Inbound from Kommiefornia and I need some help with the HI laws
« on: February 04, 2016, 06:29:53 PM »
As I stated in the new member intro, I am inbound HI in a couple weeks and am trying to get smart on the processes in HI.

I know that I have to register my firearms  :grrr: with the HPD, but what do I need when I show up to the HPD?  I am bringing three long guns and about 10 handguns with me, do I need to bring them with me when I register?

What is the deal with medical/mental/doctors note?

Separate question, I know standard capacity mags are a no-go for handguns, but I am bringing a match AR, should I pack my standard capacity mags for it?

Thanks for your help and I look forward to meeting some of you.

What is the deal with medical/mental/doctors note? : HPD has a form that you fill out that says you give them permission to contact your doctor to see if you have any medical reason not to possess a firearm,
You have 2 choices. Fill out the form in Full (name, doctors contact info and signature),  OR Tell them you dont have a doctor and write none in the doctors section
http://www.honolulupd.org/downloads/medicalinformation_HPD089R05_13.pdf Their is also a state medical release that goes to the department of health http://www.honolulupd.org/downloads/mentalhealthwaiver_HPD089AR02_14yellow.pdf

Separate question, I know standard capacity mags are a no-go for handguns, but I am bringing a match AR, should I pack my standard capacity mags for it? 30 round mags are a grey area, As AR pistols that have a detachable magazine are illegal here (assault pistol ban) it appears for the time being that 30round AR mags are being allowed.

Thanks for your help and I look forward to meeting some of you.

Don't take any magazines with you when you go to register. If you have standard capacity pistol mags, don't bring them or take them apart and keep them as parts kits
Also you have a time frame to register your firearms

Welcome, lots of info on this site.

I am still a novice but here are some highlights of what I have learned here:

*Soo many discussions on your questions can be found here but take all advice with a grain of salt and use your own judgement, because Hawaii laws and the way we locals interpret them are infinite.
*Good discussion on standard capacity magazines from the mainland https://2ahawaii.com/index.php?topic=20850.msg187335#msg187335
*As far as ID and medical waiver requirements for out of state transfers, you might want to call HPD Firearms Division and ask to be sure.  They do answer the phone which pleasantly surprised me.  Not sure how to handle if you don't have a local doctor yet.
*Need $14.75 in exact change for background check, one time fee.
*I agree with the other post, HPD is not required to check your magazines and they don't ask so leave whatever magazines you have at home.  The limit is 10 rd for any mag that will fit in a pistol, this includes the infamous "assault pistol". which is itself illegal in Hawaii.  Sooo many laws that overlap which leads to confusing interpretations.
*In my experience, the officers at the window really are trying to help you with the paperwork as long as you remain calm and speak respectfully.  Not all of them are super friendly but they usually want to get you in and out as quickly as possible.
*There are HPD officers on this website because a lot of them like guns too.
*Do not promote illegal practices on this site (see line above).

All good stuff.  Thanks.

Do I need to bring my firearms with me when I register?  All of them?  I don't want to look like a nut job.

Make sure they are legal to possess in Hawaii before you bring them down !  :shake: :shake: :shake: :shake:

I think that technically, you have 5 days after arrival to register them.  You can make multiple trips if you want but the line will vary in length from day to day so you are probably better off bringing them all at one time if you can.

Just my guess here, if you do make multiple trips, they will know when you registered the first firearm so I wouldn't wait more than 5 days to get the others registered.  They don't know when you actually arrived but once you start the process, they know that the latest you could have arrived was the first day you stopped by.  Again, just a guess on my part.  Never been through the process.

As far as I know you do not need a doctors note if you are moving to the Big Island. I applied for my Handgun permit in early January and only signed documents and waited my 2 weeks for my permit.  :shaka:

Nobody is required a doctors note, The release you sign allows them to contact your doctor to check to see if  they believes you have a medical condition that would prohibit you from owning a firearm, their was a couple of insurance company's that would would respond with your medical records instead of answering the request with a yes or a no. HPD would not accept this and would deny permits untill you got a doctor to sign a letter stating you are fit to own.

My understanding of the law requires you to sign the form,  It does not require you to provide your doctors information, If you have a doctor and you write None on the form you would be committing a crime, If you left it blank you should be good.

 §134-2 (sub section C) :
(c)  An applicant for a permit shall sign a waiver at the time of application, allowing the chief of police of the county issuing the permit access to any records that have a bearing on the mental health of the applicant.  The permit application form and the waiver form shall be prescribed by the attorney general and shall be uniform throughout the State.

 [§134-3.5]
Disclosure for firearm permit and registration purposes.  A health care provider or public health authority shall disclose health information, including protected health care information, relating to an individual's mental health history, to the appropriate county chief of police in response to a request for the information from the chief of police; provided that:
     (1)  The information shall be used only for the purpose of evaluating the individual's fitness to acquire or own a firearm; and
     (2)  The individual has signed a waiver permitting release of the health information for that purpose.

Update.  Took the guns in yesterday, I got a much later start than I wanted and didn't get down there until about 9:30.  There was a bit of a wait, but only about seven people ahead of me.  Once I got to the window they took all the firearms and inspected and filled out the forms, then gave me the forms to sign.  Easy day.
Once I got my registration form I noticed that three guns were left off, I brought it up to them and they took care of it right away.  Had a good conversation with the Officer about some of the guns I brought in.  Good times.

I did notice that one guy that was in had a huge chip on his shoulder and surprisingly enough that didn't make the process go any easier...

Does the registration system suck?
Does it take a good part of your day?
Yes!
Having a good attitude, positive outlook makes things go smoother.
The guys behind the glass are just doing their job.
Over time, Ive learned this and often joke around with the officers.
Thanks for sharing your experience and asking questions.

I would suggest ignoring Hawaii laws.
There are cops on this site.
You are just the easy target for them.
They can kill with no worry about
prosecution.
Go underground. There are
one million guns registered in Hawaii.
There are probably three times that behind
the front door.
My neighbours have automatic weapons and hunt
with them.
I'd never call a cop on them.  Cops are more dangerous than
any of my neighbours.
