Firearms Bills PSM committee 2-6-2020

First hearing is up for Senate Public Safety this Thursday 115pm at the State Capitol room 229.  We will be asking for testimony on the HIFICO page or do it on the capitol webpage.

We need as many of you to take the afternoon off to attend the hearing in person to testify.  This is our best chance at stopping the rifle mag ban and other gun control bills.  If the rifle mag ban passes, you'll have to destroy, modify, or sell them off island.  We plan to file a temporary injunction should the magazine ban pass, but you'll have to chip in for the $15,000 cost so stop it now.

Testimony submitted.  Doesn't take more than a few minutes to submit testimony.  I did spend some time to submit more lengthy testimony on some of these.

Got a couple more to do, but it's a start....

For your thoughts and ideas:

OPPOSE
SB 2002 - RELATING TO FIREARMS. Prohibits any person from possessing a loaded firearm while intoxicated, unless the person is in their own dwelling.  Violation is a petty misdemeanor.

This is a Bill which is frankly unenforceable and is wasteful of our tax dollars and the time of Law Enforcement. As it is already statutorily illegal to carry a loaded or unloaded firearm except as noted in HRS 134-23, HRS 134-24 & HRS 134-25, law abiding citizens would not be possessing/carrying firearms outside the locations noted in the above statutes and as defined in section 703-300. Further on, this would make a person guilty of a misdemeanor if they step outside of the confines of their dwelling (home) into their yard or if hunting outside of their tent as noted in section §134-X (c)(1) to use the example of cooking at a grill or open air fire. Do we really want to criminalize someone for cooking?

Regarding section 2(A), who is determining the level of impairment and the persons normal mental faculties? As every person is different, this is highly subjective and open to vast interpretation. Will there be additional funding made available to place law enforcement at hunting camps or at peoples home to ensure that they do not step outside?

As such, this proposed legislation does nothing but place more restrictions on law abiding citizens and waste taxpayer dollars on an unenforceable statute.

OPPOSE
SB2519 - RELATING TO FIREARMS. Prohibits the manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of detachable ammunition magazines with a capacity in excess of ten rounds, regardless of the type of firearm with which the magazine is compatible.  Makes an exception for possession and use by law enforcement agencies and officers.

This bill would continue to punish law abiding citizens of the State of Hawaii and infringe upon their right to defend themselves in a manner which they deem acceptable. It would severely impact their ability while at home in the unfortunate event of a home invasion. It’s the middle of the night and someone breaks in with the intent to cause physical harm. The bad actors have firearms obtained illegally and are a threat to you and your family, but you are limited to only 10 rounds in a magazine and have no way to carry extra magazines in your pajamas and you are calling 911 with your cellphone in your other hand. What do you do? It has been proven on many different occasions that standard capacity magazines made the difference between life and death for the law abiding citizen. Judge Roger Benitez from California declared magazine bans unconstitutional in his 2019 ruling. He ruled that magazines holding more than 10 rounds are "arms" under the U.S. Constitution, and that the… …law "burdens the core of the Second Amendment by criminalizing the acquisition and possession of these magazines that are commonly held by law-abiding citizens for defense of self, home, and state."

Magazines that have capacities larger than 10 rounds were designed that way by the manufacturer for an explicit reason; to give the user the ability to defend oneself against bad actors with equality. To deviate from that would be redesigning the firearm from its initial and desired design. The Glock 17, which is the standard issue firearm for the Honolulu Police department, has a designed standard capacity of 17 rounds. The Colt AR-15 is the standard issue rifle of HPD, which is designed for use with 30 round capacity magazines. HPD officers routinely carry their own personal rifle with standard capacity 30 round magazines, that of itself does not afford any uniformity within the department and allows the individual officer to make undersigned modifications to their personal firearm which may place the department or City & County at risk. And as the proposed statute revision reads that law enforcement is exempt only in the performance in their official capacity (new section (d)). Will they be required to leave all magazines, rifle and pistol, that can hold more than 10 rounds at their respective armory and not allowed to bring them home? Is the intent of the statute to create two distinct classes of people in Hawaii? Is the safety of the Law Enforcement Officer more important than the safety of the law abiding citizen? That is what this statute is making. Law Enforcement Officers are civilians at all times and when off-duty they are not functioning in their official capacity and are subject to the statute.

Banning magazines with capacities of more than 10 rounds does nothing to address the real issues of crime in Hawaii and is only trying to fix a problem that doesn’t exist. Banning larger-capacity ammunition magazines won’t reduce the number of shootings, any more than banning alcohol reduced alcohol-related fatalities.
I urge you to oppose this measure and to work to repeal the current law of pistol magazine restrictions for the safety and welfare of Hawaii residents.

