if Dog Bounty Hunter showed up at your house?
« on: January 01, 2011, 12:32:57 PM »
looking for a fugitive pepper spray drawn...can you draw your firearm on them? Seems like they can go onto any property looking for a fugitive...Watching them hop fences, go into yards etc.
What kind of "powers" or authority they have? Seems that they go into any establishment i.e. hotel and ask for confidential info.

For starters, you can't draw your weapon on a person solely because they have pepper spray and are on your property. From Massad Ayoob (1):
Quote
"Deadly force" or "lethal force" is that degree of force which a reasonable and prudent person would expect to cause death or grave bodily harm. A person armed with a gun is incontrovertibly in command of lethal force.

Lethal force is justifiable only in a situation of immediate and otherwise unavoidable danger of death or grave bodily harm to oneself, or to another innocent person one has the right under law to protect.

Trespassing, theft and insults are not grounds for the firing of a gun. Only when killing or crippling force is used or is about to be used against the innocent can a similar level of force be employed by the citizen defender.

Three criteria must be present to create that condition of immediate, otherwise unavoidable danger of death or grave bodily harm to the innocent. These criteria are ability, opportunity, and jeopardy."

When I went through MP training, we were taught "Opportunity, Capability, and Intent," virtually the same as listed above. I highly recommend that all gun owners, at a minimum, devote their time to reading everything that Mas puts out there. Ideally, they would attend one of his MAG (Massad Ayoob Group) courses. Like the saying goes, you don't know what you don't know until you know. :)

I'm waiting to watch Dog's final episode where is actually gets shot by a "real bad" guy.

Intent is a biggest factor. A guy who drives around with rope, duct tape, garbage bags, and a chainsaw in his car may be a tree trimmer and not a serial killer.  But then again.....

Understand. But in some episodes, it is difficult to ID that they are carrying a chemical agent. Some of their pepper spray devices have an M4 style buttstock.  I'm just wondering what kind of powers / authority they have as they are all over the place when searching for a bail jumper.
But I got it. I'll call HPD first.

In Hawaii, unless the person is inside your home it would be very bad for you, if you did any shooting.  If the hunter entered your home and you are not the one on bond then he is in violation, from what I gather.

Almost 98% of the people he persues give up with out a struggle. Hahaha! That's why he stays here in Hawaii mostly. Even the criminals here get small kine ALOHA! If he came into my home I'd ask him to sign my AK. That's the "Clean the gun while my daughter gets picked up by boyfriend" card... Looks innocent but sends the intended message..... :geekdanc:

I am still waiting for the episode where Mexican bounty hunters snatch him up and extradite him back to our southern neighbor!

Dog acts like he and his family are cleaning up Hawaii by putting all the criminals back in jail, but really if they hadn't bailed them out in the first place the criminals would still be locked up.  He is essentially putting criminals on the street only to catch them again for viewer entertainment-- while laughing all the way to the bank.

And the way they hype up different areas of the island as being  "full of gang activity" and "super dangerous"; It's only dangerous if you're a narcissist running around with a camera crew trying to make money off of the lowest denomination of society.

Either way, the show does get interesting every now and again (Skip to the 2:30 mark to watch Leelan get maced by his own team, and then run for his life from some angry locals ):

If I recall (read it somewhere a while back), when the bail bonds paper work is done by the person requesting bond, they and their co-signer(s) agree that if they fail to appear to court and bail is revoked, Dog and his crew are allowed access to the address(es) to serve the arrest warrant. These people who are looking for bail bond from Dog have already given them written consent to enter the properties.

Now if they head to a place that isn't listed in their paperwork, I've always seen them ask for permission to enter the home, or place of business.

Considering Sheriff Dept and HPD are already overtaxed, I'd rather have Dog and his crew looking for these guys. I don't mind that they're making a living getting crack heads and woman beaters off the streets. Better that they get em back in lock up, than some crack head breaking into my home looking for money or other stuff. But hey to each his own, just my personal opinion.

Aside from being not able to own a gun I don't think he's for it.  I was watching one of his episode, they went to this apartment complex and the crowd were acting up like they want to fight them, he turns to the camera and he said,"This is the reason why I don't carry guns."  Why don't  just tell that he can't carry guns.

On the flip side, I watched some TV series bounty hunter show with some guys from Texas and those dudes look like their loading up to fight WW3 when they go out.

Course, when the fugitive ran they could barely move but it sure was entertaining to see them falling over shit and unable to hop fences.

Not necessarily the best source of info, but from wikipedia:

Quote
In the United States of America, bounty hunters have varying levels of authority in their duties with regard to their targets depending on which states they operate in. As opined in Taylor v. Taintor, and barring restrictions applicable state by state, a bounty hunter can enter the fugitive's private property without a warrant in order to execute a re-arrest. They cannot, however, enter the property of anyone other than the fugitive without a warrant or the owner's permission.

I have had the pleasure of meeting "the Dog" on a couple of occasions when he brought prisoners in to be evaluated/medically cleared. He's an arrogant, obnoxious, demanding, and  pushy assh*#e. Almost had to throw him out of the ED on one occasion....too bad he settled down, the Security Officers who were helping me really, really wanted to toss him.
