Very tragic....notice how the sheriff is quick to call this an unfortunate accident. Wonder if this was not a deputy and possibly in other states, would it quickly be dismissed as an accident. I would venture to say there may be varying outcomes and some could possibly argue this was negligence of the part of the gun owner.

I feel sorry for the entire family, in particular the kid. Helluva thing to happen at 4 years old and have to carry through the rest of your life. :(
As for negligence, this was a complete accident. Could he have cleared the gun before putting it on the bed? Could he have closed and locked the bedroom door? Could he have opted to not keep the guns loaded when stored?
Hindsight ... it's a bitch with perfect vision.

Not to argue, but this was total negligence in my opinion.
The Deputy apparently put a cocked and unlocked (no safety) gun on the bed.
First thing you do when you take a gun out of the safe is clear it and lock the action open.
CARDINAL RULE. ( Sorry, didn't mean to yell. )
Even my 9 and 12 year old kids know this.