OPPOSE
SB2635 - RELATING TO FIREARMS AMMUNITION. Requires the licensing of sellers of ammunition, and for the identification and proper permitting of purchasers or possessors of ammunition.  Regulates ammunition in the same manner that firearms are regulated.
This bill would punish law abiding firearms owners both within and without the State of Hawaii.
1.   This would greatly hurt the hunting tourism industry of Hawaii as hunters who come to Hawaii for weekend hunts would not be able to purchase any ammunition for their firearms. Such restrictions would greatly impact the finances of small and large hunting guides as hunters would go to other places to hunt and take their wallets with them. This would also affect the greater tourism industry as the hunters may bring their family members to Hawaii to vacation while they hunt. This revenue stream would go away, leading to job loss and decreased earnings to businesses and subsequent tax revenue loss.
2.   This would hurt the organizations such as the Boy Scouts and other such organizations that provide learning opportunities for youth to learn safely about firearms. Using the Boy Scouts, typically, one adult leader purchases the ammunition for their entire troop to use at the event. The firearms are owned by the Boy Scouts organization, not the individual. That would make the ammunition purchaser a criminal as he/she would not be purchasing ammunition for their registered firearm. How would they purchase ammunition? Purchasing ammunition for firearms not registered to the individual would in essence constitute a “straw purchase”, making all involved criminals. Now that group is disenfranchised from a Constitutionally protected event and the youth are not afforded the ability to learn SAFELY about firearms. Todays youth are tomorrows leaders.
3.   Todays firearms are more and more available as multi calibers. To the point where manufacturers are marking them as MULTI. There are factory kits available for firearms to convert calibers. These are designed by the manufacturer. The manufacturer SIG has the P320 and P250 pistols available as 9mm, .40, .357SIG with different conversion kits. The “firearm” of the SIG is just the “Fire Control Unit” How does an owner procure ammunition for these firearms if it was not originally registered as a certain caliber? To enact this places an undue burden on the firearm owner. How is law enforcement set up to easily and conveniently help firearms owners? Will owners have to re-register a firearm for every caliber if they choose to change?
4.   This statute change does not address shooting events where firearms owners gather together to engage in a legally protected activity. When an individual runs out of his own ammunition, he is barred from borrowing ammunition from his friends, even though all persons are legal possessors of firearms. And should the event occur where borrowing or giving of ammunition would occur, all involved would be made into criminals. Why are we criminalizing legally protected activities?
As such for these and many other reasons, I urge you to OPPOSE this bill.

SB2943 - RELATING TO FIREARMS. Makes it a Class C felony to purchase, manufacture, or otherwise obtain firearm parts for the purpose of assembling a firearm with no serial number.  Amends certain requirements relating to firearms registration.

This Bill does nothing to address the crime occurring in our streets. Most firearms are obtained illegally via theft or straw purchase. And in crimes where the firearm has no serial number, it was removed previously, which of itself is a criminal offense. Criminals would rather steal a firearm than go through the detailed and laborious process of manufacturing a firearm. It takes skills and tools to be able to manufacture a safe and reliable firearm. Law abiding citizens want to ensure that they are using something that will not hurt them or the ones around them. Federal law allows individuals to manufacture firearms for their own personal use. And in Hawaii, firearms are already required to be registered. This same requirement would hold true on self made firearms in the same manner as firearms brought in from out of state as stated in HRS 134-3.

The Bill as written would also ban every part for firearms repair or upgrade. Many firearms owners in Hawaii are competitive shooters and purchase parts for their firearms for competition use. Hunters would not be able to acquire replacement parts for their rifles. By banning these parts, they will be unable to repair or upgrade their legally possessed firearms. Parts affected by this ban would be, but are not inclusive of; bolts, upper receivers, slides, barrels, extractors, ejectors, trigger shoes, firing pins, sights, springs and so forth.

Also, by making it illegal to purchase these parts, local firearms shops would lose the largest part of their business, which is accessory sales. This would result in lost tax revenue from lost sales and higher unemployment as shops lay off employees or cut their hours to account for the shortages in income.

To pass this Bill does nothing but place more burdensome restrictions on law abiding citizens who wish nothing more than to exercise their Constitutional right to keep and bear arms as set forth in both the United States and the Hawaii Constitutions.

I urge you to OPPOSE this Bill

OPPOSE
SB3054 - RELATING TO FIREARM REGISTRATION. Amends section 134-3, Hawaii Revised Statutes, to require the registration of firearms that are moved out of the State.  Creates a penalty of a petty misdemeanor for any person who fails to register a firearm that is moved out of the State.

