Help get HB 679 (Immunity for NRA instructors) heard and passed (corrected) (Read 3550 times)

Below is a message the HRA will be sending out shortly. I wanted to post it here and give you a little background on why it's important to act on this now.

As many of you know, Hawaii holds gun owners "absolutely liable" for any damages caused by the gun they own. I have had more than one potential instructor say they were not comfortable using their gun for taining because of this. HB 679 would exempt NRA instructors from this laibility. Of course the plaintiff's attorney lobbist opposes this saying there is sufficient protection in the current wording of the statue. Of course this is most likely an effort to preserve their client base by ensuring that if something happens you'd have to hire one of their members to defend you.

But, three years ago the County of Maui asked us to support their effort to limit the liability of county and state agencies that are "gun owners" but allow their agents (think DNLR, Sheriff, etc.) to use those county or state owned guns. So, despite any assurances from the plaintiff attorney group, there must have been some liability exposure or the county would not have asked for the exception to liability. That exception to liability was added and now the state and county have the exemption they requested. Our NRA instructors, providing mandated training, should be afforded the very same level of protection.

Please read the message below and call, write, or e-mail (calling is best, especially if it's followed up by an email) the legislators today.

The immunity bill for NRA Instructors (HB679) needs your help.  It provides immunity against civil suit for NRA Certified Instructors while they are teaching the NRA Firearms Basic Classes, required to obtain a handgun permit from your county PD.  Presently, volunteer Instructors are at risk from Hawaii's "absolute liability" law when they let students use their firearms.  A lawsuit could discourage Instructor participation.  No safety classes = a de facto handgun ban.

This bill dies if it doesn't get a hearing in the House Judiciary Committee by next week.  House JUD Chair Gilbert Keith-Agaran is an attorney and will likely support the plaintiff attorneys, who naturally oppose any curb on lawsuits.  Chair Keith-Agaran needs to know your concern ASAP.

Please e-mail him and cc his committee members.  Ask him to please hear and pass HB679, immunity for NRA instructors.

Yep, If we as instructors don't get coverage and are held liable, why teach?

Less people who qualify=less guns sold=store closure=???

Don't know if out of sate instruction qualifies

Can always change laws to DQ Hunter Safety because no actual firearms used........

Hearing was yesterday. It was passed on to the Senate with amendments (won't know what the substance of the amendments are, they should be posted later today or first of next week). The amendments will likely water down some of the liability immunity, but we'll see.

I wanted to thank those that contributed and submitted testimony or called their legislators. However, I did want to point out s few things. It is impossible to say how many individuals helped with this because there is no way to track who spoke to their respective legislators. But, at the hearing there was only 15 people that submitted testimony. Now, I understand that some of you are not instructors, so you may not have felt inclined to help. But, I think that may be a mistake. One of the biggest problems we have is that the legislators do not view us as a big enough block of voters to be very concerned about voting against our issues. We must, IMHO, change that. We must show that not only do we stand together, but we support our various interests as if they were our own. We cannot let "them" feel as if they can divide up the issues by fractionating our "coalition." In other words, just because this was an "instructor" issue, doesn't mean that ALL gun owners shouldn't have submitted testimony. We must, again IMHO, start flexing our collective muscle and that cannot happen if we tell ourselves that "this issue doesn't affect me, so I'm not getting involved."

It also would have been good "practice" in submitting testimony. Remember, while it is generally better to write something for your testimony, you can also go to the website and just submit that you support or oppose the bill and not write anything else. So, may I suggest that when this measure gets its hearing in the Senate, that everyone submit testimony. In the meantime, call the members of the Senate Judicary and Public Safety committees (where this will likely be heard), especially if your Represenative is on one of those committees, and start the dialogue now. Start writing any testimony now. Notice about hearings may come with little advance notice and testimony needs to be submitted 24 hours in advance.


I want to say thanks to those that helped. To those that didn't, well, that's OK, but consider how much better we could do with everyone's help. In closing, I want to mention that the only real opposition came from the Plaintiff's attorney group who has a vested interest in making sure there are pleanty of opportunities for he and his cronies to make money suing folks and therefore like keeping folks on the "liability hook." Let's not let him win.
