An Oregon REPUBLICAN state senator (Boquist) has introduced a "gun confiscation" bill having some identical language and mostly similar provisions as Hawaii's SB898 (see separate thread for details about that bill). Originally SB868 in Oregon, the bill was stopped due to a procedural error by one of the proponents and has now become SB719A.
Like Hawaii's SB898 this bill provides that based solely upon statements by a family member or any other person, including a police officer, that an "ex parte" hearing (neither the accused nor an attorney representing him is present nor even informed of the hearing) can be held and the accused can be found to be "a danger to himself or others" by "a preponderance of the evidence" (nowhere close to the "beyond a reasonable doubt" standard) and have his Second Amendment rights revoked and all his firearms and ammunition will be confiscated. That person, once informed of the revocation of his rights and the confiscation of his firearms may then petition for a hearing to be held in 30 days wherein he may present evidence to counter the "ex parte" decision. Much of the language/terminology is the same in both bills, the main differences being 1. that the proposed Oregon law also prohibits that person from purchasing a firearm for a whole year, and 2. all the other parts of the law, of course, refer to existing Oregon law that would be amended or deleted in order for the new law to be consistent.
A few weeks ago I called the offices of the House and Senate sponsors of Hawaii's SB898 and asked exactly who was the "third party" for whom they had introduced the bill. They both told me "the Governor". I then immediately wrote the Governor and asked him to tell me where he got the bill from. You'll never guess, but haven't heard a word back. The article below from AWR Hawkins at Breitbart indicates that the bill has some connection with Gabby Gifford's "American for Responsible Solutions" organization. I know there have been other nearly identical bills in other state legislatures this year, so I suspect "ARS" might be the source of the bills. I wonder how many bills the Governor would submit to the legislature that were submitted to him by the NRA or GOA or SAF? Good to know who he's working for... although we've known that all along.
PS I also wrote all those organizations (the county police departments and the AG office) who testified FOR SB898 before the legislative committees asking them to provide data that would substantiate their anecdotal claims about "we've needed to have a law like this in the past", that is, please provide me with the instances wherein you deemed a person "a danger to himself or others" but were unable to confiscate that person's firearms, and then that person went on to harm himself or others
with a firearm he owned. I only got two responses, both from police departments, and both mocked my asking for evidence and refused to provide any evidence that they had ever actually encountered any such situations. I mean, how hard would it be to make a list of the instances they obliquely referred to in their testimony? Here's the literal response I got from one police chief asking for the evidence: "Why?".
