Quick question about magazines when purchasing handguns online

Aloha,

New to purchasing firearms here in Hawaii. When you guys and gals purchase online for shipment to ffl, are you picking CA legal handguns to fit into the 10 round restriction (when the gun typically comes with a higher round magazine), or ? I understand it's legal if you are a part of a firearm organization to have higher capacity magazines at the range yes? Does that mean that you can purchase handguns with those magazines or do they have to be purchased separately?

That is correct but HPD disregards this and will make an arrest and press charges regardless..


134-11  Exemptions.  (a)  Sections 134-7 to 134-9 and 134-21 to 134-27, except section 134-7(f), shall not apply:

     (1)  To state and county law enforcement officers; provided that such persons are not convicted of an offense involving abuse of a family or household member under section 709-906;
     (2)  ...........................
     (3)  To regularly enrolled members of any organization duly authorized to purchase or receive the weapons from the United States or from the State; provided the members are either at, or going to or from, their places of assembly or target practice;

Nearly all retailers will not ship to Hawaii any handgun that has a magazine over 10 rds.

the FFL will not release a pistol with more then 10 round magazines to you unless you are mil/leo
you will be required to have them blocked before you pick up the firearm if they have more than 10 round magazines

it is a misdemeanor to possess unloaded pistol magazines of greater than 10 rounds
and a felony if they are loaded in the firearm
it is not illegal to possess magazine parts
you are incorrect about being a part of a firearm organization, you need to be mil/leo to use pistol magazines of greater than ten rounds

"CA Legal" handgun standards involve more than just mag limits, so you don't necessarily need to select that option.

Some online retailers will post the gun + 10rd mags as an option. 
Others may simply state "Not for sale in Hawaii with magazines."  In that case, you wind up having to buy mags on your own. 
Still others simply refuse to do business with states that impose these restrictions for various reasons.

Most firearm manufacturers do offer 10rd mags for states with limits, so it might depend on whether that specific seller adds that product with 10rd mags to their inventory. 

Many pistols come with standard mags that hold 10rds or less.  If you buy one of those, this issue is moot.

An FFL is allowed to receive & possess mags > 10rds.  Whether of not they can actually make use of them is another thing.

You can take the pistol without taking the magazines.

Dunno of any shops letting military personnel take handgun magazines over 10 rounds home without blocking them. I have heard it said at multiple shops that for LE you need to have 24/7 police powers in Hawaii in order to receive your unmolested standard capacity magazines. Could just be those shops policy's?

Can anyone else offer any insight in to this?

Now being military if a standard capacity  beretta magazine made its way to my house and was somehow found by LE would I have a way out of charges if filed by being military?

exempt LEO and SOT from posession of magazines , SBRs and machine guns

But HPD does not think so.......

A few minor corrections if I may Mac....

It is a misdemeanor to possess an unloaded magazine capable of being used in a pistol if greater than 10 rounds. It sounds like semantics but makes a world of difference if one tries to argue that AR or AK magazines are (or are not) affected by this law.

It is a felony to have a magazine capable of being used in a pistol inserted into a pistol. Presumably, this would mean that if you were caught with a 30 round magazine in your AR/AK rifle, it would still be a misdemeanor. Take it out ant put it in a pistol variant, and now you're committing a felony.

 §134-8  Ownership, etc., of automatic firearms, silencers, etc., prohibited; penalties.  (a)  The manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of any of the following is prohibited:  assault pistols, except as provided by section 134-4(e); automatic firearms; rifles with barrel lengths less than sixteen inches; shotguns with barrel lengths less than eighteen inches; cannons; mufflers, silencers, or devices for deadening or muffling the sound of discharged firearms; hand grenades, dynamite, blasting caps, bombs, or bombshells, or other explosives; or any type of ammunition or any projectile component thereof coated with teflon or any other similar coating designed primarily to enhance its capability to penetrate metal or pierce protective armor; and any type of ammunition or any projectile component thereof designed or intended to explode or segment upon impact with its target.
     (b)  Any person who installs, removes, or alters a firearm part with the intent to convert the firearm to an automatic firearm shall be deemed to have manufactured an automatic firearm in violation of subsection (a).
     (c)  The manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of detachable ammunition magazines with a capacity in excess of ten rounds which are designed for or capable of use with a pistol is prohibited.  This subsection shall not apply to magazines originally designed to accept more than ten rounds of ammunition which have been modified to accept no more than ten rounds and which are not capable of being readily restored to a capacity of more than ten rounds.
     (d)  Any person violating subsection (a) or (b) shall be guilty of a class C felony and shall be imprisoned for a term of five years without probation.  Any person violating subsection (c) shall be guilty of a misdemeanor except when a detachable magazine prohibited under this section is possessed while inserted into a pistol in which case the person shall be guilty of a class C felony. Would like to know more info on this also.  Have anything in writing stating the mil can receive magazines that can hold more than 10 rds?  I had a glock from the blue label program and was sent 13 rd magazines.  ffl wouldn't release them to me.
