carrying pepper spray in Hawaii
« on: February 06, 2017, 07:42:58 AM »
Hello all, i'm new to the board and would like to know if it's legal to carry pepper spray for personal defense in hawaii?

I'm from pennsylvania where we're a shall issue state (I have had a pennslylvania license to carry firearms for almost 20 years) , and open carry state- so i'm not used to being rendered defenseless by the state. I'll be travelling to hawaii in a couple months for a 3 month stint as a travel nurse.

I looked online a bit about pepper spay and see that it's legal in Hawaii, but don't see anything with regard to carrying it on one's person or in a vehicle. I figured you good folks would be able to let me know what the laws are.

Also, i'd like to bring a .357 magnum revolver to keep in my apartment for home self defense. What requirements (if any) are there to lawfully keep a loaded firearm/ammunition in my residence.

Thanks so much for any help you can provide.

There's no laws against pepper spray here.  There are other banned items such as batons, mace, tasers, and other stuff.

You can keep a firearm in your home for self defense.  Read the summary of laws on http://hawaiirifleassociation.org/ by clicking "about" in the menu.  You will have to register your firearm when you arrive, read the procedures at http://honolulupd.org/.

I suggest joining the HRA which is our local version of the NRA.

Let me know if you have any questions.  Join my meetup group to get oriented to the shooting activities on the island.

These are not legal in Hawaii as it is a firearm by the Crazy Hawaiian laws.
I would also go down to the county sheriff office and get a new Carry Permit, the 50 State reciprocal carry law may pass congress this year which will allow carry in Hawaii.

Pepper spray to carry on ones person is legal, as in it's not on the excluded list of deadly weapons (dirk, dagger, billy, blackjack, butterfly knife, switch blade, taser, metal knuckles).  But there is a section "or any other deadly weapon".  Just make sure to be polite to the cops if they stop you or question  you.

So I guess my JPX  Jet Protector is illegal as well.  Actually even a paintball gun is clasdified as a firearm.  Too bad a blackjack is illegal.  It would be capable of taking anyone out with a good strike to the head.

Thank you all for the answers and opinions (more welcome if you feel so inclined).

My Pa license to carry firearms is still good for another 3 years, so if 50 state reciprocity does pass I should be already covered.

My fiancee actually has the Kimber Pepper blaster you guys posted and carries it everywhere. She lives in New Jersey (We call it New Germany), so much like you good folks in Hawaii, she can't get a permit to carry firearms.

It looks like my posting will be in Kauai. From what i've gathered it's pretty much paradise, but one can never be too safe.

Yes the JPX is a "firearm" by HRS definitions.
It cannot be carried without a CCW permit.

HRS134-1
"Firearm" means any weapon, for which the operating force is an explosive, including but not limited to pistols, revolvers, rifles, shotguns, automatic firearms, noxious gas projectors, mortars, bombs, and cannon.

Too bad.  These look interesting but I probably wouldn't carry those even if legal.

Thanks for being on top of these inane HI laws. Impossible for most of us to keep track of.

I agree, you only have two shots to hit a small face target under stress.  A can of pepper gel would be more effective as a continuous stream and prevent the blow back.

Hi all,
I carry a 26.5 MM signaling device on my boat and transport it  in my vehicle.
If I needed to use it to get someones attention, it would be hard to argue that it
is a firearm, as its purpose is signaling for help.

"Firearm" means any weapon. A weapon is a purpese built or repurposed item made to inflict bodily injury or death.

I'm sure you carry that signaling device unloaded in a rigid enclosed container on your way to and from your business/place of sojourn (boat), right?  :geekdanc:

It's not a weapon, not a firearm. He can carry it tucked in his belt like a pirate if he wants ton

Bruce Willis must have done it somewhere sometime.

I don't see him listed in the following discussion, but seems like he should have done that at least once...

Some one misusing a product as a weapon does not make all the others a weapon, only that one.

Otherwise there'd be a LOT fewer (none?) cars and trucks in "the entire public sphere*".
