lawmakers are looking at dates at the end of August,
September, and the week before Thanksgiving, as three possible five-day
blocks to set aside if they would need to return to a special session.
"At this point, the priority will be the budget. It is a limited time. It requires
members to be on the same page, because there's not any room in the five-day
block for amendments," Nakamura explained.

Seems to me a 5-day window is too compressed to draft, publicize, and vote on gun issues with no amendments -- and that's on top of the budget issues driving the special sessions.
Given how flawed the last few major gun control bills were, I can't imagine them getting one to pass and ready for signature with zero amendments.
