I had a DUI. If i didnt want to jump through all of the hoops, could i just buy a gun out of state and bring it back with me and register is with no problem?

Im asking because i dont want to put up with all of the BS. I had a dui and i had to get counseling on the big island. I now live on Oahu and i dont have a doctor up here to get the medical clearance. i think it would be easier to just go to a state with lax gun laws and buy one there and bring it back here. if i do will i still have to deal with the same dui BS of will they overlook that because i already own it?

if you do, you can't buy anymore guns and what fun is that? very few gun owners I know of only have 1 gun.
just get a doctor, jump thru the hoops like everyone else, and get one legally here so you can buy as many as you like when you like. it saves on the ffl fees and shipping which cost more in the long run.
P.S. It's illegal to buy a gun in a state in which you are not a resident... I would not be posting (on a forum probally monitored by the police) that you are trying to do something illegally!

I believe you can say you don't have a dr. As far as the dui you just need to get clearance from the drivers Ed place. See the post stegosaurus posted here

P.S. It's illegal to buy a gun in a state in which you are not a resident... I would not be posting (on a forum probally monitored by the police) that you are trying to do something illegally!

Is the answer the same if it is "Buying a gun while out of state, as well as buying a gun from out of state?
I thought there were residency requirements for local purchase.

Depends on the state and the gun. I travel to the mainland and, while there, buy firearms with regularity. It's legal in the states I visit for me to buy them, legal for me to transport them here, and legal for me to own them. I do have to register them, but because I a quired them elsewhere, I don't need a permit to acquire.

You might run into a problem with the NICS check. Save the airfare and get things sorted out locally first.

No it's not the same. When buying FROM out of state it has to go through a local FFL.
As for what the OP asked if he could "buy a gun out of state and bring it back". Both KK and Tom_G are correct, I've done it in various states/shops. The only Federal requirement is being there "in person" to make the purchase. You just show ID, fill out the 4473, and walk out with a longgun (handguns need to go to an FFL in your home state).

What loophole?
Every other state I've bought guns in (from a gun store or pawn shop), they have performed the NCIS. It takes under 2 minutes, and they do it before completing the transaction. When I show up at HPD to register, if they want to take my photo and fingerprint me, they are certainly welcome to do so (I, of course, have already had both done long ago, but the OP may not have).
The only real difference between the process pre- and post-SB69 (if it passes (as currently written)) is that HPD will have more work to do when I show up to register my gun. It in no way changes the legality of be buying a gun in another state, then lawfully transporting my property home.

So in a sense, you go through background check when you purchase in State A and then you have to do it again here in State B. By loophole I meant the you can bypass all the Hawaii BS by buying a gun out of state and importing it. Only one trip to PD and no FFL xfer. In theory, you can go to a gunshow on the mainland (currently no background check), purchase gun or have frined purchase gun and bring to Hawaii and register (no background check).
