This bill, SB 3041, in its present form would be unconstitutional by violating 1A. The gov’t cannot compel any person to speak. Period.

All great suggestions. But whatever you decide to carry, train. And remember the first rule of CCW…don’t openly converse that you’re carrying in public!

A little off topic, but I thought another benefit to getting a HICCW license was not having to wait two (2) weeks to get your PTA. But I recently found out (2 weeks ago) HPD decided to change that.

How and when did this happen???

Only need 50 plus VPOTUS at worst or 51 at best to get it passed in the Senate.

Unable to safely retreat, my intent was to stop the actions of the person or persons causing bodily harm to myself or others and not to kill or murder. So intentionally or knowingly I haven’t committed murder. The result of my action may or may not be a death, but I still only intentionally acted to stop the threat(s).

Tokuda’s bill may actually have the opposite effect on “gun buy back programs” across the country. Law enforcement (LE) which run these programs, don’t destroy the firearms, LE procures businesses to do that. Tokuda’s bill targets those businesses (which are bonded by LE) that will specifically destroy the part that makes a firearm a firearm (usually the action/receiver) and then the business make a profit by selling the remaining parts, ie. triggers, firing pins, barrels, etc. (not the part that makes a firearm a firearm) on the secondary market. If these businesses can’t turn a profit, they won’t process the firearms from LE and thus LE now won’t have anywhere to turn over the firearms collected from these programs. And so these “gun buy back programs” then go bye-bye!

The HISC is being very myopic and childish. If one perlustrates the logic of the HISC’s prepense albeit a unanimous 5-0 ruling on HI v. Wilson, which blatantly defies the rulings of Heller, McDonald, Caetano, and Bruen by SCOTUS (SCOTUS being the highest court in the USA), then following this logic, Hawaii’s residents should like wise be free to overlook laws with which they can make a cogent germane argument against the law telling the State of Hawaii why it is not liked. Because this is exactly what the HISC is doing with this Wilson ruling.

All 50 States (including Hawaii), US Territories and the Federal government obsequious to the US Constitution, thus the HISC is an inferior court to SCOTUS and thus must yield to SCOTUS.

This obtuse ruling was a meager stunt which just goes to show how jocose and irrelevant Hawaii is and the disdain it has for the rule of law.

But it will get worse and it’s just a matter of time before anarchy overshadows the islands.

I’d be surprised if SCOTUS doesn’t grant cert to a Wilson appeal; since it involves federal and constitutional law. This decision by the HI SC is a colossal opprobrium to several recent SCOTUS rulings, I can’t imagine this would be left alone.

              (i)  The prohibition on carrying or possessing a firearm in certain locations and premises;

             (ii)  The prohibition on carrying more than one firearm on the licensee's person at one time;

            (iii)  The prohibition on carrying a firearm on private property of another person without the express authorization of the owner, lessee, operator, or manager of the private property;

             (iv)  The requirement to maintain possession of the license on the licensee's person while carrying a firearm;

              (v)  The requirement to disclose information regarding the carrying of a firearm when stopped by law enforcement;

             (vi)  The provision for absolute liability for injury or property damage proximately caused by a legally unjustified discharge of a firearm under section 663-9.5; and

            (vii)  Laws regarding the use of deadly force for self-defense or the defense of another;

I believe SCOTUS will give an opinion on this issue next week Thursday; so all this conjecture will be put to rest or Trump will be put out to pasture.
