Justice Thomas rips Ninth Circuit and SCOTUS re 2nd Amendment Today SCOTUS denied cert to Silvester v. Becerra (challenge of California's 10 day waiting period for people who already own other firearms), and Justice Thomas issued a blistering 14 page dissent ripping the deceptive and, according to him, unconstitutional ignoring of the rights protected by the Second Amendment. It's a great read, and explains exactly how the courts have conspired to rob us of our ability to legally exercise our rights (by, among other things, using "rational basis review" masquerading as "intermediate scrutiny"). My only disappointment is that the dissent was not joined by any other justices, especially Gorsuch.
https://www.supremecourt.gov/opinions/17pdf/17-342_4hd5.pdfThe right to keep and bear arms is apparently this Court’s
constitutional orphan. And the lower courts seem to have
gotten the message.
If a lower court treated another right so cavalierly, I
have little doubt that this Court would intervene. But as
evidenced by our continued inaction in this area, the
Second Amendment is a disfavored right in this Court.
Because I do not believe we should be in the business of
choosing which constitutional rights are “really worth
insisting upon,” Heller, supra, at 634, I would have granted
certiorari in this case.
