Registering a long gun at first, then registering as a pistol
« on: December 05, 2015, 01:53:40 PM »
Has anyone ever had experience with buying  a long gun and registering it at HPD as a long gun. Then working on it and turning it into a pistol and registering it as that instead?

it doesn't necessarily have to be an AR.
I'm not concerned with the federal level of long  guns to pistol.
for these purposes I care about is in the "other" category like a PG only shotgun or an AR reciever
i've got plenty of reg receipts from AR lowers already.

has anyone ever
1)brought anything in the other category
2) picked it up from the FFL as if it were a regular long gun transaction but filled the 4437 as other
3) registered it at HPD as a long gun
4) put on whatever you needed to make it whole
5)go back to HPD and register it as a pistol

your white copy receipt should say "receiver only", regardless of permit it is still a receiver.
and your 4473 was "other"
However, HPD tends to make up their own laws and may prohibit it, even though HRS and BATF  has no restrictions on it.

Oh good, it's the person I hoped would chime in.

Did you ever get around to bringing one of those non NFA shotguns in?
whatever thing the ATF and mossberg were going through that stopped them from selling the 14in barrels is over and they've been shipping them now.
If I can get the 4473 filled out as other then I'll be good on the federal side, I'm just wondering how the HPD will react when i show up the very next day to get them to change it to a pistol under HRS definitions.

This one ! ;)
Federally its a "firearm" , under HRS its a "pistol"

Not yet.
It transferred on the 4473 as "other" (receiver only). Built into a "firearm under federal law. The State Laws here also recognize it as a "firearm" but this State does not mandate registration.

What does your white copy read? "receiver only"

I had registered several NON AR 80% at HPD , and all of them were registered as "receiver only"

I haven't been able to find a receiver yet. i figure i could just pick up a pg only mossberg from one of the local gunstores that have them and make sure they 4473 it as other firearm.

FFL are required to 4473 them (PGO) as "other"  as per  the ATF open letters distributed to dealers. however local gun store still register them as long guns with HPD.

Make sure the the LGS registerers them as pistols.

Pistol Grips and Shotguns
Firearms with pistol grips attached:
The definition of a shotgun under the GCA, 18 U.S.C.
§ 921(a)(5), is “a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and de- signed or redesigned and made or remade to use the energy of an explosives to fire through a smooth bore either a number of ball shot or single projectile for each single pull of the trig- ger. Under the GCA, 18 U.S.C. § 921(a)(29)(A), handgun means “a firearm which has a short stock and is designed to be held and fired by the use of a single hand.” Federal law provides under 18 U.S.C. 922(b)(1), that if the firearm to be transferred is “other than a rifle or shotgun,” the purchaser must be 21 years of age or older.

Certain commercially produced firearms do not fall within the definition of shotgun under the GCA even though they utilize a shotgun shell for ammunition. For example, firearms that come equipped with a pistol grip in place of the buttstock are not shotguns as defined by the GCA.

A firearm with a pistol grip in lieu of the shoulder stock is not designed to be fired from the shoulder and, therefore, is not a shotgun. Since it is a firearm “other than a rifle or shotgun,” the purchaser must be 21 years of age or older. Additionally, interstate controls apply. The licensee and transferee must be residents of the same State.
Other questions raised pertain to entries made in the licensee’s required records with respect to firearm “type.” These entries should indicate the firearm type as “pistol grip firearm.”

that's the thing though, i don't think the LGS will sell it as a pistol but we'll see
as far as I can tell there's no HRS saying that a long gun can't become a handgun after the fact

It would be pretty logical that NO LGS are willing to do this, or just don't understand the laws.

Buy it on the Mainland and just fly it back to Hawaii , Make sure all your paperwork and ATF letters are handy and available , just like a NFA item.

Even in PA , I had to explain the laws on numerous occasions.

Guilty until proven innocent is the new America.

that's the problem. since other firearms on a 4473 have to be bought by a person with an ID matching the same state of purchase i can't just go out of state and get a PG only shotgun. i'm SOL on that.

it just occurred to me that couldn't i just by a PGO shotgun an register it as just a reciever by taking it to HPD without the barrel?
