Title: If I registered just a lower and the AWB were passed.....
Post by: aieahound on March 25, 2013, 10:17:50 AM
I'm starting a new thread as this is a more specific issue and I would think affects a lot of us.

This from prior thread http://2ahawaii.com/index.php?topic=7449.0 (http://2ahawaii.com/index.php?topic=7449.0)

If the AWB was to pass and you only listed the lower... then only the lower would be grandfathered in and not the full rifle. and if you were to complete the rifle at a later date and the "said awb" does pass then you are stuck with just a lower and if you attached a upper even though you already owned it you would be in violation of the law to my ignorant knowledge.( IF upper had a fore grip or bayonet lug or any other accessory listed in the bill now rumored amendment....

But as someone posted above if their were an awb and it was just the lower registered, then you may be stuck with just the lower.  Someone correct me if I'm wrong

Where are you guys getting this info. from. All my ARs were built from lower up and as such, all were registered as lower receiver only.

Registration doesn't say anything about collapsible stock, pistol grip, bayonet lug, flashhider or any of the "evil" cosmetic features of an upper or lower. Just make, serial no. and barrel length.

I would think so long as you don't mount an SBR you should be good to go as far as grandfathering.

Then again, I'm totally ignorant on the subject.  This might be HUGE for all the folks here who registered lower receiver only.

Could I take 3 lower receivers and 1 upper and just keep popping off the same upper, remounting it to the next lower and passing it through the window again ?   8)

That is kind of what I was thinking.  How are they going to police this since uppers are not regulated?  How are they going to find out if I have an "illegal upper?"

I'm thinking it's not illegal as long as I can prove I owned it before the AWB went into effect. ( Keep receipts )
Or if I don't have receipts but legally owned it prior to AWB, if they can't prove I didn't own it ( since they have burden of proof ) it would be grandfathered.

So don't worry about it.  :)

when you register a lower you are registering a "firearm" just because it is only one piece of a puzzle does not matter. Just like how it would be illegal to mail a lower.. or 1911 frame through the mail without meeting certain rules and regs... but perfectly OK to do it with the rest of the parts.

They will eventually find out about this "loop hole", and make or amend the law to include uppers as well.  Those need to be registered and regulated as well!!!

Maybe we shouldn't talk about it anymore in case they are watching?  LOL.

What loophole? The upper is not a weapon a firearm.

Yup, same way the lower trigger groups/controls are not the firearms part of H&K rollerlock rifles.

Don't under estimate the stupidity and length they will go through.

Cool. Thanks for the reply's.   :shaka:

They had me worried on the other thread.

So the main thing is I have pre-hypothetical-ban lowers.  ( and legally owned uppers )

Or better yet that the government recognizes our constitutional rights and a ban NEVER takes place.
