5th amendment video - A must for CCW
« on: May 22, 2017, 11:58:54 AM »
This needs to be watched if you have a CCW permit.  The video is about not talking to investigators without consulting an attorney first, even if you are innocent.  I took several CCW courses and they suggest not talking to the police right after an incident even if you are right and this explains in detail why.

So nobody in Hawaii needs to watch this.    :shaka:

I've watched this several times the last few years.  The first 3 times was to try and keep up with the first speaker's speed-talking!!   :geekdanc:

I used some of the information to debate the aftermath decisions one should make if encountering the police, especially if you've shot someone.

The very first LE person you need to be weary of is the 911 operator.  They ask a long string of questions, partly to give to the responding units so they know what's going on, and partly for the record.

I think you should call 911, ask for help (police & ambulance), and leave the line open.  Answer factual questions (name, location, nature of injuries), but then just stop talking.  You're being recorded.  Saying "I killed him" won't help you when the 911 recording is played in court.

If you are calling 911 DURING the attack, leave the phone connected to the 911 operator so they can listen/record.  It'll back up your version of events better than a witness.

So nobody in Hawaii needs to watch this.    :shaka:

I have many non-resident, non-Hawaii permits.  This is good info for traveling and carrying.  It's also good advise for any other law enforcement interview.

This is a good post. Thanks zip.

I got hooked into the TV series called "The Closer".
The main character specializes in getting perpetrators to confess.
Similar to what was discussed in these videos.

One thing I realized is you can be an innocent person and want to give your story to the police since you did everything right and want to help the investigators.  You get cleared of criminal charges.  But then the bad guys family sues you and twists your statements to police to go against you.

I was taught to do the following by my CCW instructor:

1) Say that I feared for my life (true or I wouldn't have pulled the trigger)
2) Say you will cooperate with authorities after you speak to an attorney (your right to remain silent)
3) Keep your mouth shut after that

Reason why, say they ask "how many shots did you fire?".  An innocent question by the PD. You say "4".  But there are 5 shell casings on the ground, 5 bullets recovered, 5 holes in 1 or more things.  So all evidence points that you fired 5 times.  Now your credibility is in question.
So PD has no intention of making you look stupid, but the prosecuting attorney will or the attorney of the persons family or themselves.

How many shots did you fire?

As many as it took to stop the threat.

I watched these some time ago. They bring up very good points. In the beginning I though at least if you are innocent then why not talk but the retired officer gave an example where an honest statement would later be used against you because of a witness making a inaccurate statement by mistake.

I can see how it's human nature to want to prove your innocence, help with the investigation, and talk story.  Just gotta shut up sometimes.

As I understand it the best thing to say is not that you don't want to speak. Rather you should say you want to help out and are willing to speak but would like to consult with a lawyer first.

This is true especially when talking to the feds because lying to a federal agent is a felony so all they need to do to take you through the ringer is the most tiny inconsequential lie.
