Violation of the 1A?

Just a thought, are the laws banning usage of phones while driving/crossing in violation of the 1A?

Or is the law written that "you can't hold a electronic device" so technically not infringing on freedom of speech because it doesn't say you can't talk on a mobile device.

They aren't banning you from speaking while walking.  The new law is intended to mainly prevent you from reading and sending text messages while walking in the street.  If you're using a hands-free headphone, you can "exercise your rights" while walking out in front of traffic.

Its a ban on using a portable electronic device.... such as reading a text msg ; reading a newspaper does not qualify.

It would be a very far stretch to call it a 1st amendment violation.  Even if it was a 1a right, there can be restrictions for safety or infringing on other peoples rights, like holding protests in the middle of the freeway or blasting a speaker in the middle of a neighborhood.

Still a stupid law though.
