FIsher v. Kealoha update

Hi guys so judge Kay asked us for supplemental briefing.  The Brady Campaign took the position that American history should be rewritten so fulfill their political agenda. This is my brief. The other 3 parties should be filing in the next day or two.  I'll update this thread when their briefs have been filed.

Accordingly I focused my brief on that topic and opted to leave the criminal aspects to Mr. Wilkerson. He also is a highly experienced criminal defense attorney and I am not.  This is my brief. The other 3 parties should be filing in the next day or two.  I'll update this thread when their briefs have been filed.

this is the proposal to broaden our rights to carry right? not just CCW but to lift the restrictions of not being able to have a gun unless on your way to or from a range/gunsmith/policestation right? i hope that if the CCW doesn't pass we at least get that bullshit piece of legislation revised. carrying my rifle from my house to a relatives house or somewhere else should not make me a criminal.

No that is being done in Mr. George Young's appeal. This one is about HRS 134-7 which says you lose your gun rights forever if you get convicted of even a misdeanor crime of violence. Judge Kay presided over the final hearing recently.  After a excellent oral argument by Te Hina Hicks who was plaintiffs counsel (and me chiming in for a little while) Judge Kay ended with this case raises some very difficult questions for this Court. That is a really good sign. He said he was ruling against us in Baker right away. It sounded like he is giving serious consideration to overturning that law. We still have a long way to go but I really believe that we are going to overturn these laws. Moreover its going to be done by local attorneys like Donald Wilkerson, Tehina Hicks and Richard Holcomb not guys from D.C. who apparently don't think Hawaii is worth their time.

Thanks for doing this guys. This issue hits home personally, as a member of my family is being subjected to this clause, which is preventing him from owning firearms for the past 10 years.

Supposedly, his wife at the time fabricated a story that he had threatened her with a firearm, upon which he was immediately apprehended for terroristic threatening, even though it was later proved that her she lied to the officers. He later received a Governor's pardon from Lingle, which HPD refused to accept due to her office not listing the correct offense, and being that to receive the correct pardon, he would need to go through Abercrombie's office, which refuses to do so. He went through the correct processes to have this corrected, and just received a notice that it finally made it up to the AG office after waiting almost 2 years. Abercrombie has refused to return or answer any of his calls, as well as all the other state legislative offices he has contacted.

On behalf of my family member, I would like to thank you for fighting the good fight, and attempting to help individuals like him regain his 2nd amendment rights which were unjustly taken away from him for something he didn't do.  :shaka:

I don't mean to get too personal but has he applied to have is record expunged? I am curious about that process.
