HPD issue with medical clearance letter

So back when HPD had that whole situation with kaiser patients needing to get a medical clearance letter a few years ago (http://www.hawaiinewsnow.com/story/30790522/gun-permit-applicants-denied-over-medical-dispute)

I went ahead and went to an outside doctor (non kaiser, private practice) who wrote me a letter. Everything was fine after that. I was able to renew my long rifle permit twice and get a few pistol permits. no problems at at all.

This week I went to apply for another pistol permit and show them my medical letter like usual. The officer at the window scrutinized it and because its actually a copy of the letter not the original he told me I needed to come back with the original when I came to pick up the permit in two weeks. The issue is the doctor's signature isnt in "wet pen ink" (the words the officer used) cause its in the ink from the copy machine. Problem is I dont have the original, the doctor who wrote it does. I contacted that doctor and he said he'll try to locate the original but no guarantees cause it was a couple years back, further more he no longer writes those letters because of liability issues.

I'm not sure why they are wanting the original letter now, I was using this letter for 2 years getting permits no problems. It seems like HPD like to make up new rules whenever. I dont see anything in the law that says the letter needs to be signed in "wet pen ink".

Ask your physician what he thinks about the immunity law.  If there are flaws in it, then propose a legal fix to your representative in November for the 2019 legislative session.

§ 134-18.  Qualified immunity for physicians, psychologists or psychiatrists who provide information on permit applicants.
There shall be no civil liability for any physician, psychologist or psychiatrist who provides information or renders an opinion in response to an inquiry made for purposes of issuing a firearm permit under § 134-2 or for purposes of investigating the continuing mental health of the holder of a valid firearm permit provided that the physician,
psychologist, or psychiatrist acted without malice.

If the doctor is dragging his feet, just have him re-sign the copy.  It'll have the "wet ink" signature and the original date, so the doctor has less liability concern than creating a new letter.

Is this the letter that says "you're no longer Yada Yada". If not. Here's a hint. Does your doctor have to answer?

If you need to find a psychiatrist to sign off on a new letter you can go on https://www.psychologytoday.com/#sidr-main

You may have to make a few calls to find someone comfortable signing off, although a copy of your old letter and the applicable HRS should be sufficient to persuade a rational health care professional.

Please tell us how the situation resolves.

Im on the Big Island and will sign letters.

I agree just have him sign the copy and not have to find the original.  If your doc has an electronic record and saved it, it will be saved as a scanned copy and not on paper so there will not be an original with ink on it. 

If it were me, I'd make you a copy chiseled in solid stone for them  ::)

Just noticed that article is from 2015 and this at the bottom  "HPD and Kaiser say they are working toward a resolution. "

So sounds like the resolution was to do nothing huh?

I heard the resolution was that Kaiser would send the medical records but left it up to HPD to decide. Question is how competent are the clerks who make the decision. Do they have any medical training?

I recently had to sign a form for someone who could not get clearance from Kaiser so Im thinking they didnt do anything.

So maybe it was just the particular officer at the window who had a problem with the copy of the letter. Either way im still waiting to see if I could get the original from my doctor in case HPD complains again.

Unfortunately, that's not uncommon -- for there to be inconsistent direction at HPD.  That's why it's always good to ask for a copy of the law or policy they are using to deny you your rights.

But, fortunately for you, you got someone else.  Remember who the first officer was, and try to avoid him in the future.

Usually they defer to the ones that have been around longer, but idk what happened in his case.

sometimes it's better i think just to say you dont' have a doctor.  no doctor, no issue with medical clearance. lol  I've seen that done before.
