Building your own firearms + state law?

So I know the feds don't care unless it's an NFA item.. does anyone have experience building your own (from scratch or 80%, etc) insofar as how HPD treats this? Specifically long guns.

§134-3 (b) says if there's no serial # that the permit # would be engraved on it. That makes sense to me and so I'm assuming that if you construct your own you'd have to engrave it yourself? Or can you just make up your own serial # and use that? As a practical matter if it looked well-made and had a serial # I doubt they would care. The concern would be if ATF would then be able to go after you for being a manufacturer (even if you don't try or intend to sell any).

manufacturing a firearm for personal use has always been ok without paying any taxes.
until the GCA of 68 all firearms were not required to have a distinct serial number.

since you are the manufacture , you are able to select your own distinct serial number.

yes, I have manufactured several firearms from 0% and parts kits .

Very cool! Congrats on having the skills to put that together. Just out of curiosity, how long were you at HPD waiting for ATF to show up, and did they say anything other than "it's okay"?  :shaka:

it was about lunch time when I went into HPD. took then over two hours to show up with 3 agents, two where new recruits.
it went fast and only ask me one question ," is it for personnal use".

the reciever is all marked  in Hebrew with original IDF insignias .

I don't know what federal laws you have to satisfy in order to construct a firearm from scratch (not parts) but I cannot think of any Hawaii firearm laws that says you cannot mill and build your own firearm from scratch. Yes you would have to develop a serial number system and ifyouwere going to sell any you probably need an FFL? and all the right tax license/business license.

Ok, found that there is a state license you need to manufacture.

§134-33  Punishment for violations of section 134-32.  Any person who manufactures or sells any firearms within the State without having a valid license so to do, or who being a holder of a license violates any of the terms or conditions of the same, shall be fined not less than $100 nor more than $1,000 or imprisoned not less than three months nor more than one year. [L 1921, c 13, pt of §1; RL 1925, §2036; RL 1935, §2557; RL 1945, §7198; am L 1953, c 155, §1(c); am L 1955, c 54, §2; RL 1955, §157-33; HRS §134-33]

hey guys im new here but i actually just spoke with someone at hpd over then phone and was initialy told that
-lower reciever if homeade (80% etc.) must be brought in before assembly to be registered. then you would be issued a number that "shall" be engraved on lower reciever. he then said i had to bring the gun back in when it was fully assembled. i asked what the window of time allowed from initially bringing the reciever into for registratioin to this "inspection" was and he said he didn't know. i then told him that nowhere in HRS134 does it state that homemade guns need to be brought back for inspection/verification of engraved permit number on the reciever. he said "oh" but that he was going to read and look to see again.

i figure if you bring in your lower reciever and register it you "should" get it engraved with HPD supplied number, which is simple enough.

i havent done mine yet but it sounds good to me. if anyone else has more information about how they succesfully registered their homeade or 80% build with HPD i would really appreciate it. it would be nice if i could be done with everything all in one trip to town. thanks

That is incorrect. After you finish ANY Receiver you need to then take it down to HPD. Not before.  You can put any ID marks on it for a serial number.

This is considered a personal built firearm and CAN NEVER BE SOLD OR TRANSFERRED.

Except if you pass away then you can transfer it to your kin.

they can be transferred, but not for profit or as a business. ATF does not specify how many is too many, but if you don't like the lower , they can be TRANSFERRED   to another but not sold.

Like most, I am not in the "firearms manufacturing business", I'm just a regular Joe Shmoe messing around with various power tools in my garage or workshop.  So would the manufacturer's name would be my name?

........and shall include the following information:  name of the manufacturer and importer; model; type of action; caliber or gauge; serial number; ..........
