Can you refuse the medical waiver?
« on: January 24, 2015, 09:50:34 PM »
Brand new member here and moving to Oahu in a few months as a result of military orders. I was wondering if anyone could help me better understand the process of moving my guns there. I've been to the Honolulu PD website and it says I have to register within 5 days of getting there. I also saw links for mental health and medical waivers that would give the police access to my medical records. Would I have to fill these out or are they just for people trying to acquire new guns? What happens if you complete everything else, but refuse to sign the waiver? I also noticed it said on the bottom of the form that you could revoke the waiver at anytime, does it affect your ability to own a gun in Hawaii if you do revoke the waiver?

There is nothing in my medical record I'm worried about, but the whole thing just seems like an invasion of privacy to me. Coming from Florida, the registration part is hard enough to accept, I don't see why I need a police officer rooting around in my medical records too.

I would appreciate any input from anyone who knows about this or has gone through the process of moving to Hawaii with firearms.

Just tell them it's a private doctor and list your doctor in Florida.

HPD doesn't access your medical records, they just mail a paper to your doctor.

My doctor doesn't even send the paper back.

He can't.

As soon as he says 'military', they know he will be TriCare and if he tries to lie they will catch him.

But as KK said, no need to worry.

Yeah, no need to lie, but I list my personal doctor, and he said they mail him "some crap" that he never sends back.

It's funny when people have Kaiser, because you don't get a doctor.

I wonder if any of the docs there bother sending anything back?

Either way, it's a stupid requirement.

Never had a personnel Dr. Thus I have always filled in NONE as my Dr.

Thanks everyone for your responses.  I still don't like it, but I guess it's not as bad as I thought.  I thought they would be requesting copies of all my records or something like that.

Has anyone tried revoking the waiver at a later date?  I'm wondering how that would affect everything since it says on the form that you can do that.

Since you have to sign a new waiver form with each permit application, HPD must forward the original signed form to the doctor/HMO,  Makes sense, because the doctor needs proof you gave permission for them to respond, and they more than likely need to keep that on file for CYA.

I'm only theorizing, but the way the process appears to work, that makes sense to me.

I wouldn't worry about HPD retaining the waiver for longer than that one permit request.  Once they have the doctor's response, the waiver is moot.

If you're really worried, ask the doctor how long they retain that waiver on file.  That's where the waiver actually can do harm later.

I have no doubt I would pass the check, it's just a personal privacy issue for me.  I don't want to give them any more than I absolutely have to.

Thank you again everyone for your inputs
