Interesting article. Note Hawaii doesn't have a specific law against it. Also note that there is a survey attached to the story asking if guns should be allowed in school, and that the majority says "yes."

Hawaii already has a law against it. DUH. It's not a range or a place of repair for firearms. While it is a place of business if you are a teacher you are not he owner of the school so it is already illegal. Common sense people!!! :closed:

yep with the exception of anyone that has the rare "golden ticket" (CCW permit) other states have guidelines on where you can ccw......that being said .... this discussion is more on law theory than practice

You should review the HRS....if someone were to be granted a CCW, there is currently no prohibition about where that individual may or may not carry his/her firearm concealed. Please feel free to provide the appropriate reference to the HRS 134 when replying.

Haha. No one has CCW so that's the end of it. The only people out there  that  are carrying concealed are LEO so there is no debating the law.  :thumbsup:

Funny thing that... seems you aren't privy to the policies of every school in the state.  Private institutions certainly can allow firearms on campus if they so choose.  The school I work for has specific language in its policy manuals allowing firearms on campus with the consent of faculty.  Admittedly, the intention is to allow certain classes access to firearms for learning how to recover forensic evidence from them, but the specific wording is such that any faculty member can bring a firearm on campus.

It probably requires the approval of the dean, director, or board of regents if not all 3. Plus it a liability nightmare for the school. I'm all for for armed security at the schools, but I feel that they need to be off duty LEO like how Punahou has already.

I have an uncle who is a high school teacher in utah and says he has been carrying a gun to school for the past 20 something years. He said most teachers do. My cousins from there say they feel safer knowing that the teachers are armed. Totally different mindset than people from hawaii.

True, there are no specific laws on the books...Closest would be HRS §302A. BUT Hawaii does have administrative rules & policies regarding weapons in schools...

1) Public schools: Covered in Hawaii Administrative Rule §8-19-3 (aka Chapter 19) and HRS §302A. The zero tolerance policies on weapons applies to ALL students, faculty, staff and visitors.

2) The University of Hawaii system: Is also covered under parts of HRS §302A and includes the Student Conduct Code (and a Faculty version). All prohibit weapons on campus. ***Note: On campus housing for faculty & students are technically legal under HRS §134 (as a place of residence)..."House rules" prohibit weapons.

3) Private educational institutions: ALL have similar rules/policies regarding weapons.

So, as I see it, whether one has a CCW would be a moot point. The policies of the educational institution (as with public/private facilities or businesses) would make them prohibited places. And that supercedes the rights a CCW would grant.

I think you are right about college, but HRS §302A (http://www.capitol.hawaii.gov/hrscurrent/vol05_ch0261-0319/hrs0302a/hrs_0302a-1134_0006.htm) and §8-19 (https://www.hawaiipublicschools.org/DOE%20Forms/Civil%20Rights/Chapter19English.pdf) clearly state that they apply only to "children" and "students." High school faculty might thus be allowed to carry firearms. Furthermore, you don't need a CCW license to possess at your place of business, nor do you need to be the owner of the business.

The law does not specify that you have to own the business, it just says "place of business" IIRC. O

The univeristy would present an interesting dilema though that I would not want to be the one to test. Is the place of business the office they have or the whole campus? They can go to multiple classrooms in the course of a day and as long as they are on the campus then technically they are at their place of business. I would argue then that teachers can legally CCW while at work. Their company policies probably prohibit it though.

Therefore, since the law (HRS 134-9) is silent on prohibitions on where you can carry WITH a permit, you can carry anywhere. Granted this is mostly a thought exercise since no one actually gets a CCW permit....

As for public schools, they can make up their own rules. I have been invited to speak to high school students at one school on a recurring basis about guns and the invitation includes bringing several firearms, pistols and long guns, to campus.