I urge you to OPPOSE this Bill as it accomplishes nothing. It has no affect on crime, does not affect public safety or serve any lawful purpose. It also oversteps the States authority as the State would not have any legal jurisdiction over any person or item that is not within the State boundaries or legal enclave. How would the State prosecute this offense? By what mechanism would it be enforced?

How would said firearm be removed from the roles of registered firearms in the State of Hawaii? How would the record be destroyed as the State would have no legal purview over the firearm? How would the owner of the firearm be notified that the removal is complete? In most instances, the firearms have left the state with the owner. Is the owner duty bound to return to Hawaii to “unregister” the firearms as the firearms must be registered while they are in the State. Who is responsible for the costs incurred to travel back to Hawaii?

If the firearms are transferred via sale, there is already a mechanism under HRS 134-2 and 134-4. Even the firearms are sold to an out of state buyer they go through the transfer process via an FFL and completing the chain of custody for registration.

By creating another burdensome layer, the only thing accomplished by this revised statute would be creating “victimless crimes” and creating a “solution” to a problem that does not exist.

I urge you to OPPOSE this Bill.

For you guys that were visiting the legislators last year, do they even read these?   I submitted but the testimonies seemed to make zero difference if a bill passed out of committee or not last year.

I believe the are bound by law to read the testimonies, I also think that without physical presence at the hearings thousands of testimonies are required to make any real difference.


On another note..... I have been trying to wrap my head around sb3054, it seemed pointless at first but I now believe it is actually a sneaky well calculated move. I suspect the information collected will be used as a sort of back door national registration list that can be shared amongst states. Antigunners are quickly moving from state to state and pushing legislation that is copied almost word for word, I believe they are seeking to bypass federal law and create their nationwide registry...... just my two cents I could be way off.

so, SB2437, Electric Guns.  I'm confused, are we in support of it, or opposed to it?
I like the idea of repeal the ban on stun guns, but I don't like the idea of "create a regulatory structure".  Also not too keen on restrictions on "storage, transfer", and creating the hurdle of "requires training and education".  so, what says the hive?

support because it repeals the ban, even though at the same time it makes it difficult to obtain, etc?  something is better than nothing?

Repeals the ban on electric guns.  Establishes a regulatory structure for the sale and transfer of electric guns by licensed persons.  Allows for the use of electric guns for self-defense, defense of another person, and protection of property.  Restricts the use, storage, transfer, and disposal of electric guns.  Requires training and education on electric guns.  Prohibits certain individuals from possessing and using electric guns.  Prohibits the use of electric guns in the commission of crimes.

You signed up for the pledge to testify, and the call is here.  We really need your help to stop the anti-gun bills tomorrow and attending the hearings in person is extremely important.  My goal is to get 30 people to show up, right now I have about 15 commitments.  We have the potential to defeat the gun control bills in the Senate Public Safety committee (see attached report card) which could stop all those bills dead. 

Please contact me if you can attend the hearings.  Either way submit your written testimonies at the links below.  There are a lot of bills, but just testify (written or in person) on the ones you want to.  HIFICO's priority is:
1.  Ban all magazines over 10 rounds (rifles & PCCs) SB2519 and HB1902
2.  Ban on lending of firearms HB1600
3.  Firearms Registration check on ammo purchases SB2943 and HB2736

For oral testimony in person, we want everyone to cover different topics and not just everyone saying 2nd Amendment right.  Topic examples for the magazine ban:
1. How many $$$ worth of mags you have and how much will you lose
2. Do you have vintage collectable rifle magazines
3. Type of training you do with the magazines - USPSA, tactical, etc.
4. historical and legal facts
5. Defensive use scenarios
6. Shooting combat style, use the 30 round AR mags as a bipod
7. Military shooters want to train on the equipment they use.
8.  You have a disability where it's difficult to reload.
9.  You go pig hunting with your M1 Carbine with 15 round magazines.
10.  Special skills or knowledge (gunsmith, instructor, law enforcement, etc)
11.  You're in the military reserves and keep your equipment at home.
12.  Difficult to train for competitions with a 10 round magazine
etc.......

Any links to studies or arguments on mag capacity for citizens and LE?

Will be doing research tonight. But some stuff going around in my mind are:

- LE can fall for backup. I’ll likely be on my own
- Fact - recent instances of groups of attackers
- Fact - observes response time to my apt was in the 10-12 min range and that’s with the main station a few blocks away. Observed longer for my dad’s house in PC/Aiea area.
