Another lawsuit by Alan Beck.
"My client was charged with felony burglary, kidnapping and domestic violence while living in Fresno CA in 1997. The charges refer to an incident where my client removed his unresponsive at the time wife from her friend’s house and took her to the hospital for acute alcohol intoxication. All charges were dismissed. Some years later, my client moved to the County of Hawaii. In 2012, he purchased a shotgun without incident. In April of this year, my client applied for a permit to acquire a new firearm. He was told that he was denied because he had been prosecuted for felony kidnapping. He also was told he had to turn in his shotgun or face prosecution. Under Hawaii state law, those who are currently being prosecuted for a felony are prohibited from firearm ownership. There is no prohibition for those previously prosecuted but not convicted of a felony. I think the County is just misapplying the law. I filed a lawsuit on my client's behalf arguing that the County’s conduct violates the Second Amendment. You can review the complaint and other documents filed at the link below."
