1099 fuckup

Just got a bill from the IRS
 for my 2015 taxs FOR $13000, One of the company's I worked for that year submitted a 1099 that  said they paid my $67000 when in reality they paid me $700. So i guess i have to speak to them and then contact the IRS.

You'll be better off paying the taxes and sending the company an invoice for the unpaid $66,300 .... plus interest and late fees!!   :geekdanc:

The company is in violation of the tax laws by misreporting your earnings. It is a simple process. They submit an amended 1099 to you and the IRS and then you submit an amended return with the amended 1099. However, I would write to them with a return receipt requested letter and explain what happened and what you are doing about it.

They are required to put them in the mail no later than January 31. Copies are required to go to you. But obviously they submitted one to the feds.

If this were me I would Google the laws and requirements surrounding mis reporting of earnings on 1099's and write the company a letter (return receipt requested) and inform them of their mistake and what their requirements are to correct it under the law without threatening them. This should include any timeline they are required to follow such as within 30 days of being notified (Or whatever the law is). Make sure they know you never received a 1099 from them and ask them to correct the address they have for you. I would include a copy of this letter to the IRS if you are going to write to them.

It's a lot of work to do all this writing and mailings but I found companies sometimes don't take you seriously if you phone them. It is to your benefit to document everything from the beginning. JMHO  :shaka: :shaka: :shaka:

That's a standard IRS tactic. 

As long as you make contact with them and explain you are disputing the 1099 and subsequent taxes owed, they can't make you pay.  If, however, they decide against you, then you owe more interest back to the time it was due.  That's on top of penalties.

Has your mailing address changed since you worked for that employer?  If not, it sounds like the company might be trying to hide some revenue they don't want to pay taxes on by claiming bogus expenses.  If they have your address, there's no other reason for them to report to the IRS and not send you a copy.  If that's the case, expect them to delay, lie and ignore you.  They will attempt to avoid getting caught no matter what you have to deal with.

If you can gather evidence of what they paid you, it's a very good start.  The IRS always allows the taxpayer an opportunity to dispute their findings with evidence.  Pay stubs, direct deposit bank records, invoices you sent to the company or copies of checks deposited go a long way toward demonstrating a $700 income versus $67K.

Oh, make sure EVERY SINGLE contact you make with the IRS is through, or followed up with, a letter.  You need to document everything you tell them.  Don't rely on the person on the other end of the phone.  Protect yourself.

Phone calls route to whomever is next to answer.  You'll never be able to get the same person on the phone unless they assign you a case handler.  Then good luck ever finding that person by the phone.

Document, document, document.  It'll save you time and money in the end!   :geekdanc:

I have found the 1099, it arrived after I filed my taxes. The income was however declared so i may have to file an amended tax return, the 1099 is for $675.00 the IRS has it has $67500 so it's obviously a missing decimal point.

That makes much more sense. 

This is the reason the IRS wants every number rounded to the nearest dollar.  It avoids decimal mistakes.

Plus they get to keep the taxes paid under 50 cents.  But if you are lucky enough to have paid 50 cent, you can round up to the nearest dollar.

It may take a year to get it fixed, sorry to say...  When mine was messed up it took me three times, mailing the SAME STUFF to them(with months between replies), before they bothered to look through it and correct their mistake!  Maybe with the new bosses in charge, and hopefully not trying to persecute conservatives, they might get 'er done faster.  Good Luck!  :thumbsup:

PROBLEM SOLVED

This is the letter i sent.

"I do not agree with the changes to my taxs,

I used turbo tax to complete my taxs and at the time entered the 1099-misc information for 2 of the 3 stated,

I did no receive a 1099 from Company 1 The income from which however was reported.

The income from Company 1, Company 2 and Compamy 3 is included in the total income on line 12 of my 1040 and line 38 of my Schedule C.


I also did not get paid $67500 from Company 3, it was a total of $675 on the 1099 there is a decimal point so the total reads 675.00 Included is a copy of the 1099 I received + a copy of the original provided by Company 3.

My total income from  the 3 company’s indicated was a total of $3375 not $70200"


I included a copy of the 1099's and faxed it to the IRS.

Reminds me of after two years being divorced from my slut ex, got a note from her lawyer saying I owed some $...k in tax penalties. 

Told them to pound sand, and told the IRS that the slut had kept all tax records and it was out of my hands. 

Never heard another peep.
