On February 27, 2017, you had indicated you had received a loan and it would fund on 3-1-17 or sooner (“possibly today”) You further indicated the total due past due would be paid in full.  On 3-3-17 you indicated that your loan had not yet funded but you would be returning with a $5,000.00 “Cash” Payment.  Samson and I waited until 6:30 PM you did not return.  On Monday 3-6-17 you told us that your “attorney” had picked up a check for more than $20,000.00 and the “Bank would not allow you to just withdrawal $20,000 in CASH, you had to schedule that” – Your Words.  I told you on Monday 3-6-17 that your time was up and we would not except any MORE EXCUSES, you needed to go over to the bank and get a cashier’s check.  You said you were going to the bank to get a Cashier’s Check and NEVER RETURNED! 

You were served a 5 day notice to pay on 2-14-17   YOU FAILED TO PAY.
You were served a notice of breech for cause along with a 45 day notice to vacate by April 1, 2017 on 2-24-17.
On 3-13-17 an additional notice of Breech and Notice to vacate along with a current invoice was taped to your door and photos of the posted notice and invoices were recorded. You removed the notice @ 8:20PM on 3-15-17 (copy of surveillance video logged).

THIS NOTICE DATED 3-22-17 IS ALSO SERVED BY PLACING IT UPON THE DOORS OF THE RENTAL UNIT.

Failure to make payment in full and vacate by April 1, 2017 will resort in additional expenses in filing documents with the court and perusing all legal remedy to recover damages.

You know I'm seriously considering calling these guys, give them Haisuka's MO and strongly advise them go to HPD and register a complaint. If they don't they're fugging stupid and deserve whatever they lose. Only way to stop a rat is to cut its head off. Since the property is commercial and not residential, is it required that the landlord go through all the same eviction steps a person renting out a home would?

FYI, the tax records online show it's a industrial property with structure type = Warehouse.

The short answer is, "no." Residential property evictions are governed by Chapter 521, Hawaii Revised Statutes.  Commerial property evictions are governed by Chapter 666, HRS.

Let's hope he doesn't do something stupid like Road Rage Guy, and turn into just another excuse for the state to continue it's clamp down on gun rights. Someone should press charges for those reasons alone.

SB 898 allows for firearms to be seized based on an ex-parte warrant application based on the low evidentiary standard of probable cause.  An individual is entitled to a hearing, however that hearing may not take place for up to 30 days.  At the hearing, the seized firearms can be retained and a permanent firearm prohibition can be put in place, not because of a disqualifying offense but merely the risk of one.  No one wants dangerous individuals to have access to firearms, however this is not about dangerous people.  This bill sets to ignore the normal rules of criminal procedure in order to promote the anti-gun agenda of the political elites and others.

I'm not even sure how that proposed law is supposed to work unless the state really wants to go out of it's way to harass somebody with no lawyer money. It seems like an enormous waste of energy and resources that could be directed towards investigations and criminal prosecutions. The more I understand about how law enforcement and judicial systems operate the more I'm inclined to believe there's the job-description job that we all expect from them, and then there's the actual job where they pretty much do whatever they like and make up the rules as they go along.

It's like "hey officer, this guy threatened to kill me" and unless you are someone with connections they will blow you off. Or even worse if the person who threatened/attacked you has connections then the cops, DAs, and judges can make your life more difficult until you finally get frustrated and drop it.

But then when that guy goes out and actually kills someone all of a sudden according to them the only way to improve public safety is to take away more rights, harass otherwise law abiding citizens, and arm police like they are soldiers.

So when we tell them "do your job" they shrug their shoulders because technically they are doing their job, just not the one in the official description that we expect them to follow.

Anyway if someone goes after this guy with the 898 I bet it won't work. All they will accomplish is burning up taxpayer money that could be used trying him for fraud.

If the guy's brother thinks he's pathological, it shouldn't be too difficult to make a report and have him labeled "dangerous".  As I said, interesting test case.

Road rage causing him to snap, while possible, is doubtful. He'll never "confront" face to face. Like the rat that he is he'll wait till you turn your back and even then, I don't think he has the balls to do anything. He'll scurry away and wait for his next "opportunity" to exploit others. Like a cancer, he needs to be removed. Getting his guns away from him is only a start but a sound logical one..... :shaka:
