Until an Assault Weapons Ban is law, it's legal.  An AWB in most states will have lists of characteristics that supposedly define an Assault Weapon, and they usually include collapsible or foldable stocks.

Having said that, there's a federal law, 922r (18 USC 922r), which requires imported rifles and shotguns have a certain number of US-manufactured parts.  if you replace a US-made fixed stock with something else, make sure you're still in compliance.  In short, it's illegal to assemble a rifle using an imported receiver and "too many" imported parts.
